This Order prescribes fees under the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 (the "Regulations").

The fee for an authorization application is £211.

The fee for a surveillance inspection is £94, if the surveillance relates to fish, or £164 otherwise. The fee for an application to amend an authorization is £96.

The fee for a registration application is £141.

An amount, charged to the Minister by a third party, can be re-charged to the operator if it is for an inspection, test or official examination that falls within Regulation 38(1)(b) of the Regulations (including a surveillance inspection, in which case the £94 or £164 fee will not apply).

A fee can be refunded (wholly or partly) if it is for an application for authorization, for amendment of an authorization, or for registration, and the application is withdrawn (rather than refused).

A licence fee, paid in the previous year under Article 4 of the Animal Welfare (Licence Fee) (Jersey) Order 2008, is to be set off against an authorization application fee, if the applications are connected. Similarly a fee, paid in the previous 5 years under the Community Provisions (Welfare of Animals during Transport) (Fees) (Jersey) Order 2014, is to be set off against the registration fee for a specialist transport business, if the applications are connected.

The Order comes into force on 26th April 2016, which is the date on which most of the Regulations come into force. Regulation 3(1) (the offence of operating when not authorized) does not comes into force until 24th May 2016, and Regulation 10(1) (the offence of operating when not registered) does not comes into force until 12th July 2016. However, applications for authorization or registration can be made, and fees paid, before those dates. Also under Regulation 3(8) a pre-existing operation that applies for authorization before 24th May 2016 may be treated as having an interim authorization if its application has not been determined by that date.

The Order was made on 22nd April 2016 and comes into force on 26th April 2016. R&O.48/2016.

This Order prescribes infectious pancreatic necrosis (IPN) as a supplementary notifiable disease, for the purpose of Part 5 of the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 (the "Regulations"). The Regulations will come into force on 26th April 2016, and the Order would come into force at the same time.

The  Order is  made under Regulation 19(2) of the Regulations,  which gives the  Minister power to prescribe a disease so as to control that disease in Jersey (subject to the requirements of the EU Directive implemented by the Regulations), on the ground that it constitutes a significant risk to the health of aquaculture animals or wild aquatic animals in Jersey.

The effect of the Order is to add infectious pancreatic necrosis to the other diseases that are made notifiable by Regulation 19(1) of the Regulations. The diseases set out in paragraphs (a) to (m) below are notifiable under Regulation 19(1)(a), because they are currently listed in Part II of Annex IV to Council Directive 2006/88/EC of 24 October 2006 (OJ L 328, 24.11.2006, p. 14). The diseases set out in paragraphs (n) to (p) below are notifiable under Regulation 19(1)(b), because Jersey is currently listed as having disease-free status in respect of them in Annex I to Commission Decision 2010/221/EU of 15 April 2010 (OJ L 98, 20.4.2010, p. 7). The ambulatory provision in Regulation 1(2) of the Regulations means any changes to the relevant EU lists will have effect in Jersey automatically, but as at the date on which this Order is proposed to be made the diseases that are notifiable by virtue of being so listed are –

  1. epizootic haematopoietic necrosis;
  2. infection with Bonamia exitiosa;
  3. infection with Perkinsus marinus;
  4. infection with Microcytos mackini;
  5. taura syndrome;
  6. yellowhead disease;
  7. viral haemorrhagic septicaemia (VHS);
  8. infectious haematopoietic necrosis (IHN);
  9. koi herpes virus (KHV) disease;
  10. infectious salmon anaemia (ISA), in respect of infection with genotype HPR-deleted of the genus Isavirus (ISAV);
  11. infection with Marteilia refringens;
  12. infection with Bonamia ostreae;
  13. white spot disease;
  14. spring viraemia of carp (SVC);
  15. bacterial kidney disease (BKD); and
  16. infection with Gyrodactylus salaris (GS).

The Order was made on 22nd April 2016 and comes into force on 26th April 2016.
