In accordance with the meeting dates fixed for 2012 by the Privileges and Procedures Committee, this meeting will continue, if necessary, on Wednesday 18th and Thursday 19th April 2012.

R&O.46/2012.

This Order amends the tariff in respect of arrivals and departures of aircraft –

  1. by adjusting the formula for annual inflation-based increases in the  passenger charge (currently £4.78), which is one component of the due charged per passenger; and
  2. by increasing the security charge, which is the other component of the due charged per passenger.

The change referred to in (a) means that each 12-month period to which the formula applies will always end on the last day of the winter flights timetable, that is, on the last Saturday in March. Generally, the inflation-based increase is 0.5% less than the increase in the Jersey Retail Price s Index.

The security charge component rises on 25th March 2012 from £1.84 to £1.97, representing an increase of 7%.

This Order establishes a scheme for the approval of premises at which civil partnerships may be solemnized by a civil partnership registrar.

The scheme provides for approval to be granted by the Connétable of the parish in which the premises are situated. Approval may be granted in respect of a single, specified civil partnership or for a period of 1 or 3 years. In the case where the premises are approved for the solemnization of marriages pursuant to a scheme made under Article 18 of the Marriage and Civil Status (Jersey) Law 2001, approval may be granted for a period ending on the date that the approval for solemnization of marriages ends. The premises must be a seemly and dignified venue for the solemnization of civil partnerships and have no recent religious connection. Certain standard conditions will be attached to an approval and the Connétable may attach further conditions. The Connétable may revoke an approval if the conditions are not complied with. An applicant has a right to apply to the Minister for Home Affairs for a review of the decision of the Connétable to refuse an approval or to grant an approval for a shorter period than that applied for or subject to conditions other than the standard conditions.

The fee payable on application for approval of premises for the solemnization of a single specified civil partnership is £100.

In a case where premises are already approved for a 1 year or 3 year period for the solemnization of marriages pursuant to a scheme established under Article 18 of the Marriage and Civil Status (Jersey) Law 2001, the fee payable on application for approval of those premises for the solemnization of civil partnerships for the remainder of the period of the approval for the solemnization of marriages is £40.

In any other case the fee payable on application for approval of premises for the solemnization of civil partnerships for 1 year or 3 years is, respectively, £200 or £300, and where the application is made at the same time as an application for approval of those premises for the solemnization of marriages the total fee payable in respect of both applications for approval for 1 year or 3 years is £200 or £300 respectively.

This Order prescribes the forms that must be used for purposes connected with the formation of a civil partnership.

It sets out the manner in which the civil partnership documents and returns are to be prepared and made, the form in which registers must be maintained and the manner in which any corrections to registers must be recorded.

Finally, it sets out the fees that apply in respect of the giving of notice of a civil partnership, the issuing of a licence or certificate for civil partnership, the solemnization of a civil partnership and the searching of a book, register or index.

The Order was made on 20th March 2012 and came into force on 2nd April 2012. R&O.52/2012.

This Order amends the Marriage and Civil Status (Approved Premises) (Jersey) Order 2002 so that in a case where premises are already approved for a 1 year or 3 year period for the solemnization of civil partnerships pursuant to a scheme established under Article 13 of the Civil Partnership (Jersey) Law 2012, an application may be made for approval of those premises for the solemnization of marriages for the remainder of the period of the approval for the solemnization of civil partnerships. The fee payable on such an application is £40.

In any other case the fee payable on application for approval of premises for the solemnization of marriages for 1 year or 3 years remains, respectively, £200 or £300, and where the application is made at the same time as an application for approval of those premises for the solemnization of civil partnerships, the total fee payable in respect of both applications for approval for 1 year or 3 years is £200 or £300 respectively.

This Order also corrects a couple of minor drafting errors.

R&O.53/2012.

This Order amends the Marriage and Civil Status (Forms, Registration and Fees) (Jersey) Order 2002.

It makes minor amendments to a number of forms used for purposes connected with the solemnization and registration of marriages and for the registration of births and deaths, principally to enable relevant details to be recorded in those documents in respect of any person who has previously formed a civil partnership. The profession of the mother of a person recorded in a birth register or in marriage forms and registers will also now need to be recorded.

It amends the procedures for the preparation of marriage return documents and the making of marriage returns.

It amends the fees payable in respect of marriages that are solemnized in the Superintendent Registrars premises, so that in addition to the fee payable for the attendance of either the Chief Superintendent Registrar or his or her delegate for the purpose of solemnizing the marriage, a fee of £60 for the use of those premises is also payable.

It amends references to "register books" to "registers" throughout the Order.

Finally, it permits registers and books that are in use before the coming into force of this Order, or forms that have been printed before the coming into force of this Order, to be used until those registers are completed or stocks of forms used, despite the changes made by this Order to forms and registers.

The Order was made on 21st March 2012 and came into force on 2nd April 2012. R&O.54/2012.

This Order amends the Community Provisions (Restrictive Measures – Belarus) (Jersey) Order 2011 to give effect in Jersey to Council Implementing Regulation (EU) No. 265/2012 of 23rd March 2012 (O.J. No. L 87/37 24.3.2012) implementing Article 8a(1) of Regulation (EC) No. 765/2006 concerning restrictive measures in respect of Belarus. The effect is to add persons whose funds and economic resources are frozen to the list in Annex 1B to Council Regulation (EC) No. 765/2006 concerning restrictive measures in respect of Belarus.

The Order was made on 28th March 2012 and came into force on 29th March 2012.

R&O.55/2012.

This Order amends the Community Provisions (Restrictive Measures – Syria) (Jersey) Order 2012 to give effect in Jersey to Council Implementing Regulation (EU) No. 266/2012 of 23rd March 2012 (O.J. L 87/45, 24.3.2012) implementing Article 32(1) of Regulation (EU) No. 36/2012 concerning restrictive measures in view of the situation in Syria. The effect is to amend the list of entities and persons whose funds and economic resources are frozen, set out in Annex II to Regulation (EU) No. 36/2012.

The Order was made on 28th March 2012 and came into force on 29th March 2012. R&O.56/2012.

This Order revokes the Community Provisions (Restrictive Measures – Iran) (Jersey) Order 2010, which gave effect to Council Regulation (EU) No. 961/2010 concerning restrictive measures against Iran. That Council Regulation has been replaced by Council Regulation (EU) No. 267/2012 of 23 March 2012 concerning restrictive measures against Iran and repealing Regulation (EU) No. 961/2010 (O.J. No. L 88/1, 24.3.2012). This Order gives effect in Jersey to the latter Council Regulation.

The Community Provisions (Restrictive Measures – Iran) (No. 2) (Jersey) Order 2011 gave effect to Council Regulation (EU) No. 359/2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Iran (O.J. No. L 100/1, 14.4.2011) That Council Regulation has been amended by Council Regulation (EU) No. 264/2012 of 23 March 2012 (O.J. No. 87/26, 24.3.2012) so as to include further sanctions. This Order revokes the 2011 Order and re-enacts it give effect in Jersey to Council Regulation (EU) No. 359/2011, as amended by Council Regulation (EU) No. 264/2012.

The Order was made on 28th March 2012 and came into force on 29th March 2012. R&O.57/2012.

This Order allows the Jersey Motor Cycle and Light Car Club to hold motor rallies on Saturday 7th July 2012 on 2 courses in the parish of St. Ouen .

"Would the Minister, in relation to the report concerning golden handshakes recently released by the Comptroller and Auditor General, confirm that the reason for the curtailment of the Chief Executive's contract was the irretrievable breakdown of the latter's working relationship with the Minister for Treasury and Resources and not that the Chief Executive had difficulty with the other Ministers?

If this was the case, would the Chief Minister state why it was considered preferable to lose the Chief Executive, rather than ask the States to remove the Minister for Treasury and Resources from office?"

"Would the Minister detail, by age, how many States tenants pay full rent (receive no help from Social Security by way of Income Support) and what size accommodation they occupy?"

"Would the Minister advise for how long vehicles have exited the Snow Hill car park onto La Route du Fort roundabout, how many accidents, if any, have happened to those vehicles in the last five years and of the latter, what percentage were using the roundabout (as opposed to turning into Green Street)?"

"Would the Minister advise what percentage of road accidents in Jersey are directly caused by excessive speed and, if above the UK accepted figure of 3%, detail the reasons for this?

Would he also state the number, in percentage terms, of accidents directly caused by a failure to wear a seatbelt and clarify the mechanism whereby such a failure is deemed the cause of an accident?"

"Will the Chief Minister publish for each Department:

  1. how many jobs have been lost since the beginning of the CSR process and the value of the savings generated from these losses in terms of salaries and benefits; and,
  2. how many jobs have been created in the same time period and the cost of these posts in salaries and benefits?"
  1. The Minister for Home Affairs will table an answer to the following question asked by Deputy M.R. Higgins of St.Helier –

"Will the Minister:

  1. publish figures for the number of police checks made on individuals seeking employment from all sources since the introduction of the Rehabilitation of Offenders (Jersey) Law 2001?
  2. provide a breakdown of these figures indicating –
  1. those checks made by firms directly and by individuals personally;
  2. the position or employment for which the information was being sought.

Will the Minister outline whether there are any Eastern Europe countries from which Jersey does not obtain background check information regarding criminal records and, if so, explain whether this is because of lack of agreements with those countries or their inability to provide the information?"

"Further to the response given to my written question 6639 on 17th January 2012 that clarification was required from the Law Officers Department, is the Minister now able to publish the Human Rights audit of his Departments Laws, Regulations, Orders, Guidance notes and procedures that all Departments of the States had to complete before the registration in the Royal Court of the Human Rights (Jersey) Law 2000, together with all subsequent revisions to these documents?

What advice was received in relation to this matter from the Law Officers?

What human rights policy, if any, was in place in January 2012 when I first asked this question?"

"Will the Minister provide the Assembly with the following summarised information, in respect of Planning applications for residential developments approved during each of the years the Jersey Island Plan 2002 was in force and since the Island Plan 2011 was approved until the end of March 2012, for the re-development of properties sited in the three built up areas of the Island (defined in paragraph 6.5 of the Island Plan 2002) namely the town of St. Helier (including the contiguous urban areas of First Tower, St. Saviour and St. Clement ), the coastal strip ,and the rural and urban settlements, for each of the three areas –

  1. the number of approved applications;
  2. the number of residential units before and after re-development;
  3. the density of development before and after re- development;

Can the Minister provide the response times for every front line ambulance attending a 999 call or accident in the last 60 months in ten minute bands and, in instances where the response time exceeded 30 minutes, advise how long it took and the reasons for the delay.

Given that action taken in the first hour after an accident can be crucial, does the Minister consider that any delays are putting patients at risk and, if so, what action, if any, will she be taking to address this issue?

If the  issue  is  one  of budgetary constraints,  would the  Minister consider  requesting increased funding for her Department in the interest of the welfare of all Island residents?

"Given that in March 2011, the then Deputy Chief Minister, was due to sign a Tax Information Exchange Agreement with India when he reportedly spotted clauses in the document which could have put Jersey at a competitive disadvantage, would the Chief Minister advise whether the document had been reviewed by senior island officials and , if so, whom?

Had the clauses which the then Deputy Chief Minister found unacceptable also been viewed by those officers, did they share his opinion and, if so, why did they not identify these issues up before the trip to India?

What justifications did the officers give for not identifying a problem existed?"

Will the Minister state whether he (or other Ministers) have commissioned other research in developing the proposals for funding affordable housing and, if so, will he agree to release this work so that members can fully assess the proposals in the light of the relevant evidence, and if not, why not?"
