Explanatory Note regarding subordinate legislation tabled at this meeting. R&O 37/2005
This Order requires persons engaged in specified nuclear and nuclear-related activities to give certain details about themselves and those activities to the Policy and Resources Committee. Jersey has, through the U.K., an obligation to the International Atomic Energy Agency to provide certain information in relation to these activities and the Order will enable the Committee to pass on any such information.
Article 1 contains the defined terms. Article 2 imposes an obligation on a person to notify the Committee if the person has carried out any of the activities specified in the Schedule or any nuclear fuel cycle-related research and development activities (as defined) without specified time limits. Article 3 sets out the particulars to be included in the notice and includes an obligation to give the Committee notice of any change of particulars.
Article 4 will change the references in the Order to "Committee" to refer to the Chief Minister. Article 5 contains the citation provision and provides for the Order to come into force 7 days after it is made, apart from Article 4, which is expressed to come into force on the same day as the change to Ministerial government.
