This Order amends the Community Provisions (Restrictive Measures – Ukraine) (Jersey) Order 2014 by giving effect in Jersey to the amendments made by Council Implementing Regulation (EU) No. 433/2014 (OJ No. L126, 29.4.2014, p.48) to Council Regulation (EU) No. 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, which adds to the list of persons that are subject to restrictive measures in view of the gravity of the situation in Ukraine.

The Order was made on 30th April 2014 and came into force forthwith. R&O.43/2014.

This Order sets out the rates for benefits towards the cost of long-term care, and conditions for receiving such benefits, under the Long-Term Care (Jersey) Law 2012 ("Law").

Article 1 is an interpretation provision. In particular it defines "eligible person" to mean a person over the age of 18 who (a) is in a care home approved under the Law or who is receiving a care package approved under the Law in the person's home; (b) has been assessed under the Law as needing care and (c) has applied for a benefit under the Law. It also defines "owned principal residence" to mean a principal residence in Jersey that is owned wholly or partly by an eligible person and/or the eligible person's partner. An "approved home" can be either a "group home" (generally catering for a small number of adults whose requirements for long-term care are not age related) or a "care home" (that is an approved home that is not a group home.) (Words and phrases which require detailed definition are set out in Articles 2 to 7.)

Article 2 defines "asset" to mean all of a person's immovable and movable (whether tangible or intangible) property. Personal possessions with a market value of less than £10,000 (unless held for investment purposes) and income are excluded from the definition. Property worth more than £5,000 that was disposed of at less than market value within the 10 year period prior to a person becoming an eligible person is included in the definition unless such a person can reasonably demonstrate that the primary purpose of the disposal was not to obtain state or parish benefits relating to care. If a person has disposed of a principal residence owned by the person (or by the person's partner) at any time, but continued to live in the residence, the residence is also included within the definition of "asset" unless, again, the person can reasonably demonstrate that the primary purpose of the disposal was not to obtain state or parish benefits relating to care. However property disposed of by a person's partner before the commencement of a partnership is not included within the definition of "asset".

Article 3 sets out a definition of "carer" of another person. This definition largely follows that used under the Social Security (Jersey) Law 1974. The definition is relevant for determining when an owned principal residence ceases to be occupied, which, in turn, is relevant to when a person is deemed to have income from the property and when a loan under the Law is repayable.

Article 4 sets out the meaning of "deemed income". In certain circumstances an eligible person is deemed to have income arising from a proportion of the value of an unoccupied owned principal residence or from any other assets (excluding other assets to the value of £25,000).

Article 5 sets out a meaning of "dependent". The definition refers, broadly, to children under the age of 19 (or under the age of 25 in the case of those receiving full-time education). The definition is relevant to determining when sums for supporting dependents are excluded from the definition of "income".

Article 6 sets out a definition of "income". Broadly all income, both earned and unearned income, is included and the definition also sets out expenses that can be deducted from income. The definition is relevant for assessing the extent to which certain benefits are payable in accordance with the Order.

Article 7 sets out a definition of "loan" to mean a loan secured under the Social Security Hypothecs (Jersey) Law 2014 or under the Security Interests (Jersey) Law 2012. Property which is used as security for a loan must include an owned principal residence or be derived from entitlement to occupy such property by reason of it being share transfer property or by reason of a consent granted under Regulation 1(1)(j) of the Housing (General Provisions) (Jersey) Regulations 1970.

Article 8 sets out the rates of benefit for the cost of long-term care ("care costs). The amount depends on the level of care required and whether it is received in a care home, group home or a person's own home.

Article 9 provides that a person is entitled to a grant of the care costs referred to in Article 8 provided certain conditions are met. The main conditions are that (a) the eligible person pays a fixed sum towards the care costs (this sum is set out in Article 10, broadly £50,000 in the case of a single person or £75,000 in the case of a partnership); (b) if in an approved home, the person pays, in addition to care costs, weekly costs of £300 and any incidental weekly expenses (up to £32.66 per week); and (c) if the person choses to receive care that costs more than the care costs or, if applicable, the weekly additional amounts, the person pays those amounts.

Article 10 sets out how the fixed sum to be paid towards care costs is determined in the case of a partnership, taking into account such things as when the partnership commenced and what happens if the partnership beaks up or a partner dies.

Article 11 sets out the circumstances in which a grant is available to meet the costs referred to in Article 9(b) and (c). A person is entitled to such a grant where the person's income and deemed income and the value of assets owned by the person, including any partner of the person, are insufficient to meet those payments.

Article 12 sets out the circumstances in which a loan is available to meet the costs referred to in Article 9(b), (c) and (d).

Article 13 sets out how a person's assets (that is a person's owned principal residence and any other assets) are valued for the purpose of determining whether a person is entitled to a benefit under Article 11 or 12. To the extent that the value in such assets is disregarded under this Article, such value may be taken into account for the purpose of assessing the person as having deemed income, as calculated in accordance with the definition of "deemed income" in Article 4.

Article 14 sets out some general matters concerning valuation, market value and allows a determining officer (that is a person who assesses a person's entitlement to benefits under the Law) to require a person's income and assets to be assessed at any time for the purpose of determining the benefits to which a person is entitled or the payments which a person must make under the Order.

Article 15 sets out the circumstances in which a loan must be repaid and the rate of interest payable.

Article 16 sets out the title of the Order and provides that it will come into force on the same day that Parts 3 and 4 of the Long-Term Care (Jersey) Law 2012 come into force.

The Order was made on 1st May 2014 and comes into force in accordance with Article 16. R&O.44/2014.

This Order amends the Income Support (General Provisions) (Jersey) Order 2008 (defined as the "principal Order") in Article 1.

Article 2 inserts in the principal Order definitions of "approved care home" and "long-term care" by cross referring to definitions used in the Long-Term Care (Jersey) Law 2012 and the Long-Term Care (Benefits) (Jersey) Order 2014.

Article 3 amends the principal Order so that a person who is treated as a member of the same household as another person (such as a spouse or civil partner) for the purposes of the principal Order continues to be treated as a member of the same household whilst receiving long-term care in an approved care home.

Article 4 amends the principal Order by excluding financial support from the Minister for Social Security for long-term care from the definition of "income" used in Schedule 2 to the principal Order.

Article 5 sets out the title of the Order and provides that it will come into force on the same day that Parts 3 and 4 of the Long-Term Care (Jersey) Law 2012 come into force.

The Order was made on 2nd May 2014 and comes into force in accordance with Article 5.

This Order increases fees for applications for leave to remain in Jersey. The fees are increased by 4%, with the exception of the fee for limited leave to remain for a dependent and the fee for indefinite leave to remain for a dependent, which are both increased by 38.8%.

The increases take effect on 1st June 2014. The last increases took effect on 1st June 2013. The Order was made on 2nd May 2014 and comes into force on 1st June 2014.
