This Order amends Schedule 1 to the Aircraft Registration (Jersey) Law 2014 to include the Crown Dependencies of Jersey, Guernsey and the Isle of Man in the list of countries in Schedule 1 to the Aircraft Registration (Jersey) Law 2014. The effect of the amendment is that a body incorporated or undertaking established in, or a resident of, Jersey, Guernsey or the Isle of Man is a qualified person for the purposes of the Aircraft Registration (Jersey) Law 2014 and as such may hold a legal or beneficial interest in an aircraft registered in Jersey.

The Order was made on 8th July 2016 and came into force on 9th July 2016. R&O.79/2016.

This Order makes transitional provisions relating to the commencement of the Children's Property and Tuteurs (Jersey) Law 2016 (the "Law", by virtue of Article 1 which is the interpretation provision).

Article 2 provides that upon commencement the Law shall apply to existing  tuteurs, with certain modifications: for example there is no need for an existing tuteur to take the oath in the new form required by the Law, and the timetable for submission of accounts in Schedule 2 to the Law is modified. However this application of the Law does not invalidate the appointment of existing tuteurs and the Law will be disapplied where the minor in question reaches full age (or dies) between the commencement of the Law and 1st January 2017. Article 2 also makes clear that the Royal Court may exercise its powers under the Law even where there is an existing tuteur, for example to discharge that tuteur or to appoint an additional tuteur, where necessary.

Article 3 is a provision to save any rights of action which may have accrued against existing tuteurs or électeurs of an existing tutelle (although in most other respects functions of électeurs are not preserved: see Article 2(2)).

Article 4 gives the title by which this Order may be cited, and provides that it comes into force upon commencement of the Law.

The Order was made on 26th July 2016 and comes into force in accordance with Article 4. R&O.80/2016.

This Order gives effect to Council Regulation (EU) 2016/1165 of 18 July 2016 amending Regulation (EC) No 1183/2005 imposing certain restrictive measures directed against persons acting in violation of the arms embargo with regard to the Democratic Republic of the Congo (OJ L 193/15, 19.7.2016). The effect of the amending Regulation, which, by this Order, is given effect in Jersey, is as follows –

  1. The derogation from the prohibition of giving technical assistance, financing or financial assistance or brokering services to non-governmental entities or persons operating in the Democratic Republic of Congo (DRC) is extended to cover where that assistance or services relate to other sales and supply of arms and related materiel that is approved in advance by the Sanctions Committee (a Committee of the Security Council of the United Nations); and
  2. Two of the matters included within acts the supporting of which leads to the assets of persons, entities or bodies being frozen are varied so as to include –
  1. planning, directing or committing of all acts in the DRC that constitute human rights violations or abuses or violations of international humanitarian law; and
  2. supporting criminal networks involved in destabilising activities in the DRC through the illicit exploitation of natural resources.

The Order was made on 28th July 2016 and came into force on 29th July 2016.

Under this Order, the Jersey Battle of Flowers Association ("the association") may close public roads and areas of beach, and use them for the purposes of holding the Battle of Flowers on Thursday 11th August 2016 and the Moonlight Parade on Friday 12th August 2016. The association may also restrict parking and traffic movements in those roads and in roads in the surrounding area, as specified in the Order, provided the association gives public notice of the closures and restrictions (as further detailed in the Schedule to the Order), and takes out public liability insurance.

The Order was made on 1st August 2016 and came into force immediately upon being made. R&O.83/2016.

This Order provides for road closures, the closing of other public places and other traffic restrictions in and around Gorey Pier and Gorey Coast Road to enable the holding of Gorey Fête on Thursday 18th August 2016.

This Order allows the Classic and Vintage Motor Racing Club of Jersey Limited to close roads in order to hold sprint races on the Five Mile Road on Friday 26th August 2016 and hill climbs at Grève de Lecq on Saturday 27th and Sunday 28th August 2016. The Order is subject to the Road Racing (General Provisions) (Jersey) Order 1959.

The Order was made on 1st August 2016 and came into force forthwith on being made. R&O.85/2016.

This Order makes various amendments to the Road Traffic ( St. Brelade ) (Jersey) Order 1990. Article 1 defines the "principal Order" as the Road Traffic ( St. Brelade ) (Jersey) Order 1990.

Article 2 inserts a new Part 4A (Articles 13A to J) into the principal Order the effect of which is to create a new resident's parking permit scheme within Les Quennevais Park. The resident's parking zones are the 2 red areas marked on the plan in new Schedule 9 to the principal Order (see Article 5). Residents of the properties marked on the plan would be entitled to apply to the Connétable of St. Brelade for up to 2 non-transferable parking permits per household subject to a maximum number of 60 permits available to be issued by the Connétable . The annual fee per parking permit is £48.

R&O.86/2016.

This Order amends the Road Traffic ( St. Lawrence ) (Jersey) Order 1990 (the "principal Order") to prohibit waiting in locations along Le Mont Cambrai, La Rue de Haut, Le Mont Cochon, St. Aubin's Road and La Route de St. Jean in St. Lawrence and to apply a maximum waiting period of 12 hours in any continuing period of 24 hours on part of Le Mont Cambrai.

This Order also amends the principal Order to substitute the name Petite Rue de l'Eglise, which has been assigned to the formerly unnamed road between the Parish Hall and the Parish Church.

This Order amends the Schedule to the Taxation (Double Taxation) (Jersey) Regulations 2010 by inserting the date that the double taxation agreement between Jersey and Rwanda came into force, that is, 27th June 2016.

The Order was made on 3rd August 2016 and came into force forthwith on being made. R&O.88/2016.

This Order amends the EU Legislation (Sanctions – North Korea) (Jersey) Order 2015, which gives effect to Council Regulation (EC) No 329/2007 of 27 March 2007 concerning restrictive measures against the Democratic People's Republic of Korea (OJ L 88, 29.3.2007, p. 1), as amended (the "2007 Regulation"). This Order gives effect to the amendments to the 2007 Regulation that were made by Council Regulation (EU) 2016/1333 of 4 August 2016 (OJ L 212, 5.8.2016, p. 1).

Those amendments provide for the addition of a new Annex Ig to the 2007 Regulation which lists additional goods (designated as "sensitive goods") to which prohibitions on the transfer, procurement and provision of technical assistance apply.

The Order was made on 16th August 2016 and came into force on 17th August 2016. R&O.89/2016.

Article 1 of this Order removes, from the Banking Business (General Provisions) (Jersey) Order 2002 (the "Order"), a requirement for an application for registration under the Banking Business (Jersey) Law 1991 (the "Law") to be made annually (Article 9(2) of the Order) and a provision relating to the refund of annual fees paid by applicants in accordance with the Law (Article 10 of the Order). These changes are necessary in consequence of amendments made to the Law by Article 1 of the Financial Regulation (Miscellaneous Provisions No. 4) (Jersey) Law 2016, which comes into force on 22nd August 2016.

Article 2 provides for the title by which this Order may be cited, and for its commencement on 22nd August 2016.

The Order was made on 18th August 2016 and came into force on 22nd August 2016.

Article 10 of the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 (the "Law") is amended by Article 4 of the Financial Regulation (Miscellaneous Provisions No. 4) (Jersey) Law 2016, to add a prohibition against the carrying on, in any part of the world, of a specified Schedule 2 business by persons, other than natural persons or companies, having a registered office in Jersey, unless such persons are registered under the Law in respect of the business and carrying on the business in accordance with the terms of their registration. (By Article 1(1) of the Law a "specified Schedule 2 business" means a business described in Schedule 2 to the Proceeds of Crime (Jersey) Law 1999 (subject to certain exemptions in Part A of that Schedule) which is specified in column 3 of the Table to the Law.)

This Order applies in relation to such persons (Article 2), and confers upon them (by Article 3) a transitional period of immunity from prosecution for contravention of Article 10 of the Law, for 6 months from the day on which the amendment described above comes into force, or until an application for registration of a business to which the new provision would otherwise apply is determined, or until a notification that such a business is being carried on is received by the Jersey Financial Services Commission, whichever is earliest.

Article 1 is the interpretation provision, and Article 4 provides for the title by which this Order may be cited.

The Order was made on 18th August 2016 and came into force immediately on being made. R&O.91/2016.

This Order amends the Control of Borrowing (Jersey) Order 1958 so as to enable the Jersey Financial Services Commission to charge fees to the holders of a consent granted under that Order at such intervals and upon the occurrence of such events as the Commission may determine. Such fees must be published in accordance with the requirements of Article 15 of the Financial Services Commission (Jersey) Law 1998. That Order currently only permits a fee to be charged upon the application for a grant of consent.

The Order was made on 18th August 2016 and comes into force on 18th September 2016. R&O.92/2016.

This Order, taken together with Regulations 5 and 5A of the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998 –

  1. prohibits the fishing, taking or storing of soft-shelled spider crabs during the period Thursday 1st September 2016 to Sunday 23rd October 2016 inclusive; and
  2. prohibits, during that period, the use of passive gear within the area of the sea that is specified in the Schedule to the Order.

The Order was made on 26th August 2016 and came into force on the day after it was made.
