Explanatory Note regarding subordinate legislation tabled at this meeting. R&O 102/2002

The purpose of this Order is to -

  (a ) r e vise the conditions for the issue of a disabled persons badge;

  (b ) p r escribe the fee to be paid on application for a badge or a duplicate badge; and

  (c ) p rescribe a new form of badge that is similar to the parking card being introduced throughout the European

Community.

There is provision for the continued recognition of "orange badges" still current on commencement of this Order. The Order was made on 30th September 2002 and comes into force on 1st November 2002.

R&O 103/2002

The purpose of this Order is to revise the provisions concerned with the parking of vehicles used by disabled persons in the Parishes of Grouville , St. Brelade , St. Helier and St. Saviour so as to enable recognition of parking cards validly issued to visitors from countries or territories that issue parking cards on the basis of the EC "Blue Badge" scheme as well as to allow recognition of other foreign parking permits. The opportunity has also been taken to clarify the relevant provisions, make a few changes to the prescribed parking places in St. Helier and place them together in a new Order dealing specifically with parking for disabled persons.

The Order was made on 30th September 2002 and comes into force on 1st November 2002.

The purpose of this Order is to revoke the provisions of the Road Traffic (Saint Helier) (Jersey) Order 1996 concerned with the parking of vehicles used by disabled persons in the Parish of St.  Helier consequential upon their re-enactment in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002. Some changes are made to the Schedule dealing with parking places on roads as a consequence of changes made to the disabled parking provisions in the new Order.

The purpose of this Order is to revoke the provisions of the Road Traffic (Saint Brelade) (Jersey) Order 1990 concerned with the parking of vehicles used by disabled persons in the Parish of St. Brelade consequential upon their re-enactment in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

The purpose of this Order is to revoke the provisions of the Road Traffic (Saint Saviour) (Jersey) Order 2000 concerned with the parking of vehicles used by disabled persons in the Parish of St. Saviour consequential upon their re-enactment in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

The Order was made on 30th September 2002 and comes into force on 1st November 2002.

The purpose of this Order is -

  1. to r e voke the provisions of the Road Traffic ( Grouville ) (Jersey) Order 2002 concerned with the parking of vehicles used by disabled persons in the Parish of Grouville consequential upon their re-enactment in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002; and
  2. to in troduce a 6 foot 6 inches width restriction on La Rue des Alleurs.

The Order was made on 30th September 2002 and comes into force on 1st November 2002.

R&O 108/2002

The purpose of this Order is to amend the provisions in the Road Traffic (Saint Lawrence) (Jersey) Order 1990 concerned with paying parking places on roads to bring them in line with the Parish of Saint Helier and thereby enable disabled persons to park for a period of 2 hours instead of 20 minutes.

The Order was made on 30th September 2002 and comes into force on 1st November 2002. R&O 109/2002

The purpose of this Order is to revise the definition of "disabled person's badge" as a consequence of the widened definition contained in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002, which affords recognition of certain parking devices issued to disabled persons by authorities outside the Island.

The Order was made on 30th September 2002 and comes into force on 1st November 2002.

This Order introduces a parking permit scheme for domestic and business residents within a defined zone in the Stopford Road area in St. Helier, for a trial period of 12  months commencing on 4th November 2002.

A person who has a place of residence or business in the zone, and keeps a vehicle for personal use, may obtain a "resident's parking permit" from the Public Services Committee. A fee of £150 will be payable for a permit for the full term of the trial period, but this will be reduced pro rata for applicants applying after it has commenced. The permit will authorize the holder to park the vehicle at any time in any parking place that is reserved for the purposes of the Order in the zone. Provision is also made for the Connétable of Saint Helier to allow vehicles to use reserved parking places on an ad hoc basis.

Two kinds of parking places will be reserved -

  (a ) T hose in Part 2 of Schedule 1 to the Order will be set aside for the exclusive use of permit holders at all

times.

  ( b ) T hose in Part 3 of that Schedule will be reserved for permit holders at night and on Sundays. Anyone

(including a permit holder) may use them at any other time on a paying basis using parking cards, under the Road Traffic (Saint Helier) (Jersey) Order 1996, for stays not exceeding 2 hours.

Reserved parking places within the zone will be available on a "first come, first served" basis to any persons (whether permit holders or other motorists) who are for the time being allowed to use such parking places.

The issuing of permits will depend on the availability of parking places, and in dealing with applications the Committee may give preference to the holders of disabled person's badges.

A person may have only one permit at a time, and may hold it only in respect of a specified vehicle. Permits are not transferable to other persons. However, the unexpired period of a permit may be transferred without charge to another vehicle kept by the holder. Subject to an administration fee of £10, a proportionate refund may also be obtained if the holder surrenders the permit on moving away from the zone.

This Order does not affect the lawful use of public car parks, and parking places in the zone that are not specified in Part 2 or Part 3 of Schedule 1.

The Order was made by the Public Services Committee on 30th September 2002, after consultation with the Connétable of Saint Helier.

R&O 111/2002

The effect of this Order is to designate specified parking places in the residential and business parking zone in the Stopford Road area in Saint Helier as two-hour paying parking places during the times at which they are not reserved for the use of permit holders.

The Order also varies the provisions of the Road Traffic (Saint Helier) (Jersey) Order 1996 in respect of waiting restrictions, the closure of roads to vehicular traffic, parking places and the parking of motor cycles and mopeds in the Parish of St. Helier.

The Order was made by the Public Services Committee on 30th September 2002, after consultation with the Connétable of Saint Helier, and comes into force on the same day as the residents' parking scheme, i.e. 4th November 2002.

The Order will continue in force after the scheme (which is for a trial period of 12 months only) comes to an end.
