Explanatory Note regarding subordinate legislation tabled at this Meeting

(See Item B)

R & O 151/2000

The purpose of this Order is to establish a framework for the progressive implementation of Part 3 (requirements under legislation) of the Electronic Communications (Jersey) Law 2000.

The intention is that Committees should now start to make arrangements to enable them to receive in electronic form information presently required by legislation to be provided in written form.

As these arrangements progress the titles of the Laws under which information can be supplied in electronic form will be added to this Order.

At the moment the Order does not refer to any enactments since Article  23(2) of the Law provides that the Industries Committee shall not make any Order for the purpose of Part 3 of the Law in respect of any enactment without the approval of the Committee with responsibility for the administration of the enactment (defined as the "relevant Committee" in Article 23 of the Law).

This Order will therefore gradually be added to by other Orders made by the Industries Committee with the approval of or at the request of the relevant Committees.

The Order was made on 13th December 2000 and came into force on 1st January 2001 (the date when the Electronic Communications (Jersey) Law 2000 came into force).

R & O 152/2000

The purpose of this Order is to increase the rental and other charges charged for Private Boxes with effect from 1st January 2001.

This Amendment revises dues charged in respect of moorings.

The Amendment was made on 14th December 2000 and came into force on 1st January 2001.

This Amendment revises harbour dues for arriving and departing passengers, imported and exported goods and mails, and vehicles carried on "drive-on/drive-off" ferries.

The purpose of this Order is to give effect to Council Regulation (EC) No. 2488/2000 which maintains a freeze of funds in relation to Slobodan Milosevic and persons associated with him.

It has been mooted for some years that the Royal Court and the Magistrate's Court should when sentencing be able to allow offences to be "taken into consideration". As long ago as 1970, Sir Robert Le Masurier when he was Bailiff suggested that Rules of Court be drafted for such a purpose. In the event, this initiative was not acted upon.

In 1998, however, the [then] Attorney General examined a renewed recommendation for a régime similar to that in England and Wales under which offences are taken into consideration. It was generally agreed that the way to implement this proposal was by Rules of Court enacted by the Superior Number. As a result, the "Criminal Procedure (Taking Offences into Consideration) (Jersey) Rules 2000" have been prepared to give effect to this recommendation. They are based substantially upon English practice.

Rules 1, 2 and 3 concern when and which offences might be taken into consideration, the power of the Court when sentencing and the status of offences once they have been taken into consideration.

Rule 4 provides for practice directions specifying details of procedure.

Rule 5 provides for the Rules of Court to come into force on 1st March 2001.

There are several advantages to be gained from a procedure enabling offences to be taken into consideration. Much time is expended preparing charge sheets and indictments which charge a multiplicity of offences. Not merely for the police and the prosecution is this a wasteful commitment of time; for counsel and indeed the judiciary itself, the burden of having always to deal with the minutiae of each and every count/charge is not merited in the public interest.

Taking offences into consideration also affords an opportunity for a defendant to make a fresh start by "wiping the slate clean". The Court would still impose a sentence which took account of the other offences, but the defendant could not be sentenced to more than the maximum for the offence with which he was actually charged. Although an offence taken into consideration would not technically amount to a conviction, in practice it would be unlikely for a person to be prosecuted afterwards for the offences which he admitted and which had been taken into consideration. Indeed any subsequent prosecution would require the consent of the Attorney General.

The procedure in each case would involve the preparation beforehand of a schedule of offences to be taken into consideration reciting the date, type of offence and value of any property concerned. The accused would sign the list. Upon sentencing, the Court would be given the schedule and would then ask the accused if he/she admitted the offences and wished them to be taken into consideration. The prosecution would thus be spared the task of having to move sentence on each and every count of an indictment/charge sheet and valuable Court time would be saved as the Court would not have to analyse and adjudicate upon the facts of every related or ancillary charge.

The Rules were made by the Superior Number of the Royal Court on 21st December 2000.

R & O 157/2000

The purpose of this Order, made by the Supervisory Committee, is to prescribe the forms to be used for the purposes of the Parish Rate (Administration) (Jersey) Law 1946.

The Order was made on 19th December 2000 and came into force on 1st January 2001.

R & O 1/2001

This Order prohibits the sale, supply, and importation, of any medicinal product for human use which -

  (a ) c onsists of or contains a plant belonging to a species of the genus Aristolochia or belonging to any of the

species: Akebia quinata, Akebia trifoliata, Clematis armandii, Clematis montana, Cocculus laurifolius, Cocculus orbiculatus, Cocculus trilobus, Stephania tetrandra, or an extract from such a plant; or

(b ) is presented as consisting of or containing Mu Tong or Fangji, a plant belonging to any of the species Akebia

quinata, Akebia trifoliata, Clematis armandii, Clematis montana, Cocculus laurifolius, Cocculus orbiculatus, Cocculus trilobus, Stephania tetrandra, or an extract from such a plant.

These prohibitions do not apply where the sale or supply is to, or the importation is made by or on behalf of, a person exercising functions in relation to the enforcement of food or medicines legislation, or where the product is the subject of a product licence, marketing authorization or homeopathic certificate of registration under UK law.

This Order which was made by the Health and Social Services Committee on 10th January 2001, will come into force on 1st February 2001 and shall continue in force until 31st January 2002, when it will expire.

R & O 2/2001

This Order further amends the Medicines (Prescription Only) (Jersey) Order 1997 ("the principal Order") which specifies descriptions and classes of prescription only medicines (i.e. medicinal products which, subject to exemptions, may be sold or supplied by retail, only with a prescription given by an appropriate practitioner, and which may be administered only by or in accordance with the directions of such a practitioner). Under Schedule 1 to the principal Order, products are included in a class of medicines by reason of the substances contained in them, subject to their being excluded in specified circumstances. Schedule  2 to the principal Order lists the persons exempt from the restrictions on the sale or supply of prescription only medicines imposed by Article  57(2) of the Medicines (Jersey) Law, 1995, and the conditions under which those exemptions are operative.

The amendments made by this Order are as follows -

Amendment of the conditions under which products containing the substance Felbinac may be sold or supplied otherwise than as a prescription only medicine (to increase from 30  g to 50  g the maximum amount of medicinal product that may be contained in a container or package);

Amendment of the conditions under which medicinal products containing Azelastine Hydrochloride, Domperidone Maleate, Paracetamol and Triamcinolone Acetonide may be sold or supplied otherwise than as prescription only medicines;

An exemption from the restrictions on sale and supply of prescription only medicines for products containing the substance Ibuprofen where they are for external use, of maximum strength 10 per cent, have a maximum pack size of 50 grams, and are for administration at a maximum dose of 125 mg and a maximum daily dose of 500 mg;

An amendment to provide that medicinal products containing Domperidone and Lodoxamide Trometamol may be sold or supplied otherwise than as prescription only medicines on the conditions specified;

The inclusion in Schedule 1 to the principal Order of the substance Levocarnitine with an exemption where products are for use for dietary supplementation;

The inclusion in Schedule 1 of the substance Terbinafine Hydrochloride, with an exemption for products which are for external use for the treatment of tinea pedis or tinea cruris, with a maximum pack size of 15  grams and a maximum strength of 1 per cent;

The inclusion in Schedule 1 to the principal Order of the substances Acamprosate, Aceclofenac, Alendronate Sodium, Altretamine, Apraclonidine Hydrochloride, Bicalutamide, Calcipotriol Hydrate, Cefprozil, Didanosine, Exemestane, Ferumoxsil, Imidapril Hydrochloride, Lercanidipine Hydrochloride, Meloxicam, Moexipril Hydrochloride, Moxonidine, Omeprazole Magnesium, Penciclovir, Quinagolide Hydrochloride, Ranitidine Bismuth Citrate, Rimexolone, Sevoflurane, Sparfloxacin, Tamsulosin Hydrochloride, Ticlopidine Hydrochloride, Tiludronate Disodium, Topiramate, Toremifene, Valaciclovir Hydrochloride and Venlafaxine Hydrochloride.

The amendment of Part III of the Second Schedule to the principal Order to extend the exemption from the prohibition to state registered paramedics, and to add to the list of medicines which may be administered by paramedics, medicines containing the substances Ergometrine Maleate 500 mcg per ml with Oxytocin 5 iu per ml, and medicines containing the substances Benzylpenicillin, Frusemide, Metoclopramide, Morphine Sulphate and Streptokinase.

The Order was made on 10th January 2001 and comes into force on 1st February 2001. R & O 3/2001

This Order further amends the Medicines (Sale and Supply) (Miscellaneous Provisions) (Jersey) Order 1997 by amending Article 4 of that Order (pack size for certain medicinal products on a general sale list) to provide that medicinal products containing mepyramine maleate, bisacodyl or heparinoid and which are on the general sale list may be sold or supplied from outlets other than registered pharmacies only in separate and individual containers or packages containing not more than 20 grams of the product in the cases of heparinoid and mepyramine maleate, and not more than 20 tablets in the case of bisacodyl.

The Order, which was made by the Health and Social Services Committee on 10th January 2001, will come into force on 1st February 2001.

R & O 4/2001

This Order further amends the Medicines (General Sale List) (Jersey) Order  1997, which specifies medicinal products that may be supplied otherwise than under the supervision of a pharmacist.

The Order amends Table B (external use only) of Schedule 1 to the principal Order (medicinal products, other than products the subject of a product licence of right, on general sale) by inserting an entry for Alpha-pinene, an entry for Heparinoid for products of maximum strength 1.0 per cent for the relief of bruises, sprains and soft tissue injuries in adults and in children aged 6 years and over, and an entry for Mepyramine Maleate for products of maximum strength 2.0 per cent, for use for the symptomatic relief of insect stings and bites, and nettle stings, in adults and in children aged 2 and over.

The amending Order was made by the Health and Social Services Committee on 10th January 2001 after consultation with the Medicines Advisory Council, and will come into force on 1st February 2001.

NOTIFICATION OF STANDING ORDER DECISIONS - FINANCE AND ECONOMICS COMMITTEE

(delegated functions)

  1. a s recommended by the Housing Committee, an increase in the ground rent for the 99-year lease from the Crown of land measuring approximately 18,750 square feet (0.97 vergées) at Le Parcq de la Belle Fontaine, La Rue de l'Aval, St. Martin (upon which has been constructed a development of two two-bedroom flats and three three-bedroom flats for social rented purposes), to an annual figure of £10,865 from 24th June 1997, which sum reflected an 8.65 per cent increase in the fair rents set over the same period; and also that the rent review clause be revised to provide that with effect from 24th June 1997 ground rent would be reviewed and increased by the same percentage as the percentage increase during the period between the last review date and the current review date in the total annual rents setby the Housing Committee for properties leased by it. (The Committee rescinded its ActNo. A2(d) of 13th March 2000 accordingly);
  2. a s recommended by the Housing Committee, the purchase from the parish ofSt. Helier of the road known as Le Jardin des Carreaux, St. Helier, for the sum of £10, with each party to be responsible for its own legal fees in relation to the transaction (which road had been extinguished as a Parish by-roadbyActof the Royal Court, dated 28th September 2000, in accordance with Article 3 of the Extinguishment of Roads (Jersey) Law 1972, as amended);
  3. a s recommended by the Harbours and Airport Committee, the addendum to the existing lease to Channel Islands Handling Limited (Emeraude Lines) of offices E8 and E8A in the Elizabeth Terminal, in respect of accommodation (the former Police emergency incident room and small adjoining office - measuring 279 square feet) on the mezzanine floor of the Elizabeth Terminal, St. Helier, from 1st November 2000, at an annual additional rent of £4,659.30 (representing a rate of £16.70 a square foot), subject to annual review on 31st October each year until the termination of the main lease on 31st October 2007;
  4. a s recommended by the Harbours and Airport Committee, the renewal of the lease to J.H. Jaffé and Company Limited of the Old Shell House (LF5), La Folie, South Pier, St. Helier, for a period of three years from 1st November 2000, at an annual rent of £13,471.92, subject to annual review in line with the Jersey Retail Price Index;
  5. a s recommended by the Public Services Committee, the re-assignment to Drs. Nigel Minihane, Patrick Higgins and Michael Winspear of the sub-lease of Beresford House, Bellozanne Road, St. Helier for the remaining period of the lease until 6th August 2004, for the annual sumof £14,560 under the same terms and conditions as the existing head lease.

NOTIFICATION OF ACCEPTANCE OF TENDER UNDER RULE 5 OF THE PUBLIC FINANCES (GENERAL) (JERSEY) RULES 1967, AS AMENDED -

" M e mbers will be aware that in many other jurisdictions, security of tenure and the guaranteed return of deposits with

interest are available to tenants. Would the President advise members -

(a ) if the Committee is aware of any steps being taken to secure the return of tenants' deposits held by landlords?

  (b ) w hether the Committee is considering legislation to cover the guaranteed return of such deposits together

with interest accrued?"

"I n 1999 I held a public meeting on improvements for pedestrians in St. Helier No. 1 District and subsequently pressed for improvements. Would the President advise members what is being done to improve facilities for pedestrians at -

  (b ) th e mini roundabout near the Hotel de Normandie?   (c ) th e south end of Dicq Road?

1 .( a ) as the Committee has representation on the Centre Ville Group and helps with that Group's funding, does it

consider that there might be conflict of interest as regards its responsibility for licensing the "Route 88" bus service?

( c ) in light of the findings of the Administrative Appeals Panel into the then Hoppa' bus service, is the

speed limit on Grouville 's coast road at the meeting on 12th December 2000.

Deputy Roy George Le Hérissier of St. Saviour will ask the following question of the President of the Planning and Environment Committee -
