Taxation (Agreements with European Union Member States) (Suspension and Termination of Agreement with Austria) (Jersey) Order 2017.
The Government of Jersey was notified by a letter, dated 21st December 2016, from the Permanent Representative for Austria to the European Union ("Austrian Permanent Representative") –
- proposing the suspension of the agreement between Jersey and Austria (the "agreement" as defined in Article 1 of this Order) as to the mutual exchange of information relating to the taxation of savings income in the form of interest payments ("tax information about savings income"), with effect from 1st January 2016 in relation to data for that year; and
- proposing the termination of that agreement as at 31st December 2016 in accordance with the provisions of Council Directive (EU) 2015/2060 of 10 November 2015 (OJ L 301, 18.11.2015, p.1) repealing Directive 2003/48/EC on the taxation of savings income in the form of interest payments (OJ L 157, 26.6.2003, p.38).
Accordingly –
Article 2 of this Order suspends the operation of the Taxation (Agreements with European Union Member States) (Jersey) Regulations 2005 (the "Regulations") to the extent that those Regulations implement so much of the agreement as is suspended in respect of the fulfilment of Jersey's obligations in respect of the exchange of tax information about savings income arising in 2016.
Article 3 of this Order confirms that the agreement ceases to have effect as at 31st December 2016 and removes Austria from the list, in Schedule 1 to the Regulations, of Member States of the European Union with whom an agreement implemented by those Regulations has been entered into.
Article 4 of this Order provides that whilst the agreement with Austria is no longer effective, Jersey is still required to comply with its information exchange duties under the Regulations, for the purposes of that agreement in relation to tax years prior to 1st January 2016.
Article 5 of this Order gives its title and provides for it to come into force on making.
The Schedule to this Order sets out a copy of the Minister for External Relations' letter to the Austrian Permanent Representative, dated 3rd January 2017, agreeing to the suspension and termination of the agreement.
The Order was made on 13th February 2017 and came into force on being made.

Road Traffic ( St. Mary ) (Amendment No. 2) (Jersey) Order 2017.
This Order limits parking to periods totalling 12 hours in any continuous period of 24 hours on 2 previously unrestricted sections of the east side of La Rue de la Rosière in St. Mary . It also extends the prohibition of waiting to another small section of that side of that road.
The Order was made on 27th February 2017 and came into force on 28th February 2017.

Companies (Transfers of Shares – Exemptions) (Amendment No. 3) (Jersey) Order 2017.
This Order amends the Companies (Transfers of Shares – Exemptions) (Jersey) Order 2014 to add as an approved stock exchange the Stock Exchange of Mauritius (in respect only of its market known as the "Official Market").
The effect of this amendment is that any Jersey company listed on an approved stock exchange (which would include the Stock Exchange of Mauritius) would be exempt from the requirement of Article 42 of the Companies (Jersey) Law 1991, which requires an instrument of transfer of shares in writing to be delivered to the company in order for a transfer to be registered, and also the requirement of Article 50(1) of that Law to produce a certificate in respect of allotments or transfers of its shares within 2 months of the allotment or transfer, as the case may be. The exemption from Article 42 is provided for on the basis that a transfer of shares is made to or from an approved central securities depositary (as defined in Article 1 of the Companies (Transfers of Shares – Exemptions) (Jersey) Order 2014) or by means of a computer system which has been approved by the competent authority that has also approved the central securities depositary.
The Order was made on 28th February 2017 and came into force on 1st March 2017.

Legal Tender (Coins) (Jersey) Order 2017.
Article 2 of this Order specifies a new description of £1 coins for the purpose of such coins being legal tender in Jersey. Article 3 calls in £1 coins issued in Jersey prior to 28th March 2017, with the effect that such coins will cease to be legal tender by 15th October 2017.
Article 1 is the interpretation provision and Article 4 gives the title by which this Order may be cited and provides for it to come into force immediately upon being made.
The Order was made on 3rd March 2017 and came into force on the same date.

Police Procedures and Criminal Evidence (Codes of Practice) (Amendment No. 3) (Jersey) Order 2017.
This Order amends Code C in the Schedule to the Police Procedures and Criminal Evidence (Codes of Practice) (Jersey) Order 2004. Code C is the Code of Practice for the detention, treatment and questioning of persons by police officers.
In fulfilment of the publication requirements under Article 62 of the Police Procedures and Criminal Evidence (Jersey) Law 2003 ("2003 Law"), a notice was published on 31st January 2017 in the Gazette advising of the proposals to amend Code C and that a draft of this Order was available on request.
Article 1 is the interpretation provision.
Article 2 amends the interpretation provision and paragraph 2.1(e) in Code C, so as to remove references to certain police stations in Jersey which will cease to function once the Jersey Police Headquarters Building in La Route du Fort becomes operational on 8th March 2017.
Article 3 is a transitional provision which would enable the continued operation of Rouge Bouillon police station as a designated police station for the purposes of detaining arrested persons (see Article 33 of the 2003 Law) until noon on 8th March 2017.
Article 4 provides for the title of this Order and for it to come into force on 8th March 2017. The Order was made on 7th March 2017 and came into force on 8th March 2017.

Motor Vehicles (Driving Licences) (Amendment No. 14) (Jersey) Order 2017.
This Order amends the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to remove the requirement for a photograph required to be furnished with an application for a licence to drive a motor vehicle to be in printed form only so that an application may be made electronically and specifies what the requirement is if the application is made electronically.
The Order was made on 7th March 2017 and comes into force on 14th March 2017.

Long-Term Care Services (Health and Social Services Charges) (Amendment No. 3) (Jersey) Order 2017.
This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014 to increase the charges for the provision of long-term care services (as defined in Article 1 of the Long-Term Care (Health and Social Services Charges) (Jersey) Law 2014) in a care home or group home (as defined in Article 1 of the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014) in line with the 2.67% increase in the rates for the benefit in respect of the cost of long-term care from 1st April 2017. The charges were last increased on 1st January 2016. The Minister for Social Security was consulted with respect to the increase in the charges.
Article 2 sets out the title of this Order and provides for its commencement.
The Order was made on 8th March 2017 and comes into force on 1st April 2017.
