This Order updates the requirements for prospectuses for the sale of units in certified funds and extends their application to closed-ended funds which are constituted as companies or unit trusts, and to open- ended or closed-ended incorporated limited partnerships, limited liability partnerships, limited partnerships and separate limited partnerships.
Article 1 contains basic rules for interpretation.
Article 2 contains definitions associated with the activities and transactions that may be entered into by the certificate holder in relation to a certified fund, or its agent, specifically –
- the marketing of units;
- the sale of units on their issue or creation;
- the subsequent repurchase of units (open-ended funds);
- the subsequent sale of units (open-ended funds);
- the cancellation of units on the winding up or termination of the fund.
Article 3 states the basic requirements for content and presentation of a prospectus and gives effect to the Schedule, in which details of information to be included in a prospectus is specified. There is also a requirement to revise a prospectus if there is a new issue of units or if, whilst units are being marketed, there is a significant change in or related to the fund.
Article 4 prevents the marketing of units in a certified fund unless the prospectus either satisfies the requirements of Article 2 or the Jersey Financial Services Commission has consented to the marketing of the units notwithstanding that the prospectus does not satisfy those requirements in every respect. In addition, before units are marketed, a copy of the prospectus must be sent to the Commission and any trustee, custodian or depositary of the fund.
Article 5 imposes requirements for the provision of the prospectus and other specified documents to a person buying units from the certificate holder in relation to the fund, or its agent.
Article 6 requires that the prospectus is made available to prospective investors, without charge.
Article 7 creates a statutory liability to compensate a person who has purchased units in a certified fund from the certificate holder or its agent and who suffers loss as a consequence of a statement in a prospectus that is untrue or misleading, or the omission of material information from a prospectus.
Article 8 creates exemptions from the liability under Article 7.
Article 9 revokes the Collective Investment Funds (Unclassified Funds) (Prospectuses) (Jersey) Order 1995.
Article 10 amends the Companies (General Provisions) (Jersey) Order 2002 with the effect that the requirements in it as to prospectuses no longer apply to closed-ended certified funds which are constituted as companies.
Article 11 amends the Financial Services (Advertising) (Jersey) Order 2008 to clarify that it does not apply to a prospectus for an unregulated fund and to make amendments that are consequential upon the repeal of the Collective Investment Funds (Unclassified Funds) (Prospectuses) (Jersey) Order 1995 and its replacement by this Order.
Article 12 cites the name of the Order and provides for its commencement 6 months after it is made, subject to the following transitional arrangements –
- if, before commencement, the Collective Investment Funds (Unclassified Funds) (Prospectuses) (Jersey) Order 1995 applied to a fund, that Order shall continue to apply to the fund for one year following commencement or, if sooner, until the occurrence of a significant change that necessitates the revision of the prospectus;
- if, before commencement, Part 3 of the Companies (General Provisions) (Jersey) Order 2002 applied to a fund, that Part shall continue to apply to the fund until the marketing of a new issue of units in the fund;
- any other fund certified before the commencement of this Order shall only become subject to the requirements of this Order one year after commencement or, if sooner, upon the marketing of a new issue of units in the fund or a significant change that necessitates the revision of the prospectus.
The Schedule set out the detail of the information to be included in a prospectus.
The Order was made on 17th May 2012 and comes into force in accordance with Article 12 (as set out above).

- may close public roads, and use them, for the purpose of holding the Battle of Flowers on Thursday 9th August 2012 and the Moonlight Parade on Friday 10th August 2012;
- may restrict traffic on public roads for the same purpose;
- has to give public notice of the closures and restrictions; and
- has to take out public liability insurance.
The Order was made on 18th May 2012 and came into force on being made.

Does the Minister consider that for the most part teaching assistants should be on fixed-term or permanent contracts with defined hours to deliver consistent support in the classroom?
Will he further assure members that zero-hours contracts are not used to cover for predictable absence of teaching staff, such as maternity leave?
Will he also state how many zero hours contracts involve Highlands College lecturers (apart from Adult Education tutors) and what circumstances would justify this?"
- The Minister for Health and Social Services will table an answer to the following question asked by Deputy G.P. Southern of St. Helier –
"Will the Minister whether any of the 545 employees on zero-hours contracts are, like those at the Social Security department, actually employed by agencies and thus do not form part of FTE headcount and, if so, how many?
Will he give a further breakdown of the numbers of zero hours contracts by job types within Health and Social Services?"

"Given that the Assistant Chief Minister has stated that of the 28 requests for information from jurisdictions with which we have a Tax Information Exchange Agreement (TIEA) the "majority" have been complied with, will the Chief Minister state what this number is?
Will the Chief Minister state how many of these concerned a person or a company as defined by Article 4 of the TIEA with Italy (P.34/2012)?
How many involved criminal tax matters as defined in the aforementioned Article 4?
How many involved information on each of paragraphs 4(a) and 4(b) (i) to (iv)of Article 5 of the same TIEA with Italy?
Is the Chief Minister aware whether any tax revenue has been recovered through the use of a Jersey TIEA?"
- The Minister for Planning and Environment will table an answer to the following question asked by Deputy M. Tadier of St. Brelade –
"Will the Minister –
- produce a table showing the number of complaints received regarding his officers between 2006 and 2011, breaking the complaints down into planning, environment, enforcement sections; years; officer grade; and indicating whether multiple complaints were received against any one officer in these areas?
- explain the complaints procedure;
- explain how many complaints, if any, were upheld and how they were dealt with for example an official warning, suspension, dismissal etc?"

"Will the Minister advise the Assembly of the number of new first time buyer homes, affordable homes or open market homes, both flats and houses, which have been added to the local housing stock since the adoption of the 2011 Island Plan, on sites within each of the following areas and categories identified in paragraphs 6.38- 6.64 and Table 6.3 of the Island Plan -
- from the 900 homes reported in the Island Plan as under construction as at March 2011;
- from the planning permissions reported as outstanding in March 2011 for a total of 1,243 dwellings;
- the site zoned for first time buyer homes in the Island Plan 2002 but remaining undeveloped at the time of the plan;
- the six sites zoned for lifelong homes in the July 2008 amendment to the Island Plan 2002;
- sites within the St Helier waterfront;
- other sites within the town of St Helier;
- sites outside the town of St Helier, within urban and rural settlements classified as built up zone in the Island Plan 2011;
- extensions of village and rural centres under policy H5; and,
