This Order amends Article 2 of the Employment (Minimum Wage) (Jersey) Order 2007, to increase the minimum hourly wage to £6.97 for employees other than trainees, to £5.23 for trainees in their first year, and to £6.10 for trainees in their second year. The increases take effect on 1st April 2016.
The Order was made on 20th October 2015 and comes into force on 1st April 2016. R&O.128/2015.
This Order makes further provision as to the eligibility of complainants under Article 8 of the Financial Services Ombudsman (Jersey) Law 2014. Under Article 8(3)(a) of the Law an individual is eligible, but only if not acting for the purposes of his or her trade, business or profession. Under Article 8(3)(b) a microenterprise is eligible. This Order adds a further category of eligible complainant, under Article 8(3)(c), in relation to charities.
Article 1 contains definitions. A "small Jersey charity" is defined as a body or trust that is entitled to income tax exemption (by virtue of its charitable and related purposes), but subject to an income condition. The condition is that the charity's total income must be less than £2,000,000 in the tax assessment year preceding the year in which the charity refers a complaint to the Ombudsman.
Article 2 specifies the additional categories of eligible complainant. In each of these cases the complainant must also meet the requirements of Article 8(2)(b) and (c) of the Law, in not being a financial service provider and in having the required relationship to the relevant provider. Under the Financial Services Ombudsman (Exempt Business) (Jersey) Order 2014, carrying on trust company business does not, without more, amount to being a financial service provider.
A small Jersey charity is specified as an eligible complainant if it is a corporation or association, such as a foundation or an association incorporated under the Loi (1862) sur les teneures en fidéicommis et l'incorporation d'associations. This will apply to such charities even though they are not individuals or microenterprises (and so cannot already be eligible under Article 8(3)(a) or (b) of the Law).
A trust is not a person, so if the small Jersey charity is a trust then its trustees are specified as eligible complainants when making a complaint for the benefit of the charity. Trustees are already eligible under Article 8(3)(a) and (b) of the Law if they are individuals not acting for the purposes of their trade, business or profession, or if they are corporate trustees which are microenterprises. So the effect of this provision is to extend eligibility to trustees (of small Jersey charities), where they are individual professional trustees, or are corporate trustees which are not microenterprises.
A Guernsey charity is similarly specified as an eligible complainant, if it is also eligible under Guernsey's equivalent scheme.
Article 3 names the Order and brings it into force on the commencement of Article 8 of the Law, which will be on 16th November 2015 (under the Financial Services Ombudsman (Jersey) Law 2014 (Appointed Day) (No. 3) Act 2015).

These Rules make provision about certain procedures in applying for an adoption. The provisions are necessitated by changes to the Adoption (Jersey) Law 1961 made by the Adoption (Amendment No. 7) (Jersey) Law 2015.
The Rules amend the Adoption Rules 1962 by –
- replacing all references to "infant" (or "infant's") in the Rules with references to "child" (or "child's");
- substituting Rule 6 to prescribe new procedures relating to agreements or consents by certain persons to an adoption order, including the child being adopted if he or she is 14 or over (and inserting new Forms 5, 5A and 6 with regard to such agreements or consents);
- inserting a new Rule 6A governing applications to the Court to dispense with the agreement of a spouse or civil partner;
- inserting a new Rule 28A (and a new Form 11) governing applications for disclosure to an adopted person of certain documents held by the Court.
The Rules were made by the Superior Number of the Royal Court on 22nd October 2015 and came into force on 29th October 2015.

This Order sets the fees payable under the Aircraft Registration (Jersey) Law 2014.
Article 2 provides for the citation of the Order and for it to come into force the day after it is made. The Order was made on 23rd October 2015 and came into force on 24th October 2015.

This Order makes provision for the form and manner of display of the nationality mark and registration mark of an aircraft registered in Jersey.
Article 1 provides for the nationality mark of an aircraft registered in Jersey to be ZJ and for the registration mark of such an aircraft to be three letters assigned by the Registrar from any series of letters between the letters AAA - ZZZ except that the letters I, O and S shall not be included in the series.
Article 1 also provides for the letters of the nationality mark and registration mark on an aircraft registered in Jersey to be without ornamentation and for a hyphen to be placed between the nationality mark and the registration mark. The nationality mark and registration mark must be displayed to the best advantage, taking into consideration the constructional features of the aircraft and must always be kept clean and visible. The letters constituting the nationality mark and registration mark must be of equal height and together with the hyphen, must all be of the same single colour which must clearly contrast with the background on which they appear. The nationality mark and registration mark must be painted on the aircraft, or affixed to the aircraft by any other means ensuring a similar degree of permanence, in the manner specified in Articles 2, 3 and 4.
Article 2 provides for the position in which the nationality mark and registration mark must be placed on an aircraft registered in Jersey and for the size of the marks.
Article 3 specifies the width, thickness and spacing of the nationality mark and registration mark on an aircraft registered in Jersey.
Article 4 provides for the nationality mark and registration mark to be inscribed on a fire-proof metal plate affixed in a prominent position on the fuselage of an aircraft registered in Jersey.
Article 5 provides for the citation of the Order and for it to come into force the day after it is made. The Order was made on 23rd October 2015 and came into force on 24th October 2015.

"The Minister recently released some limited information relating to the DTZ valuation on what would be the completed Jersey International Finance Centre development at some time in the future. Can the Minister advise:
- what the cost of the valuation was;
- whether the Treasury statement that The latest DTZ valuation was undertaken in accordance with the Royal Institute of Chartered Surveyors' regulations and attributes an estimated aggregate value of £332 million to the completed office development' means that it was carried out as a red book valuation in accordance with standard RICS standards;
- what average rent figure was used and what yield percentage was used to achieve a valuation of £332,000,000 valuation on the completed development of 470,000 square feet; and
- whether the full report will be published immediately to ensure transparency?"

"Will the Minister list for members the current services delivered by his department to the public or other departments and indicate whether he intends to reduce, cease or outsource any of these services as part of his commitment to the delivery of the targets set by the Medium Term Financial Plan (MTFP)? Will he also inform members what reduction in staffing numbers through natural wastage/voluntary release have been achieved by the department in delivering the MTFP so far and what further reductions are being targeted?
In relation to the foregoing, will he further state whether his department has given notice that it intends to withdraw from the contract to service gardens/public space for Andium Homes, and if so why? Is it also the intention to withdraw from a similar contract with the Education Department, and will he state the reasons which underpin this decision?"

To what extent has the need to close beds on safety grounds due to lack of staff been brought about by the need to meet 2015 spending reductions, for example, by deferring recruitment for some posts, and if so, can the Minister assure members that he has measures in hand to ensure that staffing is brought up to full complement in 2016, and if not, why not?
In particular, what measures does the Minister have under consideration to reduce the waiting time for initial orthopaedic appointments along with the waiting time for procedures, other than to prioritise relatively minor procedures that do not require bed occupancy in order to cope, and if none, why? With medical and orthopaedic beds closed what measures does the Minister have in hand to prevent a crisis in the health service this winter?"

"Given that the Minister's response to written question 9012, tabled on 20th October 2015, fails to point out that, although the most common award of Long Term Incapacity Allowance (L.T.I.A.) is 20% (approximately £40 per week), this represents only 8% of claims, can the Minister provide the average loss of income for those receiving L.T.I.A.?
Can the Minister also advise whether, given that the average L.T.I.A. award of those who also need Income Support is some £5,900 annually or £110 weekly, this results in an average loss from the removal of Income Support disregard not of £2.40 but of close to £7.00 weekly?
Is the Minister's statement that the Department has not in any way decreased the income support to those with disabilities' correct given the above figures?"

- The Chief Minister will table an answer to the following question asked by Deputy M.R. Higgins of St. Helier –
"With regard to the Historic Abuse Compensation Scheme, will the Chief Minister advise members:
- how many claims were made;
- how many have been settled;
- how many remain outstanding;
- how many claims were rejected;
- how compensation payments were calculated and how many claims were made and settled within each category;
- how much money has been paid out in total;
- how much money has been paid to States lawyers to date; and
- how much money has been paid to lawyers representing claimants to date?"
- The Chairman of the Comité des Connétable s will table an answer to the following question asked by Deputy M.R. Higgins of St. Helier –
"Will the Chairman advise members whether the Articles of the Loi (1804) au Sujet des Assemblées Paroissiales:
- are still relevant in 2015 and whether consideration should be given as to whether they should or should not be repealed in part or in their entirety; and
- whether there are any plans to amend or repeal Article 3, which allows Deputies in the States the right to attend Assemblies of the parish they represent, but not vote at them?"
- H.M. Attorney General will table an answer to the following question asked by Deputy M.R. Higgins of St. Helier –
"Will H.M. Attorney General advise members whether the Telecommunications (Jersey) Law 1972 or the Telecommunications (Jersey) Law 2002 limited, or limits, the rights of employees of Jersey Telecoms to sue their employer for breach of contract or tort?"
