Collective Investment Funds (Unregulated Funds) (Amendment No. 3) (Jersey) Order 2018.

This Order makes miscellaneous changes to the Collective Investment Funds (Unregulated Funds) (Jersey) Order 2008 (the "principal Order" as defined in Article 1).

Article 2 amends paragraph 5(2) of Schedule 1 to the principal Order. The effect of the amendment is to permit the appointment of a market maker by a fund company or by another person on behalf of the fund (that meets the other provisions of paragraph 5(2) of that Schedule) where the fund company is a United Kingdom real estate investment trust and units in the fund company are listed on one or more of the exchanges or markets listed in Schedule 4 to the principal Order, or in the case of a United Kingdom real estate investment trust, on a recognized stock exchange (within the meaning given by section 1005(1) of the Income Tax Act 2007 (c. 3) of the United Kingdom). The term "United Kingdom real estate investment trust" is defined to mean a fund company that has provided notice under section 523 or 524 of the Corporation Tax Act 2010 (c. 4) of the United Kingdom.

Article 3 amends paragraph 3(1) of Schedule 2 to the principal Order to set, as a condition, a requirement for the notice under that paragraph to be given to the registrar before 1st April 2018 in order for a scheme or arrangement not to constitute collective investment fund (i.e. to constitute an unregulated fund (as defined in Article 1 of the principal Order) that meets the conditions of Schedule 2).

Article 4 amends Schedule 4 to the principal Order to include a reference to paragraph 5(2)(a) of Schedule 1 to that Order in the sub-heading of Schedule 4 as a consequence of the amendment made to that Schedule by Article 2 and to reflect the change in the name of the "Channel Islands Stock Exchange" to "The International Stock Exchange" in the list of exchanges and markets set out in Schedule 4.

Article 5 sets out the title of this Order and provides for it to come into force 7 days after it is made. The Order was made on 25th January 2018 and comes into force on 1st February 2018.
