This Order deletes Article 2 of the Social Security (General Benefit) (Jersey) Order 1975. That Article provided for the calculation of the life average of a persons annual contribution factors. The rules for the calculation are relocated to the Social Security (Jersey) Law 1974, as amended by the Social Security (Amendment of Law No. 2) (Jersey) Regulations 2012.
The Order was made on 22nd February 2012 and came into force on the same day as the Social Security (Amendment of Law No. 2) (Jersey) Regulations 2012 – 28th February 2012.

This Order specifies the actions taken under the Fire and Rescue Service (Jersey) Law 2011 for which the Chief Fire Officer may charge a person, and sets the amount or rate that may be charged for the use of property, personnel, premises or services of the Fire and Rescue Service in taking an action so specified.

The Fire and Rescue Service (Jersey) Law 2011 (the "Law") requires the Minister for Home Affairs to make provision for the purposes of extinguishing fires, protecting life and property in the event of fire, rescuing people and protecting people from serious harm in the event of road accidents, and rescuing people from dangerous places. The Law also enables the Minister for Home Affairs to make an Order specifying other emergencies and humanitarian services in respect of which provision may be made, so far as such provision is not already required to be made under the Law.
This Order specifies those additional emergencies in respect of which provision may be made, including provision for the purposes of rescuing people who may be missing or trapped and protecting them from serious harm in the event of incidents occurring at sea within 3 nautical miles of Jerseys mean high water mark, and any other incident on water or caused by flooding; incidents involving the collapse of structures or serious transport incidents; landslides or other natural disasters; incidents involving hazardous materials; and rendering assistance to other emergency services.
The Order also specifies a range of humanitarian services in respect of which provision may be made, including rescuing a person trapped in a lift car or locked out of their house, rescuing an animal, pumping or supplying water and washing away spillages.

This Order specifies the dates and times when the Sorel Point loop road (otherwise known as the Ronez loop road) may be closed to normal traffic and used by the Jersey Kart and Motor Club to race karts and practise on them.

This Order further amends the Community Provisions (Restrictive Measures – Zimbabwe) (No. 6) (Jersey) Order 2007, to update it following Commission Implementing Regulation (EU) No. 151/2012 of 21st February 2012 (OJ L 49/2, 22.2.2012) amending Council Regulation (EC) No. 314/2004 concerning certain restrictive measures in respect of Zimbabwe. Those amendments alter the list of persons, entities and bodies whose funds are frozen, and the list of websites of competent authorities in member states.

This Order revokes and replaces the Public Finances (Accounting Standards) (Jersey) Order 2011. The Treasurer of the States must prepare annual financial statements in accordance with generally accepted accounting practice as supplemented and adapted by accounting standards prescribed by the Minister for Treasury and Resources. This Order prescribes, for the statements for 2011 and ensuing years, new accounting standards to be found in a new edition of the States of Jersey Financial Reporting Manual, which is set out in the Schedule to the Order.

This Order revokes the Export Quarantine Stations (Regulation) (Jersey) Order 1958. The Order was made on 29th February 2012 and comes into force on 7th March 2012.

Article 1 of this Order adds infectious bovine rhinotracheitis to the list of diseases to which Article 4 of the Diseases of Animals (Jersey) Law 1956 applies.
One effect of Article 1 of the Order is that a person who has cattle in his or her possession or under his or her charge is required, under Article 4 of that Law, to report to the Minister any case of infectious bovine rhinotracheitis in the cattle and to segregate the affected cattle.
Article 2 of this Order prohibits the use of vaccines against infectious bovine rhinotracheitis except under licence granted by the Minister for Planning and Environment.
The Order was made on 29th February 2012 and comes into force on 7th March 2012.

"With respect to the Ministers recent statement on the reduction of incapacity benefits, does the Minister accept that when the new in-work benefit LTIA (Long Term Invalidity Allowance), for persons who suffer a permanent loss of physical or mental faculty as a result of disease or accident, was introduced in 2001, it was clearly stated that it would not apply to existing beneficiaries?
Does he consider that any attempt to amend this provision relating to existing beneficiaries (currently 1,036), would be a breach of trust?
Will the Minister confirm that for the 1,036 existing beneficiaries, a choice to transfer to LTIA would currently risk a reduction in their award from a 100% (£186 weekly) to some lesser percentage?
Does he further accept that any reduction in payments awarded on either of these schemes (funded from contributions to the Social Security Fund) would, in most cases, merely result in increased costs to the taxpayer in Income Support payments?
Does he finally accept that if he wishes to reduce the cost of the benefit bill to taxpayers he could raise contributory benefits by a margin significantly over inflation?"

ELECTORAL COMMISSION: COMPOSITION AND TERMS OF REFERENCE (P.5/2012)
If the proposition of the Privileges and Procedures Committee is adopted at this meeting and the first amendment of Deputy R.G. Le Hérissier of St. Saviour (P.5/2012 Amd Parts 1 (a) to (c)) has been adopted, it will fall to the Privileges and Procedures Committee, in a process overseen by the Jersey Appointments Commission, to undertake a recruitment process to identify 7 people who will then be recommended to the States for appointment as Chairman and members of the Electoral Commission.
If the proposition of the Privileges and Procedures Committee is adopted but the first amendment of Deputy R.G. Le Hérissier of St. Saviour (P.5/2012 Amd Parts 1 (a) to (c)) has been rejected, paragraph (b) of the proposition requires the States to proceed immediately to appoint a States member as Chairman and 2 other members to serve on the Commission. Paragraph (b) is in the following terms –
"(b) to agree that the Chairman and 2 States members should be appointed by the States
immediately following the adoption of this proposition, with the nomination and ballot procedures for these positions following the process set out in Standing Orders for the selection of the Chairmen and members of scrutiny panels except that –
- nominations for the 2 members shall be invited from all members without initial nominations being made by the Chairman; and
- voting for the Chairman and members shall be undertaken by open ballot and not by secret ballot;"
The procedure that will be followed in these circumstances is therefore as follows –
Immediately after the adoption of the proposition the Presiding Officer will invite nominations for the position of Chairman of the Electoral Commission. Each nomination must be seconded. If there is more than one nomination each candidate will speak for up to 10 minutes with a 20 minute question period. The candidates will speak and be questioned in the order in which they have been nominated. Other candidates must withdraw from the Chamber during the speeches and question period.
Following the speeches and question periods an open ballot or ballots will be held until one candidate receives an overall majority of votes cast. Members will be required to write their own name and indicate their vote on ballot papers to enable the manner in which members have voted to be
read out after the open ballot.
Following the appointment of the Chairman, the Presiding Officer will invite nominations for 2 members to serve on the Commission. Each nomination must be seconded. There will be no speeches or questions but if more than 2 members are nominated an open ballot will be held. Members be required to write their own name and indicate their vote on ballot papers to enable the manner in which members have voted to be read out after the open ballot. The 2 members receiving the most votes will be elected.
