R&O.51/2009.
These Rules of Court amend further the Advocates and Solicitors (Qualifying Examination) Rules 1997 ("the principal Rules"). The main purpose of the amendment is to require a person applying to sit the final examination for advocate or solicitor (écrivain) to have enrolled on an approved course of instruction. Each Rule makes the following provision:
Rule 1 merely defines the principal Rules.
Rule 2 amends Rule 1 of the principal Rules to make the requirement that a person applying to sit the final examination must have enrolled on an approved course of instruction. In this context approved' means approved by the Board of Examiners ("the Board") constituted under Article 9 of the Advocates and Solicitors (Jersey) Law 1997; and course of instruction' means a course of instruction in the law of Jersey set by an approved person or body.
Rule 3(1) amends Rule 3(7) of the principal Rules to require the Board to appoint 2 sessions each year for th holding of the relevant examinations –
- o ne in June andJuly; and
- o ne in September.
Rule 3(2) amends Rule 3(18) of the principal Rules so as to require a candidate, in order to be successful in the final examination, to pass all the papers within a period of six successive sessions appointed by the Board under Rule 3(7).
Rule 4 amends Rule 4 of the principal Rules consequentially upon the amending provisions above.
Rule 5 exempts from the requirement to enrol on an approved course of instruction a candidate who before 1st January 2010 has already passed one or more of the papers in the final examination.
Rule 6 is a customary citation and commencement provision.
The Rules were made by the Superior Number of the Royal Court on 1st June 2009 and come into force on 1st January 2010.
