This Order increases the amount of a pension or annuity of a member of a household who is aged 65 or more that is disregarded in assessing the household's weekly income. The amount to be disregarded is increased in line with the increase in the States old age pension. The increase takes effect on the same day as the increase in the States old age pension, 1st October 2013.

The Order also amends the residency rule for eligibility for income support so as to replace a reference to provisions of the now lapsed Housing (Jersey) Regulations 1970 with a reference to equivalent provisions of the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013.

The Order was made on 26th September 2013.

Article 3 of the Order came into force on 1st October 2013, and the remaining Articles came into force on 27th September 2013.

This Order supplements the procedures and requirements as to registration of financing statements and financing change statements that are contained in Part 8 of the Security Interests (Jersey) Law 2012 (the "Law"). Under Article 63(1) of the Law, financing statements may be registered before or after the security agreement is made to which the financing statement relates, before or after the assignment of a receivable occurs to which the financing statement relates, or before or after the security interest has attached, being the security interest created by a security agreement to which the financing statement relates. By Article 74 of the Law a discharge of a registration or an amendment to a registration may be effected by registering a financing change statement.

Article 1 defines expressions used in this Order.

Article 2 disapplies the registration requirements in relation to a security interest over trust property of a trust (other than a prescribed unit trust) where the grant of the security interest is by the trustees of the trust.

Article 3 provides that the maximum period that a financing statement or financing change statement may be registered is 99 years.

Article 4 provides for the manner in which proceeds of collateral are required to be described in a financing statement.

Article 5 permits demands for registration of a financing change statement under Article 75 of the Law, or applications in respect of such financing change statements, to be made through the automated registration system described in Article 79 of the Law (referred to as the "SIR system" throughout the Order) and sets out notification requirements.

Article 6(1) requires any data entry requirements or fees published by the registrar to be placed in a prominent position on the SIR system. It also requires the registrar to place in a prominent position on the SIR system a notice drawing attention to the limitation of liability of the registrar under Article 60(3) of the Law. Under Article 6(2) the registrar is not required to verify the accuracy of any data contained in a financing statement or financing change statement, nor verify that a person entering data onto the SIR system is entitled to make such an entry, except in so far as the registrar is required to do so under Part 8 of the Law. Under Article 6(3), the registrar's data requirements may not require a financing statement or financing change statement to be updated once is has been registered.

Article 7 requires the registrar to ensure that the SIR system permits access for searching by a person for a purpose described in relation to that person in that Article. It also permits the registrar to prevent or restrict access to a person who the registrar reasonably believes to be searching or accessing the system for a purpose that is inconsistent with any of the purposes described. However, the registrar is not required to satisfy himself or herself that a person is searching for a purpose described.

Article 8 sets out the criteria by which a search may be conducted, and the nature of the results that will be generated by the SIR system.

Article 9 requires the registrar to assign an access code to each secured party, assignee, assignor and grantor and stipulates how they are to be provided.

Article 10 permits the registrar to disclose access codes for the purpose of enabling access to the register and SIR system to any person who the registrar believes is entitled to such information.

Article 11 confirms the registrar's power to provide certified copies of registered financing statements or financing change statements.

Article 12 describes the registrar's procedures if the SIR system is to be suspended for repair or maintenance.

Article 13 describes when the registrar may restrict access to all or part of the data on the SIR system or remove data from the SIR system.

Article 14 describes how notices or documents may be given or served.

Article 15 describes when notices or documents that are required to be given to or served upon a party by the registrar may be deemed to have been so given or served.

Article 16 gives the title to this Order and states that it comes into force on 1st October 2013. The Order was made on 27th September 2013 and came into force on 1st October 2013.

"Further to his response to a written question on 24th September 2013 when he stated that there are no situations where household income is treated as capital for Income Support purpose', will the Minister explain why, when I posed a similar question to one of his Income Support (IS) officers, I was informed that Redundancy pay is treated as capital. Pay in Lieu of notice is treated as income'?

Will he state how severance pay' which, like redundancy pay,  is usually based on length of employment and can be defined as not the same as termination pay, which is given in place of the required notice of termination of employment' is treated for IS purposes?

Will he also state how many cases of loss of employment have come before IS determining officers where the employee's final payment has been categorized respectively as a redundancy', in lieu of notice' or severance' payment by the employer?

Notwithstanding his previous answer on guidelines for income/capital, will the minister reveal those training guidelines or procedures for IS officers, whether technical or otherwise, which relate to the treatment of final payments for employees dismissed from their employment?"
