R&O.150/2013.

This Order amends the Teachers' Superannuation (New Members) (Jersey) Order 2007 ("2007 Order") so that teachers who are members of the pension scheme established under that Order ("new members") have similar rights to make additional voluntary contributions as teachers who are members of the scheme established under the Teachers' Superannuation (Existing Members) (Jersey) Order 1986.

Article 1 substitutes Article 12 of the 2007 Order. It removes the right for the Management Board of the scheme and the Actuary to refuse to allow a new member to pay additional voluntary contributions. Now, a new member is entitled to make additional voluntary contributions in order to be entitled to such added years as the Management Board, on the advice of the Actuary, shall decide. The Management Board determines the minimum and maximum amounts that may be paid. It also enables a new member to make an additional voluntary payment by a lump sum or periodical payments, or to vary the amount of the additional voluntary contributions.

New Article 12 also amends the method to calculate the number of added years by virtue of additional voluntary contributions in circumstances when the member making those contributions ceases to be an employee before normal retiring age. Currently the 2007 Order provides that the number of added years is reduced so that the value of contributions paid by and in respect of the member equates to the value of additional benefits arising from the reduced added years. This Order provides that the added years will be reduced proportionately to the reduction in the number of years that the employee is employed. However, in the case of a person who commenced paying additional voluntary contributions before the coming into force of this Order and who ceases to be an employee before normal retiring age, the years added will be the greater of the number of years added in accordance with the calculation set out in this Order and the number of years added in accordance with the calculation made by the actuary under the provisions of the Order that applied immediately before the coming into force of this Order.

Article 2 states the title to the Order and provides for it to come into force 7 days after it is made. The Order was made on 29th November 2013 and comes into force on 6th December 2013.
