Personal Tax Reforms P.119/2019

THE STATES commenced consideration of a proposition of the Minister for Treasury and Resources entitled Personal Tax Reforms' (P.119/2019) and, adopting the proposition –

  1. agreed that reforms should be made to the Income Tax (Jersey) Law 1961 with regard to the taxation of married couples and couples in civil partnerships in order to –
  1. create joint and several responsibility of married couples and couples in civil partnerships to furnish a joint tax return from the 2021 tax year of assessment, while continuing to provide for the existing election for "separate assessment" under Article 121A;
  2. give  those  couples  described  in  sub-paragraph (i)  equal  rights  of  access  to  tax information, except where couples had opted for "separate assessment"; and
  3. create joint and several liability for the payment of outstanding taxes, except where couples had opted for "separate assessment"; and
  1. requested the Minister for Treasury and Resources to bring forward the necessary draft legislation to give effect to the aforementioned reforms, for approval by the States Assembly during 2020.

Affordable access to Primary Care Scheme P.125/2019

THE STATES commenced consideration of a proposition of Deputy Geoffrey Peter Southern of St. Helier entitled Affordable access to Primary Care Scheme' (P.125/2019) and, adopting an amendment of the Minister for Health and Social Services (P.125/2019 Amd.), agreed that –

in the opening paragraph, the words "on, and removes potential barriers to," should be deleted and after "primary care" there should be inserted the words "by reducing financial barriers";

at the beginning of paragraph (b), there should be inserted the words "for the groups identified in (a),";

in paragraph (b), after the words "reducing the patient co-payment", the words "for G.P. consultations" should be deleted; and

in paragraph (b), the wording that began "for patients" through to the end of paragraph (b) should be replaced with the words ", supporting the development of multidisciplinary services provided in General Practice, which might include expanded roles for pharmacists, nurses, physiotherapists, mental health workers and community support workers; and".

THE STATES, adopting the proposition of Deputy Geoffrey Peter Southern of St. Helier , as amended, requested the Minister for Health and Social Services, in consultation with the Council of Ministers, as appropriate, to devise a scheme which improved access to primary care by reducing financial barriers for patients who were financially, clinically or socially vulnerable, by –

  1. identifying and prioritising which vulnerable groups were most in need of affordable access to primary care;
  2. for the groups identified in (a), reducing the patient co-payment from its current level, supporting the development of multidisciplinary services provided in General Practice, which might include expanded roles for pharmacists, nurses, physiotherapists, mental health workers and community support workers; and
  3. identifying the appropriate sources for the funding of such improved services; and

to bring a proposition for debate by the Assembly in the third quarter of 2020, in order that such a scheme could be implemented from 1st January 2021.

Public Holidays: designation of 27th September 2021 – commemoration of the Corn Riots and the Code of 1771 P.9/2020

THE STATES commenced consideration of a proposition of Deputy Montfort Tadier of St. Brelade entitled Public Holidays: designation of 27th September 2021 – commemoration of the Corn Riots and the Code of 1771' (P.9/2020) and, adopting the proposition –

  1. agreed that Monday 27th September 2021 should be designated as an extra Public and Bank Holiday;
  2. with reference to its Act of 20th November 2012, in which it had agreed that 28th September should be recognised annually by the States of Jersey as Reform Day' to mark the anniversary of the events in Jersey of 28th September 1769, agreed instead that 28th September should henceforth be recognised annually by the States of Jersey as the anniversary of the Corn Riots';
  3. agreed that the events of 28th September 1769 and the subsequent democratic reforms of 1771 be added to the citizenship curriculum in schools;
  4. agreed that there should be an open day of the Royal Court and States Assembly building every year, where possible, on or around this anniversary; and
  5. requested the Chief Minister to bring forward for approval the necessary Act under the Public Holidays and Bank Holidays (Jersey) Law 1951 to give effect to the decision.
