This Order gives effect to Commission Implementing Regulation (EU) No. 7/2012 of 5 January 2012, which amends Council Regulation (EC) No. 1183/2005 of 18 July 2005 imposing certain specific restrictive measures directed against persons acting in violation of the arms embargo with regard to the Democratic Republic of the Congo by amending the list of persons in Annex I to that Council Regulation who are subject to the freezing of funds and economic resources.

The Order was made on 17th January 2012 and came into force on 18th January 2012. R&O.10/2012.

This Order contains a direction by the Chief Minister under the Money Laundering and Weapons Development (Directions) (Jersey) Law 2012 ("Law"). Under Article 5 of that Law a direction may be made if certain conditions are satisfied. Both of the following conditions are satisfied: (a) the international body known as the Financial Action Task Force has advised that measures should be taken in relation to Iran because of the risk of money laundering; and (b) the Chief Minister reasonably believes that activity in Iran facilitating the development or production of nuclear weapons poses a significant risk to the interests of Jersey.

The direction is given to all "relevant persons" as defined in the Law. "Relevant person" means –

  1. a person carrying on a financial services business in or from within Jersey; or
  2. any of the following carrying on a financial services business in any part of the world –
  1. a body incorporated in Jersey,
  2. a limited liability partnership registered under the Limited Liability Partnerships (Jersey) Law 1997, or
  3. a separate limited partnership registered under the Separate Limited Partnerships (Jersey) Law 2011.

The direction prohibits a relevant person from entering into new transactions or business relationships with banks incorporated in Iran, including their branches and the Central Bank of Iran, or continuing to participate in transactions or business relationships with such banks. Under Article 6(15) of the Law, the direction also prevents such transactions or business relationships from taking place with subsidiaries of such banks. Under Article 9 of the Law, the Chief Minister may grant a licence to exempt certain acts from these prohibitions.

Under Article 14 of the Law, a person who breaches a direction is guilty of an offence and liable to a maximum term of 2 years imprisonment and an unlimited fine.

This Order comes into force forthwith and, unless earlier revoked, will cease to have effect one year after it is made in accordance with Article 7(3) of the Law.

These Rules amend the Immigration (Work Permits) (Jersey) Rules 1995 in order to require the Minister to take into account an entrants knowledge of English (as well as the existing criteria) when deciding whether to issue a work permit to the entrant and to allow work permits to be issued up to 3 months in advance (instead of the current 2 months).

The Rules were made on 19th January 2012 and come into force on 1st March 2012.

This Order amends the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 with effect from 1st February 2012.

The charges are increased by 3.9%, rounded up or down as appropriate. They were last increased on 1st February 2011.

The second amendment narrows the rule for eligibility to pay discounted parking charges. Currently, all vehicles which have emissions of no more than 100 grams of carbon dioxide per kilometre and hybrid vehicles that have emissions in excess of that amount but less than 120 grams qualify for discounted parking charges. The amendment restricts the eligibility of hybrid vehicles that have emissions in excess of 100 grams but less than 120 grams so that only those vehicles which are first registered before 1st July 2012 qualify.

This Order increases the minimum wage by 2.5% with effect from 1st April 2012. The minimum wage was last increased on 1st April 2011.

This Order creates transitional arrangements for the valuation of benefits in kind taken into account as part of a Class 1 insured persons earnings or a Class 2 insured persons income from self-employment. For the first half of 2012, benefits in kind shall continue to be taken into account in the same way as they were taken into account in 2011.

The Order was made on 25th January 2012 and came into force on 26th January 2012.
