In accordance with the meeting dates fixed for 2015 by the Privileges and Procedures Committee, this meeting will continue, if necessary, on Wednesday 29th and Thursday 30th April 2015.

Explanatory Note regarding subordinate legislation tabled at this meeting. (See Item B)

This Order uprates, by 10%, the fees payable for parking permits in St. Helier . In respect of the Cheapside, St. Mark's, and St. Thomas' Zones, the fee for a resident's permit is increased to £293. The fee for such a permit in respect of the Richmond Road Zone is increased to £146. The fee for a business parking permit for any one zone is increased to £219.

The increases will take effect from 1st May 2015. The last increase was on 1st May 2014. The Order was made on 20th April 2015 and comes into force on 1st May 2015.

R&O.44/2015.

This Order –

  1. makes the Esplanade Car Park Shopper Zone a car park in which a vehicle may be parked for up to 3 hours in any one visit, at a charge of 1 unit per hour (for parking between 8 a.m. and 5 p.m. on any day except Sunday);
  2. introduces regulation of parking in the St. Ouen Parish Hall Car Park and the St. Ouen Parish Church Car Park as follows –

Parking in the St. Ouen Parish Church Car Park is restricted to a maximum of 8 hours in any continuous period of 24 hours. Commercial vehicles with an overall length of 15 feet or more and agricultural vehicles may only be parked with the written permission of the Connétable ;

Parking in the rear of the St. Ouen Parish Hall Car Park is restricted to a maximum of 6 hours for each visit between 9 a.m. and 5 p.m. A parking disc must be displayed. A vehicle cannot return within one hour of leaving. Commercial vehicles with an overall length of 15 feet or more and agricultural tractors may only be parked with the written permission of the Connétable ;

Parking in the front of the St. Ouen Parish Hall Car Park is restricted to a maximum of 1 hour for each visit. A parking disc must be displayed. A vehicle cannot return within one hour of leaving. Commercial vehicles with an overall length of 15 feet or more and agricultural tractors may only be parked with the written permission of the Connétable .

The Order was made on 20th April 2015 and came into force on 27th April 2015.

This Order makes provision as to proceedings of the Planning Applications Committee established under Article 9A of the Planning and Building (Jersey) Law 2002 and Standing Order 141A of the States of Jersey. It prescribes (by  Article 1) the quorum for meetings of that Committee, and (by  Article 2) provides that where there is equality of votes on any matter before the Committee, the matter shall be determined in the negative.

The Order was made on 20th April 2015 and came into force on 21st April 2015.

Whether he has, over the past 12 to 24 months, personally received several individual complaints from members of the public in writing and in person, and also from States members, past and present, in meetings with the Chief Executive, regarding alleged harassment, misconduct, and numerous ultra vires actions against these individuals by States of Jersey employees and Executive Officers based within the Environment Department;
  2. Whether, given the number of complaints received, and that they are in the same context, of the same nature, and do not appear to be individual grievances, it was appropriate for these complaints to be passed on to the individuals that they may have been about, or to the person who is responsible for the alleged action;
  3. Whether, in view of concerns raised by former States members with reference to the Committee of Enquiry in 2011, the Chief Minister believes that he is conflicted on the current issues, given his chairmanship of the States Employment Board?"

"Further to the Chief Minister's responses to questions relating to expenditure on e-government, which have revealed that, in addition to the £1.8 million in 2014, a further £4.9 million has been allocated to e-government in 2015, will the Chief Minister indicate what further sums have been estimated in the new Medium Term Financial Plan for the years 2016, 2017 and 2018 and what savings, in which departments, are expected to result from this expenditure over those years?

Will the Chief Minister further state how many posts, at what grades, if any, will be lost through this process, and whether the current post-holders will be offered opportunities for redeployment or redundancy, either voluntary or compulsory?

Will he also inform members when it is anticipated that the savings produced by this "spend to save" initiative will exceed expenditure?"

"The figures released in response to written question 8734, tabled on 14th April 2015, reveal little change in the pattern of tax revenues from non-financial businesses compared with those previously given for the year 2009. Both, however, are dominated (almost 60% of revenue) by two sectors – "other business services" and "other community services". In order to better help members understand the Jersey economy, can the Minister provide a breakdown what types of business these two large categories include?

Will he further inform members what contribution each sub-sector within these broad sectors makes to the £30m of tax revenues produced, and, if not, why not?

The response also states that "the table above includes income tax assessed in respect of the legal and accountancy professions" and then overleaf that only two of the five subsectors of the finance sector, banking and trust and company administration, will pay tax at 10%, the remainder would be taxed at 0%. How much tax is paid by the fund management, legal and accountancy sub-sectors of the financial services sector?

Will the Minister further explain what role is played by income tax on partnerships and sole traders on tax revenues in the finance sector?"

Lewis of St. Helier , asked on 14th April 2015, that the new Transfer of Public Sector Employees (T.O.P.S.E.) agreement to protect the terms and conditions of States employees, which applied in the case of the incorporation of Andium Homes and will apply to the Ports incorporation, did not apply to the formation of the public-private partnership "Visit Jersey" to replace the Tourism department and under which "it was anticipated that the majority of current staff would transfer". Can the Chief Minister give a detailed explanation of why he believes that the protection of T.O.P.S.E. should not have applied in this case?

Will he further assure members that, in the case of any further public-private partnership formations to reduce the numbers in public sector employment, T.O.P.S.E. protection will apply, and if not, why not?"
