Explanatory Note regarding subordinate legislation tabled at this Meeting

R & O 26/2000
The purpose of this Order is to prescribe new exchange line rentals and National call charges. The Order was made on 14th March and comes into force on 31st March 2000.
R & O 27/2000
The purpose of this Order is to increase the rates of postage for insular and domestic letters and to cancel the separate postal charge for cut flowers.
The Order was made on 15th March 2000 and comes into force on 9th May 2000. R & O 28/2000
This Order further amends the Post Office (Foreign Post Provisions) (Jersey) Order 1973 so as to increase certain postage rates for letters, air letters, postcards, small packets and printed packets addressed to destinations outside the British Islands.
The Order was made on 15th March 2000 and comes into force on 15th September 2000. R & O 29/2000
The effect of these Rules is to prescribe, for the purposes of Article 7 of the Criminal Justice (Evidence and Procedure) (Jersey) Law 1998, the manner in which a party in criminal proceedings before the Royal Court must give notice of expert evidence.
The Rules were made by the Superior Number of the Royal Court on 24th March 2000, and come into force on 1st April 2000.
R & O 30/2000
The purpose of these Rules is to widen the number of cases in which service out of the jurisdiction will be available in the Petty Debts Court. The Petty Debts Court Rules were not amended when the Service of Process (Jersey) Rules 1994 were passed, and the latter had the effect of adding additional categories in relation to service out of the jurisdiction orders in the Royal Court. The new rule refers to the provisions in the Service of Process (Jersey) Rules 1994, which are the updated equivalent of those currently referred to in the Petty Debts Court Rules, but have added Rule 7(m) which refers to a case in which "the claim is brought to enforce a judgment or arbitral award".
The Rules were made by the Superior Number of the Royal Court on 24th March 2000, and come into force forthwith. R & O 31/2000
The purpose of this Order is to reduce certain dues for aircraft carrying passengers which would otherwise have been payable from 1st April 2000.

- a s recommended by the Sport, Leisure and Recreation Committee, the entering into of a Deed of Arrangement with the Jersey Society for the Prevention of Cruelty to Animals (Incorporated), owners ofNo. 70 Val Plaisant, St. Helier, for the purpose of gaining access to the rear of those premises, across Springfield Car Park, which was utilised by the Society, for the sum of £250, with the owners of No. 70 Val Plaisant to be responsible for all legal fees arising from this transaction;
- a s recommended by the Sport, Leisure and Recreation Committee, the lease to Mr. Maurice Francis Gotel of Fields Nos. 116 and 117, Crabbé, St. Mary (together measuring a total of14 vergées), for the purpose of operating a clay pigeon shooting range, for a period of nine years from 25th December 1999, at a commencing annual rent of £750 payable yearly in advance, with rent reviews every three years in line with the percentage increase in the Jersey Retail Price s Index, subject to each party being responsible for its own legal fees arising from the agreement of the new lease;
- a s recommended by the Housing Committee, an increase in the ground rent for the 99 year lease from the Crown of land measuring approximately 18,750 square feet (0.97 vergée) at Le Parcq de la Belle Fontaine, La Rue del'Aval, St. Martin (upon which has been constructed a development of two two-bedroom flats and three three-bedroom flats for social rented purposes), to an annual figure of £10,865 from 24th June 1997, which sum reflected an 8.65 per cent increase in the fair rents set over the same period;
- a s recommended by the Public Services Committee, the lease to the Jersey Electricity Company Limited of an area of land at Field No. 387, Grève de Lecq, St. Ouen , required for the construction of a jointing bay in connexion with the proposed 90 KV cabling link between France and Guernsey, for a period of99 years with a one-off payment of rent of £250 payable upon passing of contract and, in addition, the grant to the Company free of charge wayleave rights in association with the jointing bay (as shown on Drawing No.SCL-1-199-9),on the basis that the Company would, on completion of the works, reinstate the Grève de Lecq sea defences and promenade along with associated land surrounding the jointing bay and cable route to the satisfaction of the Public Services Committee and the Environmental Services Unit of the Planning and Environment Committee, with each party being responsible for its own legal fees arising from this transaction;
- as recommended by the Sport, Leisure and Recreation Committee, the lease to the Jersey Muzzle Loaders and Antique Firearms Association, of part of Field No. 116, Crabbé, St. Mary , for a period of nine years from 25th December 1999, at an annual rent of £150 payable in advance, subject to reviews every three years in line with the percentage increase in the Jersey Retail Price s Index, with all other terms remaining as in the previous lease, on the basis that each party would be responsible forits own legal costs arising from this transaction;
- a s recommended by the Sport, Leisure and Recreation Committee, the lease to the Jersey Outdoor Smallbore Rifle Club of an area of land (measuring 1.65 vergées) at Crabbé, St. Mary, for a period of nine years from 25th December 1999, at an annual rent of £150 payable in advance, subject to rent reviews every three years in line with the percentage increase in the Jersey Retail Price s Index, with all other terms remaining the same as the previous lease, and on the basis that each party would be responsible foritsown legal costs arising from this transaction;
- a s recommended by the Public Services Committee, the renewal of the lease to Gabetty Limited (with Mr. Gabriel De Silva Rodrigues and Mrs. Elizabeth Rodrigues, née de Freitas, acting as guarantors) of the Howard Davis Park Tea Rooms, St. Saviour , for a period of nine years from 1st January 1999, for a base annual rent of £18,000 or a sum equivalent to15 per cent of gross sales recorded, whichever was the greater, with rent reviews on1st January every three years from the commencement date of the lease and with the basic rent to be reviewed on an upwards only basis, the terms and conditions remaining the same as the pre-existing lease, and with each party to be responsible forits own legal costs arising from this transaction.

- a s recommended by the Public Services Committee, the assignment from Mr. Terence Alexander McDonald, to Pyromac Limited, of the existing lease of the property known as the German Bunker, Kempt Tower, La Grande Route des Mielles, St. Ouen , for use as a permanent fireworks magazine store, on the basis that Pyromac Limited would be responsible for the public's legal costs arising from this transaction;
- as recommended by the Policy and Resources Committee, the lease by the Waterfront Enterprise Board Limited to the Jersey Electricity Company Limited of an area of land (measuring 160 square metres/1,722 square feet) within the West of Albert Car Park at La Route du Port Elizabeth, St. Helier (as designated on Drawing No. 53547), for a period of 99 years at an annual rent of £1 payable in one lump sum upon completion of the construction of an electricity sub-station (No. 622), on the usual terms and conditions, with the Jersey Electricity Company Limited to be responsible for the public's reasonable legal fees in connexion with this matter, and with the Waterfront Enterprise Board to meet the total cost (£70,000) of the construction of the sub-station, in return for the Jersey Electricity Company agreeing to provide a high voltage infrastructure throughout the West of Albert area at no cost to the Waterfront Enterprise Board, with the smaller sub-stations to be provided by the developers at a later date;
- a s recommended by the Public Services Committee, the lease to Mr. James William Webster of the bunker at Bouley Bay, Trinity , for the purposes of running his diving school, from 25th December 1999 at a commencing annual rent of £380, subject to annual increases in line with the Jersey Retail Price s Index, on the basis that each party would be responsible for its own legal costs arising from the transaction, with other terms and conditions remaining the same as the previous lease;
- a s recommended by the Public Services Committee, the entering into of a Deed of Arrangement with the Channel Islands Co-Operative Society and the tenants of Le Marais de St. Pierre in order to clarify the boundaries between Goose Green CarPark and the road which provided access to the car park from Beaumont Hill, on the basis that each party would be responsible for the payment of its own legal costs arising from the transaction, and on the basis of the terms and conditions set outin a letter, dated 22nd December 1999, from the Director of Property Services.

The Public Services Committee has accepted the lowest tender for the Halfway Hill Foul Sewer extension to serve properties adjacent to Le Vier Mont, La Route de Longueville and La Rue à Don, in St. Saviour and Grouville , namely that submitted by M.J. Gleeson (Jersey) Limited in the sum of £299,474.81 in a contract period of 26 weeks.

"Now that the Policy and Resources Department has a full-time statistics officer who prepares the Island's quarterly manpower figures on behalf of the Industries Committee, would the President inform members of any recent changes in the methodology used for compiling the figures identifying in particular (or estimating if exact figures are unavailable) the employment categories, and numbers, of economically active people who are -
( a ) n o longer included in quarterly returns; or
( b ) n ow being included in quarterly returns for the first time; or ( c ) in cluded in more than one manpower return?"
Deputy J.L. Dorey of St. Helier will ask the following questions of the President of the Industries Committee -
"(1) Approximately a year ago, when the Finance and Economics Committee administered the Regulation of
Undertakings Law, the President of that Committee predicted that the first prosecutions for breaches of the Law, as most recently amended, were imminent. Would the President inform members -
(a) o f the number and result of prosecutions which have taken place since June 1998?
( b ) o f the number of prosecutions pending?
(2) Wo uld the President assure members that no employees are presently known to be employed illegally, or give an estimate of the number of people believed to be so employed?"

fees for planning and building control services, a draft schedule of fees was agreed and members were informed that fees would be simple, realistic, fair, and equitable with applications being processed within approximately eight weeks. Would the President inform members whether or not the Committee has been able to maintain that target, and if not, would he explain why?
(2) Wo uld the President explain why charges in some categories on the fee schedule have risen by considerably more than the rate of inflation, in breach of the States' policy of increasing charges by no more than 2.5 per cent?"

"(1) Would the President advise members whether the owner of a building listed as a Building of Local Interest

POLICY AND RESOURCES COMMITTEE
The Commission Amicale between the States of Jersey and the Conseil Régionale de Basse Normandie was established by the States on 31st January 1995 following the closure of the French Consulate in Jersey in the early 1990s, with the aim of reinforcing cultural and commercial links between Jersey and France.
One of the Jersey delegation's aims for 1999 was to increase co-operation between Jersey, Lower Normandy and also Brittany in the longer term, and the Jersey delegation will be pursuing closer links with Brittany this year given the obvious gateway to this region through St. Malo.
The Jersey delegation's membership is drawn from different Committees to ensure that as wide a spread as possible of mutual interests between the two communities is represented. Following the reconstitution of the States, and the formation of Committees, in some cases those members who formerly represented the views of a particular Committee no longer serve on those Committees.
Accordingly the Jersey delegation to the Commission feels that a change in its membership is desirable, to maintain the spread of interests, and proposes the following as new members -

Together with existing members, this will ensure that the interests of the Policy and Resources, Finance and Economics, Planning and Environment, Industries, Education, Public Services, Agriculture and Fisheries, Tourism, Sport, Leisure and Recreation, Home Affairs and Postal Committees are represented, as well as the Jersey Transport Authority and the Comité des Connétable s.
The benefits of this membership are clear, given the importance of transport links, the commercial opportunities that may be available, not to mention mutual interests including commercial fishing, planning and tourism issues.
RENT CONTROL TRIBUNAL: APPOINTMENT OF MEMBERS

HOUSING COMMITTEE
Article 3 of the Dwelling Houses (Rent Control) (Jersey) Law, 1946, as amended, provides for the States to appoint a Rent Control Tribunal consisting of a chairman and not less than three, nor more than four, other members. The Law also provides that the chairman and two other members constitute a quorum for any sitting of the Tribunal.
Regulation 2 of the Dwelling Houses (Rent Control) (Jersey) Regulations, 1946, states that the chairman and members of the Tribunal shall hold office for a period of 12 months, ending on 12th April each year and are eligible for re-appointment.
The chairman and two members who served on the Tribunal for the period ending on 12th April 2000 have agreed to allow their names to be put forward for nomination for a further twelve month term. In addition Mr. Christopher Sheehan has agreed to let his name be put forward.
The Committee accordingly has pleasure in nominating the current chairman and the persons named below to serve for a further 12 month term, ending on 12th April 2001 -

Robin Ward is located on the top floor of the General Hospital and Acute Hospital's 1960s Wing. All of the other floors of this building have already been refurbished and the refurbishment is now urgent.
The drawings for the project have been completed and include a central play room, improved relatives' room, waiting area off the corridor, specialised treatment rooms and a new shower room. The reorganisation of space has been achieved by installing new double glazed windows allowing the use of the old balcony areas.
Funding for this refurbishment has already been approved and will come from the Health and Social Services Committee's Capital Vote C3226 scheduled for year 2000.
WATERFRONT ENTERPRISE BOARD LIMITED: APPOINTMENT OF STATES DIRECTORS (P.34/2000)
Senator W. Kinnard has given notice, in proper time and form, of her intention to make an additional nomination of a States member to be a States Director of the Waterfront Enterprise Board Limited. Senator Kinnard's nominee is Deputy A.S. Crowcroft of St. Helier.
