R&O.79/2012.

This Order increases certain fees connected with the issue of certificates in respect of unclassified collective investment funds and imposes new fees upon the occurrence of specified events. This is the first change in the fees since the arrangements for certification commenced in 2008. The fees have been consulted upon (see JFSC Consultation Paper No. 1/2012).

The Order was made on 25th June 2012 and came into force on 1st July 2012. R&O.81/2012.

Article 1 of this Order makes an amendment to ensure that the Shipping (Employment of Young People) (Jersey) Order 2007 does not prevent certain children from working in Jersey waters on Jersey-registered ships, or ships owned by Jersey residents or Jersey companies, for the purposes of gaining work experience while at school. This can only be done with approval from the headteacher and the Harbour Master.

Articles 1 and 2 change cross-references in that Order consequentially on the enactment of the Harbours (Inshore Safety) (Jersey) Regulations 2012 by the States.

Article 3 similarly changes a cross-reference in the Shipping (Safety of Navigation) (Jersey) Order 2009.

The existing cross-references are to licences that apply to boats, being licences under Part 4 or 5 of the Boats and Surf-Riding (Control) (Jersey) Regulations 1969. These Regulations have been replaced by the Harbours (Inshore Safety) (Jersey) Regulations 2012. Under the latter, the cross-references need to be to permits under Regulation 6 in respect of ships.

Article 4 sets out the short title of this Order and provides for it to come into force a week after it is made. The Order was made on 28th June 2012 and came into force on 5th July 2012.

This Order gives effect in Jersey to Council Regulation (EU) No. 545/2012 of 25th June 2012 (OJ L 165/23 26.6.2012) ("the amending Regulation") and Council Implementing Regulation (EU) No. 544/2012 of 25th June 2012 (OJ L 165/20 26.6.2012) ("the implementing Regulation"), by further amending (by Article 2) the Community Provisions (Restrictive Measures – Syria) (Jersey) Order 2012 (defined by Article 1 as "the principal Order").

The amending Regulation amends Regulation (EU) No. 36/2012 concerning restrictive measures in view of the situation in Syria, to develop the application of those measures related to financial assistance in the context of the arms embargo. The implementing Regulation adds the persons and entities listed in the Annex to that Regulation, to the list of those subject to restrictive measures set out in Annex II to Regulation (EU) No. 36/2012.

Article 3 provides for citation and commencement of this Order.

The Order was made on 4th July 2012 and came into force on 5th July 2012.

Given that one of the key outcomes of the conference was to remind British Consuls overseas of their duties to support the interests of British and not just UK shipping worldwide, does the Minister consider that Jersey has been appropriately represented in relation to Jersey registered Vessels overseas and, if so, give examples?"

Will he also state whether this new initiative is intended to replace the missing £3.6 million from his CSR savings targets resulting from the abandonment of proposals to reduce the subsidies to the fee- paying sector and, if not, does he intend to re-introduce reductions in these subsidies in the period to 2016?"

"Will the Minister explain why his major proposal to remove final salary pensions for public sector employees appeared in the press in advance of any statement to States members or to public sector representatives?

Does he not consider that while negotiations on pay, terms and conditions for the public sector are at a sensitive stage, his statement may be seen as inflammatory?

Will he explain to members:

  1. why this issue was not left to the States Employment Board to consider as part of its modernisation programme for the public sector;
  2. why this problem is so urgent when "Jersey is far better placed than other jurisdictions" and "the Islands public sector pension pot has a very enviable balance of £1.2 billion";
  3. whether he intends to renege on the recently negotiated agreement that the States were to cover pre-1987 shortfalls in return for higher contributions/smaller pensions;
  4. whether he is including teachers pensions in this proposal, despite the fact that the teachers pension fund which is financed differently to that in the UK and currently has assets of $300 million which makes it healthy?"

"Will the Minister explain to members why it is not in the Islands interest to join Guernsey and the Isle of Man in signing up to the automatic information exchange under the European Union (EU) Savings Tax Directive?

To prevent any repeat of the recent K2 publicity and to improve our reputation for transparency, will the Minister explain whether the coverage of the EU Savings Tax Directive will be extended to include disbursements from Jersey based trusts to residents in the UK and elsewhere and, if not, why not?

Will the Minister also state whether the introduction of a requirement for full public disclosure of the ultimate beneficial owners of all companies registered in Jersey has been considered and, if not, why not?

Will he further state whether the introduction of a requirement for all Jersey based paying agents (i.e. banks, trust administrators, company administrators, etc) to declare income and capital distributions to persons resident in the UK and elsewhere in the world to the Jersey tax authorities, in order that the Island authorities are able to meet their commitment to co- operate with international exchange of tax information has been discussed with regulators and, if not, why not?"

"As the criteria precluding an individual from serving as a Jurat includes reasons as diverse as criminal convictions; holding a paid office with either the States or a parish and also being or being employed by a brewer and given that Jurats are sitting in judgment upon others and thus need both a commitment to justice and the law as well as sound and unsullied personal judgment, to what degree does evidence of such individuals putting the welfare of minors at risk of abuse by failing to comply with legislation also preclude election to the role of Jurat, and if such actions do not, why not?"

"What disciplinary sanctions are in place in instances of lawyers/advocates being found to have attempted to charge incorrect amounts of money to clients - whether their own or, in an instance of adverse costs rulings, to clients of others; further still, how many disciplinary sanctions have been imposed in the past ten years and what form have these sanctions taken?"

"Further to the CSR savings and user pays proposals listed in a press release on 25th June 2012, will the Minister state –

how he can make additional savings of £1,086,000 from demographic changes when both primary and tertiary numbers are increasing;

what data will enable savings of £1.5 million (17%) on tuition fees and how confident is he that these will be delivered by 2016;

how will the increase in grant assessment savings be calculated and staged?

how will the introduction of an out of school placement for key stage 4 (already achieved by Trident) produce a £250,000 saving?

how will the additional £90,000 charges be delivered, how will it be staged over the period and what will the average cost of instrumental music lessons now be?

what cost/benefit analysis has been performed on the loss of a trainee librarian?

what additional posts will be lost in restructuring the youth service and sports management, will these involve redundancies and, if so, how many?

how the £320,000 saving on property charges for provided schools and £312,000 grant to independent schools will be achieved and how it is to be staged?
