Explanatory Note regarding subordinate legislation tabled at this meeting.
R&O 180/2005
The object of this Order is to enable the electronic submission of income statements on behalf of individual taxpayers and to set out the conditions for that.
At present tax agents already have, by agreement with the Comptroller of Income Tax, the option of submitting individual clients' income statements electronically. However each statement so submitted has still been required to be followed by a statement set out on paper and signed by the taxpayer.
This Order, by specifying income statements for the purposes of Part 3 of the Electronic Communications (Jersey) Law 2000, would effectively increase the degree of reliance that may be placed on the electronic statement. However, this Order also sets out conditions for the electronic submission of an income statement, and they include the condition that there be a corresponding paper statement kept by the tax agent.
The Order was made on 24th November 2005, and comes into force on 1st December 2005. R&O 181/2005
This Order sets out requirements for the handling of insurance money by persons ("registered persons") who are registered under the Financial Services (Jersey) Law 1998 to carry on general insurance mediation business. It restricts the financial institutions with which insurance money may be held, specifies how insurance money is to be dealt with, imposes monthly accounting requirements and makes a registered person responsible for the safe keeping of clients' policy documents. The Order also creates a mechanism ("pooling") for ensuring that all clients of a registered person are treated equally in the event of the collapse of the registered person's business.
The Order permits the Commission to exempt certain persons from the requirements of this Order, if it is of the opinion that they are appropriately regulated by the laws of other jurisdictions.
This Order was made on 24th November 2005, and comes into force 7 days afterwards. R&O 182/2005
This Order amends the Financial Services (General Insurance Mediation Business (Accounts, Audits, Reports and Solvency)) (Jersey) Order 2005 so as to make the exemption provision in that Order the same as the exemption order set out in the Financial Services (General Insurance Mediation Business (Client Assets)) (Jersey) Order 2005 (R&O.181/2005).
The Order was made on 24th November 2005 and comes into force 7 days afterwards. R&O 183/2005
This Order amends the Airport Dues (Tariff) Order (Jersey) 2003 by lowering from £6.05 to £5.50 the tariff to be paid by an aircraft to land a passenger, and imposing a tariff of 4p for each 10 kg of bulk newspapers that are landed by an aircraft.
The Order was made on 24th November 2005, and comes into force on 1st January 2006.
