R&O.39/2010.

This Order restricts parking in the parking bays on La  Rue Hamel to 12  hours in any 24  hours. The Order was made on 23rd April 2010 and came into force on 30th April 2010.

R&O.40/2010.

This Order replaces the Competition (Mergers and Acquisitions) (Jersey) Order  2005.

The effect of the Order is that certain acquisitions of undertakings will no longer need the prior approval of the Jersey Competition Regulatory Authority.

This applies where the undertaking being acquired has no existing interest in Jersey or where its interest in Jersey is not being acquired.

The Order was made on 27th April 2010 and came into force on 4th May 2010, 7  days after it was made. R&O.41/2010.

This Order specifies qualifications, and proof of qualifications, that a person must have in order to be registered as a pharmacist or pharmacy technician, and the information to be contained in the register of pharmacists and pharmacists kept by the Minister for Health and Social Services. It further specifies the information to be provided annually by registered pharmacists and registered pharmacy technicians to the Minister.

The Order further makes transitional arrangements for pharmacists. A person whose name, immediately before 16th May  2010, is on the list of pharmacists kept by the Royal Court and satisfies the requirements for registration specified in this Order, has 4 months from that date in which to apply for registration under the Pharmacists and Pharmacy Technicians (Registration) (Jersey) Law  2010 and in accordance with the detailed requirements of this Order.

The Order was made on 28th April 2010 and comes into force on 16th May 2010.

" W ould the Chief Minister advise whether Orchid Communications has been employed by the Waterfront Enterprise Board (WEB) to undertake promotional work and, if so, why is this considered necessary at this time in view of the proposed establishment of a States property company to take over WEB?

 H  ow many officers on average, and at what grades, are involved in the process of producing a single

Ministerial Decision from its inception to its appearance on the gov.je website?

C a n he explain to members why there has been a massive reduction in the number of decisions published on

the website by each Department compared with the old Committee system of "Acts" published along with the accompanying reasons or briefing papers?

H as "Livelink" reduced the information available to scrutiny and the public rather than increasing

accessibility and accountability, as it was expected to do?

W ith set up and hardware costs at over £2million and annual running costs of £131,000 for the licence alone, does the Minister consider the system to be an efficient alternative to the Committee Clerks it replaced?"

( a ) whether Jersey Finance commissioned the report "Transfer mispricing and child mortality" by

drafting of the revised VR terms and at what stage is it intended to consult them?

W  hen public sector terms and conditions are investigated as part of the Comprehensive Spending Review at

before bringing any proposals to the States for ratification?"

" F ollowing the undertaking given on 20th April 2010, will the Minister inform members what request he has made to the Jersey Competition Regulatory Authority over the consultation timescale concerning the granting of class 1 postal licences to two competitors to Jersey Post and inform members what the new timescale for the process is now?

W  ill he advise what meetings, if any, he has had with stakeholders to address the concerns expressed by

Jersey Post and the Communications Workers Union and if not why not?

W  hat steps, if any, has he taken to ensure that the impact of the introduction of new competitors in this sector

on the maintenance of postal Universal Service Obligations are made clear to the Jersey public, and if no steps have been taken, when will he do so?"

" A re Rank Taxi drivers to be charged a fee to collect passengers from the Airport like Taxi Cab drivers and if, so what will be the charge levied?

" F urther to my written question of 20th April 2010, in relation to scaffolding at a building in La  Motte Street, when the Minister stated that one of the problems delaying the removal of the scaffolding was the death of the owner, would the Minister state if he has information regarding the ownership of the building and, if so, disclose this to members?

W  ould the Minister further advise whether the detrimental effect of the scaffolding to other businesses in the

vicinity has featured in his department's discussions with the owners of the property and outline what pressures, if any, can be applied to bring ensure that the scaffolding is removed as swiftly as possible?"

" F urther to the 1996 legal advice referred to in the PWC Report 1999 (page 14) has the Minister taken recent legal advice on the need to avoid any contamination of neighbouring properties on the Talman site and on the consequences for the States of Jersey if such pollution does occur and, if so, would he advise members what advice was received?

H  as the Minister formally evaluated the risk of contaminating neighbouring properties under the different

options for the creation of the Park, especially the Park only' and the Park with buildings wrapped around the eastern edge' options and, if not, why?
