(See Item B)

R&O.9/2010.

This Order makes it clear that class licences may be granted for imports of certain animals, of certain materials derived from animals and of certain plant-based materials. It also enables general (public) licences to be granted for those imports.

Article 1 names the Diseases of Animals (Importation of Miscellaneous Goods) (Jersey) Order 1958 as the "principal Order" for the purposes of this Order.

Article 2 restates the general requirement that certain imports be made in accordance with the restrictions and conditions set out in Schedule 1 to the principal Order. But Article 2 also makes it clear that another possibility is to make an import in accordance with a licence, and that will now include the possibility of a general licence that allows any person to make the import.

Article 3 restates a requirement to comply with conditions attached to licences. The requirement is restated in such a way as to apply also to conditions attached to general licences. Article 3 also makes a change so as to require the Minister to publish general licences on a States website.

Article 4 amends Schedule 1 for the sake of law revision and to introduce a restriction on imports of amphibians. Article 5 revokes Schedule 2, which is no longer needed.

Article 6 gives the citation of the Order, and Article 7 provides for the Order's commencement.

The Order was made on 29th January 2010 and comes into force on 5th February 2010.

R&O.10/2010.

This Order makes changes to allow the keeper of a pig, goat, or sheep in Jersey the option of relying on ear tags fitted to such an animal before its import into Jersey, instead of having to fit new tags when the animal is imported into Jersey. The Order also enables the use of microchips in certain cases.

Article 1 makes the Diseases of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007 the "principal Order" for the purposes of this Order.

Article 2 inserts a definition of "officially recognized".

Articles 3 and 4 make changes to allow the keeper of a pig, goat, or sheep in Jersey the option of relying on ear tags fitted to such an animal before its import into Jersey. To qualify under this option, the foreign ear tag or tags must be officially recognized by the competent authority where they were issued.

Article 5 adjusts existing Article 5 (identification of animals moved off a holding) as a consequence of the changes made by Articles 3 and 4.

Article 6 similarly revises existing Article 7 (removal, defacing or replacement of an ear tag). Article 7 makes changes to allow a microchip or other electronic identification device to be used –

  1. i nstead of a secondconventional ear tag onany pig, goat orsheep (new Article 7A);or
  2. i nstead of any conventional ear tag on a pig, goat, orsheep, kept by Durrell Wildlife Conservation Trust (new Article 7B).

Article 8 gives the citation of the Order, and Article 9 provides for the Order's commencement. The Order was made on 29th January 2010 and comes into force on 5th February 2010.
