This Order gives effect to the 5 codes of practice set out in the Schedules to the Order.
The Order was made on 6th December 2006 and comes into force on the same day as the Regulation of Investigatory Powers (Jersey) Law 2005.
R&O.147/2006
This Order authorizes certain interceptions of telecommunications which would otherwise be prohibited by the Regulation of Investigatory Powers (Jersey) Law 2005.
The interception must be by or with the consent of a person carrying on a business. For this purpose, administrations of the States, public authorities and others exercising functions conferred by enactments are taken to be carrying on a business.
The interception must be for purposes relevant to the business, and using the business's own telecommunications system.
Interceptions are authorized for –
(a) m o nitoring or recording communications –
– t o e stablish the existence of facts, to ascertain compliance with regulatory or self-regulatory practices or procedures or to ascertain or demonstrate standards which are or ought to be achieved (quality control and training) (NOTE: in this case the authorization is limited to what would be permitted in a Member State by virtue of Article 5 of Council Directive 2002/58);
– in t he interest of national security (in this case, only where the interception is made by or on behalf of the police or another law enforcement or intelligence agency specified in the principal Law);
– t o p r e v e n t or detect crime;
– to in vestigate or detect unauthorized use of telecommunications systems; or
– in o rder to secure or as an inherent part of the effective operation of the telecommunications system;
(b) m o nitoring received communications to determine whether they are business or personal communications; or
(c) m o nitoring communications made to anonymous telephone helplines.
Interception is only authorized if the controller of the telecommunications system on which they are made has made all reasonable efforts to inform potential users that interceptions may be made.
Article 5 of Council Directive 2002/58 says –
"Confidentiality of the communications
- MemberStates shall ensure the confidentiality ofcommunications and the related traffic data bymeans of a public communications network andpublicly available electronic communications services, through national legislation. In particular, they shall prohibit listening, tapping, storage or other kinds of interception or surveillance ofcommunications and the related traffic data bypersonsother than users, without theconsentof the users concerned, exceptwhen legally authorisedtodoso in accordance with Article 15(1). This paragraphshall not preventtechnical storage which is necessary for the conveyanceof a communicationwithoutprejudiceto the principleof confidentiality.
- Paragraph 1 shall not affect any legally authorised recordingofcommunications and the related traffic data when carried out in the course oflawfulbusiness practice for the purposeof providing evidenceof a commercial transaction orof any otherbusinesscommunication.
- MemberStates shall ensure that the use of electronic communications networks to store information or to gain access to information stored in the terminal equipmentof a subscriber or user is only allowed on condition that the subscriberor user concerned is provided withclear and comprehensive information in accordance with Directive 95/46/EC, inter alia about the purposesof the processing, and is offered the right torefuse such processing by the data controller. This shall not prevent anytechnical storage or access for the sole purposeof carrying out or facilitating the transmission of a communicationoveran electronic communicationsnetwork,oras strictly necessary inorder to providean information society service explicitly requestedby the subscriber or user."
The Order was made on 6th December 2006 and comes into force on the same day as the Regulation of Investigatory Powers (Jersey) Law 2005.
R&O.148/2006
This Order contains miscellaneous provisions supplemental to the operation of the Regulation of Investigatory Powers (Jersey) Law 2005.
Article 1 is the interpretation provision.
Article 2 specifies information that must be included in the records kept relating to covert human intelligence sources.
Article 3 restricts the use of a covert human intelligence source who is under the age of 16.
Article 4 requires that, if a covert human intelligence source is under the age of 16, an appropriate adult (for example, a parent or guardian) must be present at any meeting between the source and the investigating authority. Article 5 requires that, where it is proposed to use a covert human intelligence source who is under the age of 18, the use of the source cannot be authorized without the risk of physical injury or psychological distress to the source being assessed. If there are such risks, they must be justified and explained to the source.
Article 6 provides that an authorization to use a covert human intelligence source who is under the age of 18 cannot have effect for more than one month, although it can be renewed.
Article 7 specifies who must exercise any duty to cancel an authorization in the event that the person who would otherwise be subject to that duty is no longer available to exercise it.
Article 8 specifies circumstances in which a person who has power to grant an authorization may delegate that power.
Article 9 provides for the Order to come into force as the same day as the Law.

This Order increases by 2.4% the fishing boat licence fee (a fee that was last increased early in 2006) and by 5% and 3% the scallop permit fees (fees that were last increased at the end of 1999).

The purpose of this Order is –
- t o narrow (to mostcattle) the class of animals towhich the Contagious Abortion (Jersey) Order 1958 is expressed to apply, because contagious abortion (now more commonly known as bovine brucellosis orby the nameofthe pathogen responsible Brucella abortus) does not normally affect sheep, goats or pigs, and only rarely affects horses;
- t o give temporal precision tothemeaning, for certain purposes,ofabortion in that Order;
- t o makeitclearthat, when a cow is deemed to be affected with bovinebrucellosisbecauseithas suffered an abortionor premature calving, a notice from an inspectormayend that deemingin appropriate cases;
- t o makeit clear that when a cow suffers an abortion or prematurecalving, the personincharge must keep thecalfor foetus, and other matter, untilnotified otherwise byan inspector;
- t o allow the Minister touse discretion in decidingwhether to have animalsexamined in certain cases of bovinebrucellosisor suspected bovinebrucellosis.

This Order means that the accounts of any body that receives from the States £5,000 or more to carry out its activities may be audited by the Comptroller and Auditor General.

R&O.153/2006
This amendment to the Tariff of Harbour and Light Dues will –
- i ncrease, by 2.5%, the harbour dues for arriving and departing passengersandvehicles carried on drive on/drive off' ferries;
- i ncrease, by 3.6%, the dues payable for marina, visiting craft and other mooring spaces.
The dues were last increased 1 year ago. The Amendment was made on 13th December 2006 and came into force 1st January 2007.
R&O.1/2007
This Order amends the Order which sets out restrictions on the movement and parking of vehicles in St. Helier . Article 6 sets out –
- n e w provisions that establish a requirement that only persons with residential orbusiness parking permits should be able to park in certain parts of the Stopford Road Zone' or the Richmond Road Zone' at certain timesof day;
- fe e s of £200 a year for a resident'sparking permit in the Stopford Road Zone, £100 a year for a resident's parking permit in the Richmond Road Zone and £150 a year for a business parking permit in the RichmondRoad Zone;
- th a t a permit in relation to a vehicle maybe transferred to a substitute vehicle and that a proportionate amountof the fee forthepermitmayberefundedifthepermitis surrendered.
Article 7 prohibits motorcycles and mopeds from being parked on certain areas of road within the Zones. Other Articles make amendments consequential to the provisions inserted by Article 6, or amend the Schedules setting out –
- ro a ds in other parts of St. Helier that are one-way traffic routes (Schedule1);
- ju n ctions at which vehicles are required to stop (Schedule 3);
- ro a ds where waiting is prohibited (Schedule 4);
- ro a ds onwhich paying parking places are established (Schedule 8);
- ro a ds where parking for the purpose of loading orunloadingvehiclesisrestricted(Schedule 10); and
- w h ere motorcyclesandmopedsmay,ormay not, be parked(Schedule 11).
The Order shall come into force 14 days after it is made.

R&O.2/2007
This Order corrects a reference to "Committee" to read "Minister" in the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 and further amends that Order to make changes to the disabled parking places provided on roads in St Helier.

"Further to public concerns, would the Minister undertake to ensure that no mobile telephone masts and base units are sited less than 300 metres from any school or medical facility?"

The Minister for Housing will table an answer to the following questions asked by Deputy G.P. Southern of St. Helier –
" ( a ) On page 43 of the report "Planning for Homes 2006" (R.94/2006) it states that one of the contributing factors to the rise in activity (and prices) in the housing market identified by estate agents is "new j category' (essential employee) buyers". How does the Minister reconcile this with his written answer on 5th December 2006 in which he stated that "it is simply not plausible () to ascribe the increase in house prices to a small number of essential employees"?
- In light of the statement in the Planning for Homes2006report that the average prices for certain 3 bedroom housesarenow"more than ten times current average annualearnings" what action, if any, does the Minister intend to take to tackle this situation in a meaningfulway?

The Chief Minister will table an answer to the following question asked by Deputy G.P. Southern of St. Helier –
" W o uld the Chief Minister inform members what progress, if any, has been made towards co-ordination between the Population Office, the Health and Social Services Department, the Social Security Department and the Data Protection Commissioner over the Population Register?"
The Minister for Social Security will table an answer to the following question asked by Deputy G.P. Southern of St. Helier –
"( a ) Would the Minister agree to seek an explanation from the Employment Forum for its decision to base
the 2007 minimum wage recommendation on the figure of 40% of the average wage and inform members of it and, in particular, would the Minister seek an explanation of why the recommendation is not referenced to the internationally accepted relative low income threshold of 60% of median income?
(b ) Would the Minister inform members of Jersey's current relative low income threshold for a 40-hour
week, and state how the minimum wage recommendation relates to this weekly figure?
(c ) I n the light of this information, what steps, if any, will the Minister take to lift the family types given
in Table 13 of the 2002 Income Distribution Survey (appropriately updated) on the minimum wage out of relative poverty? In particular, will he consider raising the minimum wage above the recommendation?
(d ) Does the Minister support the Employment Forum's recommendation to introduce a "Youth Rate" at
£4.05 for employees aged 16 to 18 in full-time education? Is the Minister aware of any such employees (in Saturday/holiday jobs) who are currently paid at a lower rate?

in 2006 appeared "to be as a result of growth and change in employment rates at the lower to middle- income earning levels." Would the Minister inform members what progress, if any, has been made in investigating this increased demand on tax revenues?

Commissioner over the questions asked in the application forms IS.01R and IS.01T relating to Income Support?
( b ) How many households have been asked to complete these application forms and how were they
chosen?
(c ) Can the minister explain why a 27-page questionnaire of such complexity for benefit claimants is
necessary and, in particular, justify, on data protection grounds or otherwise, why the following information is being requested –
( i) d e t a ils of any assets over the value of £1,000 held by the claimant or anyone in the household
(section H, p.17).
( ii ) the current value of any land or property and income received by any other household member
(section H, p18).
( ii i) d e ta ils of –

What safeguards, if any, are, or will be, put in place to ensure that data are not inappropriately shared? Will the Population Office be added to the list of those departments that can share the data and, if not, is the population register to be kept entirely separate?"

" W o uld the Minister inform members what target deadlines, if any, were set for the production of the following reports on the potential sell-off of Jersey Telecom and state whether any targets set have been met? If not, has this had any impact on the proposed schedule for action on this matter?
