R & O 161/2001

The purpose of this Order is to increase from £64.50 to £66.10 the fee for a licence under Article 39A of the Road Traffic (Jersey) Law 1956 (authorization of use on roads of vehicle not complying with Orders under Article 39 of that Law).

The Order was made on 15th November 2001 and comes into force on 1st January 2002.

R & O 162/2001

If a person applies for the registration in the Island of a vehicle that -

  (a ) is manufactured in a member State of the European Union (other than the United Kingdom), and

  (b ) is not certified under the relevant Directive of the Council of the European Communities as complying with

requirements for left-hand traffic and imperial units of measurement,

this Order requires him to show that the vehicle complies with the Island's legislation relating to construction and use, and lighting. Alternatively, he may show that it is exempted under Article  39A of the Road Traffic (Jersey) Law 1956. These provisions will come into force on 22nd November 2001.

The Order also increases fees payable on applications relating to the registration of motor vehicles, and trade licences. The increases will apply with effect from 1st January 2002.

The Order was made by the Home Affairs Committee on 15th November 2001.

R & O 163/2001

This Order increases from £64.50 to £66.10 both the fee for the written part of the examination for driving instructors for motor cars and the fee for the practical part of that examination.

It also increases from £128 to £131.20 both the fee for entry in the register of driving instructors and the fee for retention in that register.

The Order was made on 15th November 2001 and comes into force on 1st January 2002.

The purpose of this Order is to vary foreign postal rates. The rates were last varied with effect from 3rd April 2001. The Order was made on 15th November 2001 and comes into force on 22nd January 2002.

The purpose of this Order is to vary the insular and domestic letter post rates. The rates were last varied with effect from 3rd April 2001.

The purpose of this Order is to increase the fee payable in respect of the maximum number of persons capable of being lodged in a lodging house from £9.64 a person to £9.88 a person.

The Order was made on 9th November 2001 and comes into force on 1st January 2002.

R & O 167/2001

This Order replaces the Regulation of Undertakings and Development (Return of Employers) (Jersey) Order 1999. There are three substantive changes -

  ( a) R eturns of employees are now to be made half-yearly, within 15 days of 30th June and 31st December,

instead of quarterly.

(b ) T he present exemption of licensees who do not employ staff, from the duty to file returns, is revoked. (c ) T he form of the return is revised. The new form is contained in the Schedule to this Order.

The Order, which was made by the Industries Committee on 16th November 2001, will come into force on 1st December 2001.

This Order increases pilotage dues by 2.5. per cent.

The Order was made on 14th November 2001 and comes into force on 1st January 2002.

R & O 169/2001

Until the enactment of the Law Reform (Disclosure and Conduct Before Action) (Jersey) Law 1999, there was no statutory provision in Jersey for the pre-action disclosure of medical (or indeed any other) records or documents. However, Article  2 of the 1999 Law now provides that, in certain circumstances, an application to the Royal Court for pre-action disclosure of documents in the case of claims in respect of personal injury or death can be made. These Rules require that such an application be made to the Royal Court by representation (that is to the Inferior Number at a Friday afternoon sitting) supported by an affidavit stating the grounds on which it is alleged that the applicant and the person against whom the order is sought are likely to be parties to subsequent proceedings, and specifying the documents in respect of which the order is sought. The Rules also make provision as to service of the representation on the relevant parties and empower the Court to make a disclosure order conditional upon giving security for costs or on other terms. Privileged documents are protected from disclosure.

The Rules were made by the Superior Number of the Royal Court on 19th November 2001 and come into force on 1st December 2001.
