This Order increases fees under 3 regimes administered by the Minister for Economic Development.

Article 1 increases by approximately 2.5% the fee for an application for registration, or the renewal of registration, of premises as a place of refreshment under Article 4(1) of the Places of Refreshment (Jersey) Law 1967. That fee was last increased on 1st January 2012.

Article 2 increases by approximately 2.5% the fees for registration (or renewal) under Article 9(1)the Tourism (Jersey) Law 1948. Those fees were last increased on 25th October 2011.

Article 3 increases by approximately 2.5% the fees for testing weighing or measuring equipment under Article 12 of the Weights and Measures (Jersey)  Law 1967. Those fees were last increased on 1st January 2012.

Article 4 gives the title of this Order and states when the provisions come into force. Articles 2 and 4 come into force 7 days after the making of this Order and Articles 1 and 3 come into force on 1st January 2013.

The Order was made on 27th September 2012 and comes into force in accordance with Article 4.

The objects of this Order are –

  1. in Article 1 to avoid an overlap between the prohibition on the discharge of oil set out in Article 98(1) of the Shipping (Jersey) Law 2002 and the prohibition (and exceptions) relating to similar discharges within the terms of Annex I to the International Convention for the Prevention of Pollution from Ships, 1973 (known as the MARPOL Convention) and Regulation 13 of the Shipping (MARPOL) (Jersey) Regulations 2012;
  2. accordingly, by virtue of Article 1, to allow that Annex and those Regulations to govern those discharges;
  3. in Article 2 to extend the operation of certain provisions of the Shipping (Jersey) Law 2002, and all of the Shipping (MARPOL) (Jersey) Regulations 2012, to platforms that float or stand in the sea, so that those platforms have to meet the same pollution restrictions as ships and are subject to the same supervision under Parts 10, 11 and 12 of the Shipping (Jersey) Law 2002; and
  4. in Article 3 to amend Regulation 1 of the Shipping (MARPOL) (Jersey) Regulations 2012 by omitting the definition of "IMO" (a term which is in fact not used in those Regulations) and by changing the definition of "Organization" so that the definition will refer to the International Maritime Organization (that is, the IMO) and not its predecessor.

Article 4 sets out the short title of the Order and provides for it to come into force on the seventh day after it is made.

The Order was made on 27th September 2012 and came into force on 4th October 2012.

This Order amends the Income Support (General Provisions) (Jersey) Order 2008 (the "principal Order"). Article 1 defines the principal Order.

Articles 2 to 6 revise the rights of appeal of, and information to be provided by a determining officer to, a person who is a jobseeker aged under 19 or student aged under 25 who is in full-time education and who is a member of the household of the claimant. The jobseeker or student will only be notified of, and have a right of appeal against, a decision made in respect of the household if the decision took into account his or her capital or income or impairment. If the decision took into account the jobseeker's or student's impairment, but not that person's capital or income, the notice of the decision must not disclose to the jobseeker or student information regarding the capital and income of the claimant or any member of the household.

Article 7 revises the information to be provided in support of a claim for income support.

Article 8 revises the way in which the income of a household is to be calculated for the purposes of determining entitlement to income support.

Article 9 provides for the citation and commencement of the Order.

The Order was made on 28th September 2012 and came into force on 1st October 2012.

This Order designates the first 4 Sundays of December (or the last Sunday of November plus the first 3 Sundays of December) in every year as special occasions for the purposes of the Shops (Regulation of Opening) (Jersey) Regulations 2011. This means that a Connétable may grant (by notice in the Jersey Gazette) a blanket permit to specified kinds of shops in his or her parish to open on those occasions.

Article 1 designates those special occasions.

Article 2 names this Order and provides for its commencement 7 days after it is made. The Order was made on 1st October 2012 and came into force on 8th October 2012.

"In order to ensure that the States of Jersey Police return property taken during investigations in good condition and in a timely manner, will the Minister undertake to review procedures in order to ensure such property is:

  1. adequately logged (and photographed where appropriate) and a copy of the itemisation supplied to the owner;
  2. stored in labelled containers for easy location, thereby avoiding either the owner being advised the items do not exist or hours of police time wasted searching for them?

Will the Minister further undertake to review the police armoury facility to ensure property does not go missing and that public as well as police firearms are in a suitable environment as regards humidity etc?"

  1. home installations, due to the relative inflexibility of the fibre cable compared with copper and the need for a power source near cable entry, have resulted in inconvenience to householders;
  2. the installation time and associated costs have been higher than anticipated;
  3. customers who have broadband have expressed an unwillingness to pay for a faster service;
  4. large consumers such as banks already have fibre connections from the town ring-main and, if so, is a significant growth in this market unlikely?

Would the Minister advise what action, if any, has been taken to resolve the aforementioned issues? Would the Minister make available the evidence which persuaded him to support JT's project?

What measures are in place to mitigate the risk of either existing customers migrating to other providers or returns on the fibre investment failing to materialise?

Does the Minister consider that JT's charges and available speeds compare well with other jurisdictions, even before fibre brings increased speeds and associated increased costs to customers?"

"Following the decision to refund GST on luxury goods worth £300+ for visitors to the Island, would the Minister advise -

  1. what goods will be classified as luxury';

Would the Minister outline the decision process and publish whatever evidence was presented to support this sudden change in policy?"
