EU Legislation (Sanctions – Egypt) (Jersey) Order 2017.
This Order revokes and replaces the Community Provisions (Restrictive Measures – Egypt) (Jersey) Order 2011. It continues to implement Council Regulation (EU) No 270/2011 of 21 March 2011 ("Regulation (EU) No 270/2011") concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Egypt (OJ L 76, 22.3.2011, p. 4).
This Order updates the sanctions imposed in relation to Egypt, by giving effect to all amendments to Regulation (EU) No 270/2011 up to the date of this Order. The most recent amendment is by Council Implementing Regulation (EU) 2017/491 of 21 March 2017 implementing Regulation (EU) No 270/2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Egypt (OJ L 76, 22.3.2017, p. 10).
This Order also gives effect to any future changes to the lists in the Annexes to Regulation (EU) No 270/2011, including in particular the list of those whose funds and economic resources are frozen.
All the general provisions in the EU Legislation (Sanctions) (General Provisions) (Jersey) Order 2014 form part of this Order.
The Order was made on 20th April 2017 and came into force on 21st April 2017.

EU Legislation (Sanctions – North Korea) (Amendment No. 5) (Jersey) Order 2017.
This Order further amends the EU Legislation (Sanctions – North Korea) (Jersey) Order 2015 ("the principal Order" by virtue of Article 1) (which gives effect in Jersey to Council Regulation (EC) No 329/2007 concerning restrictive measures against the Democratic People's Republic of Korea, OJ L 88, 29.3.2007, p.1, as amended: the "2007 Regulation") to give effect (by Article 2) to amendments to the 2007 Regulation made by Council Regulation (EU) 2017/658 of 6 April 2017, OJ L 94, 7.4.2017, p.3-8.
Those amendments introduce a new prohibition (in Article 3c, added by Article 3 of this Order to the list in Article 5(1)(a) of the principal Order of prohibitions which it is an offence in Jersey to contravene) against providing any services related to mining or incidental to manufacturing in the chemical, mining and refining industry, as further described in the new Annex VIII which is also added to the 2007 Regulation. There are certain exceptions, particularly as to computer and related services, in paragraphs 2. to 5. of Article 3c, and by paragraph 6. this new prohibition does not apply to "the provision of services until 9 July 2017, due under contracts, agreements or obligations that were concluded or arose prior to 8 April 2017."
The updating effected by this Order also includes amendment of paragraph 2. of Article 5b of the 2007 Regulation (contravention of which is similarly an offence in Jersey under the principal Order, and which is a prohibition against establishing joint ventures or taking or extending any ownership interests in entities engaged in North Korea's activities or programmes related to nuclear weapons or other weapons of mass destruction).
The Order was made on 20th April 2017 and came into force on 21st April 2017.

Motor Vehicles (Driving Licences) (Amendment No. 15) (Jersey) Order 2017.
This Order amends the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to increase the fees payable by persons applying for licences. The fees are increased by a quarter (except those relating to provisional licences, which are increased by a third). The fees were last increased on 1st January 2008.
The opportunity is also taken to remove spent references to replacement of licences that were issued before 4th April 2007, and to impose a minimum of £15 on a fee that is discounted when a new licence is issued on the surrender of an unexpired licence (to match the minimum when a new licence is granted for less than 10 years).
The Order was made on 24th April 2017 and came into force on 1st May 2017.

"In light of the objectives of Energy Plan: Pathway 2050' (R.37/2014), will the Minister inform the Assembly what steps, if any, his Department is taking in relation to each of the areas specified below to ensure the public are encouraged to take up the use of sustainable energy sources?
- Offering incentives for the installation of solar panels –
- by private residential properties; and
- by businesses.
- Offering incentives to encourage road users to move away from diesel- or petrol-driven vehicles and toward electric or hybrid options –
- in relation to private vehicles; and
- in relation to commercial vehicles.
Where steps are being taken, will the Minister supply an outline of his plans (including timelines), and where none are currently being taken, will he explain his rationale for not pursuing such measures?
- Deputy M. Tadier of St. Brelade will ask the following question of the Minister for Education –
"Will the Minister provide a breakdown of figures for the total number of students at Les Quennevais School for each of the past 25 years, as well as the projections for student numbers for the next 25 years at 5-year intervals?"

"What is deemed to be the current maximum capacity of Hautlieu School's sixth form; and what are the projections for sixth-form numbers at Hautlieu School for 2020, 2025, 2030, 2035, 2040 and 2045?"

"Following implementation of the policy of charging 90 per cent of market rents in social housing, will the Minister advise what data is used to assess the movement in rental rates in the housing market on an annual basis and whether the 90 per cent rent policy is being applied appropriately?"

"Will the Minister advise what the impact has been on her Department's budget of the Assembly's adoption on 16th May 2013 of The Reform of Social Housing' (P.33/2013) and the agreement that rents in social housing would be charged at 90 per cent of market rents?"

"Given the data comparison provided in answer to Written Question 184 between Table 7 of Social Security Department: Income Support 2011' (R.126/2012) and the figures given in Table 31 of Social Security Department: Minister's Report 2015' (R.104/2016), will the Minister provide a breakdown of the sources of income (such as earnings, maintenance, Long-Term Incapacity Allowance) included as "average other income" for adults with children in these tables?
Will the Minister further advise, in relation to the Income Support claims from families with children shown in Table 33 of R.104/2016, in how many of those claims did the claimants involved have earnings from full-time, part-time and zero-hour jobs; and will she indicate whether the proportion of claimants with zero-hour jobs in this group differs from that proportion for the workforce as a whole?"
- Deputy G.P. Southern of St. Helier will ask the following question of the Minister for Social Security –
"Will the Minister provide her assessment of any trends revealed in the latest data from the labour market report published by the Statistics Unit on the changes to the number of zero-hour jobs in the economy; and will she commit to work with the Statistics Unit to interrogate the data and to examine what proportion of zero-hour contracts relate to minimum-wage or low-pay jobs?"
- The Connétable of St. Helier will ask the following question of the Minister for Infrastructure –
"Will the Minister set out in detail how it is proposed to charge commercial entities for liquid and solid waste arisings and the timetable for doing so; and will he explain how the proposed charging mechanism or mechanisms will –
- be fair, given any seasonal and sectoral variations in current waste arisings;
- incentivise recycling, re-use and waste reduction; and
- provide the predicted level of income required by the Department's revenue budget?"
- Deputy G.P. Southern of St. Helier will ask the following question of the Minister for Health and Social Services –
"Given the continuing challenges to recruitment of qualified staff from the U.K., including potentially E.U.-qualified nurses following Brexit, and the turnover rates for care assistants, will the Minister –
- provide the latest quarterly figures for vacancy rates amongst qualified nurses in hospital services and in community services, along with a like-for-like comparison with figures in both service areas for the past 3 years;
- explain what confidence he has in respect of nursing and other staff currently delivering the fully-funded care services in the community that their terms and conditions will not be eroded following the opening of care services to market forces; and
- provide his assessment of whether the provision of 3-year Service Level Agreements, instead of shorter-term agreements, would achieve greater stability in the planning and delivery of such services?"
- Deputy G.P. Southern of St. Helier will ask the following question of the Minister for Education –
"When will the Minister inform members of the proportion of teachers engaged in teaching G.C.S.E., AS and A-level subjects without a degree-level, or equivalent, qualification in that subject, given his indication on 13th September 2016 that he would do so following consultation with head teachers; and if he will not do so, will he explain why not?"
- Deputy G.P. Southern of St. Helier will ask the following question of the Minister for Education – "In relation to the pupil premium, will the Minister inform members –
- what sums have been spent on the premium to deliver additional support to pupils; and
- how many pupils have been supported and in which secondary and primary schools?
Will the Minister further explain why any such support could not be delivered through normal budget funding and, if it could not be delivered in this way, will he explain why not?"
- Deputy M.R. Higgins of St. Helier will ask the following question of H.M. Attorney General –
"Will H.M. Attorney General explain what Human Rights audits, if any, were conducted of the practices and procedures of each of Jersey's courts and tribunals to ensure that they were compatible both prior to, and after, the Human Rights (Jersey) Law 2000 was enacted; and will he further explain when any such audits took place, by whom they were conducted and where, if anywhere, the findings of any such audits can be examined?"
- Deputy M.R. Higgins of St. Helier will ask the following question of H.M. Attorney General –
"Will H.M. Attorney General explain what the phrase equality of arms' means in a Human Rights context and will he further explain, with examples, whether Jersey's court and justice system provides adequate protection to Islanders in that regard?"
