This Order amends the Community Provisions (Restrictive Measures – Ukraine) (Jersey) Order 2014 by giving effect in Jersey to the amendments made by Council Implementing Regulation (EU) No. 753/2014 (O.J. No. L205, 12.7.2014, p.7) to Council Regulation (EU) No. 269/2014 of 17th March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, which adds to the list of persons, entities and bodies that are subject to restrictive measures in view of the gravity of the situation in Ukraine.

Under this Order, the Jersey Battle of Flowers Association ("the association") may close public roads and use them for the purpose of holding the Battle of Flowers on Thursday 14th August 2014 and the Moonlight Parade on Friday 15th August 2014. The association may also restrict parking and traffic movements in those roads and in roads in the surrounding area, as specified in the Order, provided the association gives public notice of the closures and restrictions, and takes out public liability insurance.

This Order gives effect to Council Implementing Regulation (EU) No. 740/2014 of 8th July 2014 ("Council Implementing Regulation") (O.J. The Council Implementing Regulation adds one person to the list of persons and entities subject to restrictive measures and removes eight persons from that list.

Article 2(4B) of the Sea Fisheries (Jersey) Law 1994 enables Orders to be made for the purpose of giving effect to Regulations made under paragraph (1) of that Article, which include the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998. As recently amended by R&O.84/2014, those Regulations include provision banning the fishing, taking or storing of spider crabs during their soft shell' stage of development for a period to be specified by Order (under Regulation 5), and prohibiting the use of passive gear (defined as certain types of nets, for which the catch operation does not require an active movement of the gear) during a period and in an area of the sea similarly specified (under Regulation 6).
This Order specifies the period for the purposes of Regulations 5 and 5A (Article 2) and the area for the purposes of Regulation 5A (Article 3, and the Schedule). The Order comes into force (Article 4) 14 days after it is made.

(a) Council Implementing Regulation (EU) No. 371/2014 of 10th April 2014 (OJ L 109, 12.4.2014, page 9) implementing Article 12(1) of Regulation (EU) No. 359/2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Iran, which substitutes the entries for various persons in Annex I to Council Regulation (EU) No. 359/2011; and
(a) Council Implementing Regulation (EU) No. 397/2014 of 16th April 2014 (OJ L 119, 23.4.2014, page 1) implementing Regulation (EU) No. 267/2012 concerning restrictive measures against Iran, which adds the North Drilling Company to, and removes Safa Nicu from, Annex IX to Regulation (EU) No. 267/2012.

The Regulation being given effect adds 3 persons and 9 entities to Annex II to Regulation (EU) No. 36/2012.

This Order amends the Community Provisions (Restrictive Measures – Libya) (Jersey) Order 2011 to give effect, in Jersey, to Council Implementing Regulation (EU) No. 792/2014 of 22nd July 2014 (OJ L 217, 23.7.2014, page 9) implementing Article 16(2) of Regulation (EU) No. 204/2011 concerning restrictive measures in view of the situation in Libya. The Regulation being given effect removes Mohamad Ali Zidane from the list of persons in Annex III to Regulation (EU) No. 204/2011.

These Rules of Court – consisting of 7 Rules – amend the Court of Appeal (Civil) Rules 1964 ("the principal Rules").
Rule 1 merely defines the principal Rules. Thereafter the amendments fall into 2 categories:
- Judicial Greffe procedures
Rule 2 – (amending definitions in Rule 1(1) of the principal Rules)
• There is a minor consequential amendment in the definition of "respondent's case".
• The expression "timings letter" is defined as the letter referred to in Rule 8.
• The word "transcript" is defined (having abandoned references in the principal Rules to the "transcript of the shorthand note").
Rule 3 – (amending Rule 3 of the principal Rules)
Rule 3 of the principal Rules requires an appeal in a civil matter to be brought "within one month from the date on which the judgment or order of the court below was pronounced." In relation to criminal and quasi-criminal appeals, the Court of Appeal (Jersey) Law 1961 requires the appeal to be brought within 28 days. Rule 3 (of the amending Rules) substitutes replaces one month' in Rule 3 of the principal Rules with '28 days'.
Rule 4 – substituting Rules 7, 8, 9 and 10 of the principal Rules
Rule 7 – Transcript
The new Rule 7 makes it clear that, subject to any direction of the court, after an appeal has been set down, the Judicial Greffier shall, at the request of either party to the appeal, make a transcript of the official record of the proceedings at the hearing. The transcript has to be furnished to the appellant and to every other party to the appeal upon payment of such charges as are fixed for the time being by rules of court pursuant to Article 21(4) of the Court of Appeal (Jersey) Law 1961.
Rule 8 – Documents, timetable
The new Rule 8 makes it clear that the Judicial Greffier is required, within 7 days of receiving the notice of appeal, to prepare and circulate to each of the parties to the appeal a timings letter' containing a timetable of the dates by which submissions and other documents in the appeal are to be lodged, and specifying certain other procedural matters, including notice of the sitting of the Court of Appeal at which the appeal is scheduled to be heard.
The appellant is required, in accordance with the timetable, to lodge with the Judicial Greffier the appellant's case i.e. various acts, documents, pleadings, exhibits etc. germane to the appeal, including the order, judgment, decree or award under appeal; and to deliver the same to all other parties.
The respondent is similarly required, in accordance with the timetable, to lodge with the Judicial Greffier a respondent's case which sets out the respondent's contentions and authorities (and to deliver to the same appellant within 2 days).
Rule 9 – Hearing date
The new Rule 9 makes it clear that the Judicial Greffier will circulate to each of the parties, or their advocate, a copy of the Court's agenda for the relevant sitting no later than 7 days before the first day of the sitting of the Court of Appeal at which the appeal is scheduled to be heard.
Rule 10 – Abandonment by non-prosecution
The new Rule 10 involves a consequential amendment and simplification only. Rule 5 – (amending Rule 14 of the principal Rules)
The reference to an official shorthand note (of evidence in the court below) is deleted.
- The Terrorist Asset-Freezing/Money Laundering etc. amendments Rule 6 – (inserting Rule 18A in the principal Rules)
The Terrorist Asset-Freezing (Jersey) Law 2011 ("the 2011 Law") provides for financial restrictions on persons suspected of involvement in terrorist activities. The Money Laundering and Weapons Development (Directions) (Jersey) Law 2012 ("the 2012 Law") provides for directions to be given to persons in response to threats from abroad relating to money laundering, terrorist financing or weapons development.
Rule 6 inserts a new Rule 18A in the principal Rules in relation to appeals against decisions of the Royal Court in proceedings brought under Article 28 or Article 29 of the 2011 Law, or under Article 10 of the 2012 Law.
The effect is that an appeal against a decision of the Royal Court in such proceedings brought is conducted in accordance with the principal Rules, but subject to certain adaptations and modifications set out in Rule 6 to accommodate the non-disclosure and special counsel régimes under those Laws. Rules 16A/7 to 16A/17 of the Royal Court Rules 2004 are rendered applicable to the appeal proceedings as they applied in relation to the proceedings in the Royal Court.
Rule 7 – Citation and commencement
Rule 7 is the citation and commencement provision.
The Rules were made by the Court of Appeal on 28th July 2014 and came into force on 1st September 2014.
R&O.116/2014
This Order amends the Pedal Cycles (Jersey) Order 1998 to provide for the wearing of helmets by children on pedal cycles or trailers drawn by pedal cycles, following the amendment of the Road Traffic (Jersey) Law 1956 (the "Law") by the Road Traffic (No. 60) (Jersey) Regulations 2014.
Article 1 defines the "principal Order" as the Pedal Cycles (Jersey) Order 1998, and Article 2 amends the enacting provision of that Order to include Article 45A of the Law, under which this Order is made.
Article 3 inserts a new Article 6A in the principal Order. Paragraph (1) sets the age for wearing a helmet at 13 years or younger. Paragraph (2) imposes the requirement to wear a helmet, securely fastened and in compliance with the further requirements in the Schedule. The helmet must be no more than 10 years old.
Paragraphs (3) and (4) contain exceptions to the requirement to wear a helmet. No helmet is required: on a sea beach (which otherwise is a road under the definition in Article 1(1) of the Law); if the cycle is controlled by an adult pedestrian, but only on a cycle track, on a green lane or on a part of a road other than the carriageway; in a trailer, but only in certain circumstances; if the cycle has 4 or more wheels, but only on a cycle track; or for a Sikh child wearing a turban. The circumstances in which the exception for a trailer applies are when all of the following apply: the trailer is attached by a hinge to the cycle; the trailer has at least 2 wheels in parallel; the trailer complies with the relevant European Standard; the child uses the safety belt; and the child is not too tall for the trailer.
Articles 4 and 5 amend Articles 7 and 8 of the principal Order so that the powers to test and inspect pedal cycles also apply to helmets (and to trailers, where the exception applies), and so that the general offence does not apply to the new provisions on helmets (the relevant offences are instead set out in Article 45A of the Law).
Article 6 adds a new Schedule to the principal Order to set standards for helmets (see below). Article 7 names this Order and brings it into force on 6th October 2014.
The Schedule contains the new Schedule to the principal Order, which sets standards for helmets. The helmet itself must comply with a listed European or non-European standard. The applicable version of that standard is the version in effect when the helmet was manufactured (but the helmet cannot be over 10 years old – see note on Article 3 above).
For a European standard, the child's head must match the marked size of the helmet and the helmet must be adjusted and positioned in accordance with the manufacturer's instructions. For a non-European standard (which must be identified on the helmet, even if the standard does not require that), any equivalent requirements must be met.

This Order gives effect in Jersey to the Council Regulation made on 30th July 2014 amending Council Regulation (EU) No. 692/2014 concerning restrictions on the import into the Union of goods originating in Crimea or Sevastopol in response to the illegal annexation of Crimea and Sevastopol. The amended Regulation provides for a ban on new investments in the infrastructure in the sectors of transport, telecommunications and energy and the exploitation of natural resources in Crimea and Sevastopol, as well as an export ban on key equipment and technology related to those sectors.

This Order further amends the Community Provisions (Restrictive Measures – Ukraine) (Jersey) Order 2014, to give effect in Jersey to Council Implementing Regulation (EU) No. 810/2014 of 25 July 2014 implementing Regulation (EU) No. 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (OJ No. L 221/1, 25.7.2014) (the "Implementing Regulation"), and to Council Regulation (EU) No. 811/2014 of 25 July 2014 amending Regulation (EU) No. 269/2014 concerning restrictive measures, etc. (OJ No. L 221/11, 25.7.2014) (the "Council Regulation"). The Council Regulation expands the scope of the list of persons, entities and bodies who may be subjected to restrictive measures, so as to enable the inclusion of (among others) persons responsible for, actively supporting or implementing actions or policies which obstruct the work of international organizations in Ukraine. The Implementing Regulation adds certain natural and legal persons and entities to the list of those subject to restrictive measures in Annex I to Regulation (EU) No. 269/2014.

This Order amends 3 Orders made under the Social Security (Jersey) Law 1974 so as to substitute references to a fixed pensionable age of 65 with references to the raised pensionable age that is being phased in by the amendments to that Law made by the Social Security (Amendment of Law No. 7) (Jersey) Regulations 2014.
The Orders amended are – the Social Security (Accident Benefit) (Jersey) Order 1974, the Social Security (Contributions) (Jersey) Order 1975 and the Social Security (Incapacity Benefits) (Jersey) Order 2004.

This Order amends the Income Support (General Provision) (Jersey) Order 2008, consequentially upon the enactment of the Social Security (Amendment of Law No. 7) (Jersey) Regulations 2014, which phase in a raising of pensionable age, for the purposes of the old age pension payable under the Social Security (Jersey) Law 1974.
These amendments amend rules regarding the calculation of a person's income for the purposes of income support, so that rules which currently turn upon whether or not a person has attained the age of 65 will turn upon whether or not the person has attained pensionable age, as defined in the Social Security (Jersey) Law 1974.

This Order brings into effect in Jersey, with suitable modifications, the sanctions against Russia imposed by Council Regulation (EU) No. 833/2014 of 31st July 2014 (OJ L No. 229, 31.7.2014, p.1). Those sanctions include a prohibition on the sale, supply, transfer or export of certain goods and technology to Russia for military use; a requirement for authorisation for the sale etc. of certain other equipment and technologies related to oil exploration and production (listed in Annex II to the Council Regulation) to Russia or for use in Russia; and prohibitions on the provision of technical and financial assistance and brokering services related to such goods and technology, or dealing with certain securities and money- market instruments issued by entities listed in Annex III.
The Order creates offences for breach of such sanctions and introduces penalties for those offences. It comes into force the day after it is signed.

Article 2 of the Order provides that Article 74(3), (4) and (5) of the Law shall not apply to a company that immediately before the commencement of this Order was a scheme or arrangement which would be a collective investment fund under Article 3 of the Collective Investment Funds (Jersey) Law 1988 but for the fact that it does not acquire capital by means of an offer to the public of units for subscription, sale or exchange as described in that Law; a certified fund; a recognized fund or an unregulated fund. Article 3 of the Order gives a company that is a certified fund the discretion, in accordance with Article 113(1A) and (1B) of the Law, to disapply the requirement to appoint an auditor to examine and report on accounts of company in relation to a financial period under Article 113(1) of the Law if no units in the fund were issued to any person other than a person connected with the establishment or promotion of the fund in that financial period and any preceding financial period.
Article 3(2) of the Order modifies Article 113(1B) of the Law in respect of its application to a company of a class referred to in Article 3(1) of the Order to provide that the resolution must be passed by all members of the company entitled to vote in general meeting and a printed copy must be embodied in or annexed to every copy of the memorandum or articles issued after the passing of the resolution and forwarded to a member of the company at the member's request on payment of such sum (if any), not exceeding the published maximum, as the company may require. Within 21 days after the resolution is passed it must be delivered to the registrar and be recorded by the registrar. The resolution has the effect of disapplying the requirement to appoint an auditor to examine and report on accounts of the company from the date that it is delivered to the Registrar.
Article 3(3) of the Order provides that Article 113(1C), (1D) and (1E) of the Law shall not apply to the classes of companies referred to in Article 3(1) of the Order.
Article 4 of the Order sets out the title of the Order and provides for it to come into force on the same day as the Companies (Amendment No. 11) (Jersey) Law 2014.

This Order amends Article 40 of the Companies (Uncertificated Securities) (Jersey) Order 1999 by providing that, when determining the earliest time that the issuer may specify for a person to be entered on the relevant register of securities in order to have the right to vote at a meeting (being 48 hours before the time fixed for the meeting), no account should be taken of any part of a day that is not a working day.

This Order re-names the Consumer Safety (Protective Helmets) (Jersey) Order 2006 as the Consumer Safety (Motor Cycle Helmets) (Jersey) Order 2006.
The Road Traffic (Jersey) Law 1956 has been amended to introduce separate provision for protective helmets for pedal cycles (in relation to children), which then is to be distinguished from provision for protective helmets for motor cycles. This amendment therefore follows suit for the consumer safety Order that deals with motor cycle helmets rather than pedal cycle helmets.
It should also be noted that the use of the expression "Motor Cycle" in the new title, without reference to a moped, does not change the position that the Order continues to apply expressly to all such helmets, whether required for motor cycles or mopeds.

This Order amends paragraph 1 of Part 4 of Schedule 2 to, and paragraph 2 of Part 6 of Schedule 3 to the Weights and Measures (Jersey) Law 1967, to render a capacity measure of 2/3 pint lawful for use for trade, and to permit beer and cider to be sold by retail in that quantity.

This Order amends Article 26 of the Weights and Measures (General Provisions) (Jersey) Order 1968, which regulates liquid capacity measures for use for the sale of intoxicating liquor, to allow those measures to be made of stainless steel (as an alternative to glass or transparent plastic).
The Order also amends the table in paragraph 2 of Part 2 of Schedule 1 to the Weights and Measures (General Provisions) (Jersey) Order 1968, to prescribe a limit of error of 4 fluid drachms in relation to a liquid capacity measure of 2/3 pint.

This Order makes further amendments to the Road Traffic ( Grouville ) (Jersey) Order 2002 so as to prohibit waiting on parts of Gorey Village Road, La Rue à Don, La Rue du Marais à la Cocque and Le Chemin des Maltières.

This Order renames the Road Traffic (Protective Helmets) (Jersey) Order 2004 as the "Road Traffic (Motor Cycle Helmets) (Jersey) Order 2004" (the "2004 Order"), to make clear that the 2004 Order relates to helmets for motor cycles (including mopeds) and not to helmets for pedal cycles.
The Road Traffic (No. 60) (Jersey) Regulations 2014 amended the Road Traffic (Jersey) Law 1956 to provide for wearing of protective helmets by children on pedal cycles, by inserting a new Article 45A into that Law. Those Regulations accordingly amended the heading to Article 45 of that Law to read "Motor cycle helmets" instead of "Protective helmets". This Order therefore follows suit by renaming the 2004 Order, which is made under that Article of that Law.
This Order also updates the reference in the renamed 2004 Order to the related Order under the Consumer Safety (Jersey) Law 2006 dealing with motor cycle helmets (which in turn is to be renamed to show that it relates to motor cycles and not to pedal cycles).
This Order comes into force immediately after the commencement of the Order renaming the related Order under the Consumer Safety (Jersey) Law 2006.

This Order provides for the production or condition reports at the commencement and termination of residential tenancies.
Article 1 defines "condition report", requires it to be in writing and allows it to include images.
Article 2 states what a condition report must contain and requires it to specify the condition of the residential unit to which it relates and to itemise any fixtures, fittings and movables belonging to the landlord.
Article 3 requires the landlord to complete a condition report at or before the commencement of the tenancy. Within 7 days of the tenant's vacating the residential unit the landlord must confirm in writing to the tenant the landlord's satisfaction with the condition of the residential unit or complete another condition report. The landlord must provide 2 signed copies of the report to the tenant within 7 days of its completion. If the tenancy is varied or renewed and the landlord and tenant agree, the condition report prepared at the commencement of the tenancy has effect.
Article 4 requires the tenant, within 7 days of receiving the condition report, to accept it or mark on it the modifications the tenant thinks appropriate, failing which he or she is taken to have accepted the report. The landlord then has 7 days to accept the report or try and reach agreement with the tenant, failing which the landlord is taken to have accepted the report as modified by the tenant. If agreement is attempted but fails the report is not treated as accepted and in the event of the matter being considered in proceedings both parties have to provide their best evidence refuting the report, or the modifications to it, as the case may be.
Article 5 provides for the condition report, if accepted or treated as accepted, to be conclusive evidence of the condition of the residential unit and the provision or condition of the landlord's fixtures, fittings and movables, at the time of the report.
Article 6 makes it an offence to contravene Article 3, punishable with a fine of up to level 3 on the standard scale.
Article 7 names the Order and provides for its commencement.
Under the Criminal Justice (Standard Scale of Fines) (Jersey) Law 1993, the standard scale of fines is –
Level 1 £50
Level 2 £500
Level 3 £2,000
Level 4 £5,000.

This Order amends the Education (Discretionary Grants – Amounts) (Jersey) Order 2008 (the "principal Order") to increase the amount of grant maintenance to reflect the annual increase in costs for students following programmes of higher education.
This Order also allows for the removal of Article 2(2) of the principal Order which provided for the reduction in the maintenance costs for a student who has not attained 18 years who is undertaking a vocational arts course.
The minimum value of the relevant assets which are taken into account in assessing the final contribution is reduced from £750,000 to £500,000.

This Order amends the Education (Discretionary Grants – General) (Jersey) Order 2008 to update the definition of independent student and to include the income of a student's partner as relevant income if the student is in a marriage-like or civil-partnership-like relationship.
This Order also removes the distinction previously made for eligibility of students for grants for dance and drama courses.

This Order amends Schedule 5 of the Health Insurance (Pharmaceutical Benefit) (General Provisions) (No. 2) (Jersey) Order 2002 (the "principal Order") to provide an increase in dispensing fee to 351 pence for each of the first 50,000 items of pharmaceutical benefit supplied by an approved supplier on prescription in respect of an insured person. The amendment brings the dispensing fee in line with the RPI (Y) (retail price index excluding mortgage interest payments and direct taxes) value of 1.6% and will take effect from 1st October 2014.
Schedule 5 to the principal Order is also amended to add zopiclone to the list of drugs for which an additional dispensing fee is payable if the prescription is endorsed C.D . by the approved supplier.
This Order also provides for the substitution of Schedule 6 of the principal Order to reduce the discounting scale used to recoup the portion of the discount given to pharmacies by manufacturers and wholesalers from 15% to 10%.

This Order prohibits aircraft (including small unmanned aircraft) from flying in the specified airspace over Jersey temporarily for the Jersey International Air Display 2014 except where the aircraft is flying with the permission of the Senior Air Traffic Controller Jersey; under the control of the Jersey Approach Control; for the purpose of search and rescue or saving life or in the air display or in practices for the air display with the permission of the flying display director.

This Order amends the maximum amount of weekly pay that may be taken into account when calculating a statutory redundancy payment under Article 60C of the Employment (Jersey) Law 2003. The amount is increased from £660 to £670. It was last increased one year ago.

"Will the Minister inform the Assembly whether any progress has been made by the Planning Department in implementing the essential improvements required to current planning enforcement procedures as identified in the reports of the Reg's Skips Inquiry, the States Complaints Board and most recently the Planning Officers' Society and would he explain why there has been such a long delay in dealing with this matter and ensure that the States receive a full and detailed report outlining the remedial action taken?"

"Does the public service reform programme entail a reduction in the numbers of permanent employees and, if so, what targets have been set for the next 5 years and how do they impact on the different pay grades?"

"Will the Minister -
- set out how members of the public seeking the urgent assistance of mental health professionals for friends and family members who are suffering psychotic episodes or other conditions that require admission, voluntarily or by compulsion of law, to Orchard House, St. Saviour or to some other institution can get the help they require and the procedures that must be followed in such cases;
- inform Members whether a person who calls for assistance in these cases is compelled first to contact their GP to arrange for a psychiatrist to consult the person being referred and whether this person will be billed for both the GPs consultation and also that of the psychiatrist who is called out to assess the person who needs urgent medical assessment and treatment at a cost of £100s and, if so, whether she considers this is reasonable;
- explain what she considers to be an acceptable or reasonable timescale for a person to be seen by a doctor, psychiatrist or to be taken to Orchard House or a similar institution from time of first request for assistance or from examination by a psychiatrist?"
- The Minister for Home Affairs will table an answer to the following question asked by Deputy M.R. Higgins of St. Helier –
"Will the Minister advise Members of the number of work permits that have been issued in Jersey over the last three years and give further information regarding the nationality of each the people granted a permit, their profession or skills and the sector in which they will be working and the duration of the permit?"
