Marriage and Civil Status (Jersey) Order 2018.
This Order makes provisions relating to marriages, births and deaths.
PART 1 comprises Article 1 which defines certain terms used in this Order.
PART 2 comprises Articles 2 to 11 which deal with authorization for the solemnization of marriage.
By Article 2, the scheme prescribed under Article 6(3) of the Marriage and Civil Status (Jersey) Law 2001 (the "Law") for the authorization by the Superintendent Registrar of persons authorized as authorized civil celebrants or authorized religious officials is as set out in Part 2.
Article 3 sets out the application, authorization, registration and renewal processes for authorization of a person as an authorized civil celebrant.
Article 4 sets out the application, authorization and registration processes for authorization of a person as an authorized religious official.
By Article 5, an authorization of an individual as an authorized civil celebrant is valid for 5 years, subject to suspension of the authorization under Articles 8 and 9 or revocation of the authorization under Article 8.
By Article 6, an authorization of an individual as an authorized religious official shall be for an unlimited period, subject to suspension of the authorization under Articles 8 and 9 or revocation of the authorization under Article 8.
Article 7 contains conditions that apply in relation to an authorized civil celebrant or authorized religious official.
Article 8 gives the Superintendent Registrar the power, for the purpose of monitoring an authorized civil celebrant or authorized religious official under Article 6(3)(e) of the Law, to carry out an inspection in relation to the performance of an authorized civil celebrant or authorized religious official and requires the Superintendent Registrar to investigate an authorized civil celebrant or authorized religious official in certain circumstances and to take certain action, including suspending or revoking an authorization.
By Article 9, the Superintendent Registrar has the power to suspend the authorization of a person as an authorized civil celebrant or authorized religious official whilst an investigation by the Superintendent Registrar is being carried out under Article 8 or for non-payment of the annual fee referred to in Article 11.
Article 10 entitles a person aggrieved by a decision of the Superintendent Registrar under Article 3(6)(b) or (9), 4(7)(b) or (10), 8(12) or (13) or 9(1) to require a review of that decision by the Minister (as defined in Article 1(1) of the Law). In reviewing the decision of the Superintendent Registrar, the Minister has the power to request and receive submissions from any person as the Minister deems necessary, including the authorized civil celebrant or authorized religious celebrant. The Minister may also request a suitably qualified independent person to investigate in the event that the Minister believes there are compelling grounds to do so, to assist the Minister with his or her review. Upon review of the decision of the Superintendent Registrar, the Minister has the power to uphold the decision or overturn the decision of the Superintendent Registrar. The Minister's decision is final.
Article 11 makes provision for a fee and an annual fee to be payable to the Superintendent Registrar by an authorized civil celebrant or an authorized for the grant of an authorization.
PART 3 comprises Articles 12 to 24 which make provision for the locations in respect of the solemnization of marriage.
Article 12 provides for the scheme for the approval, by an approving authority (as defined in Article 1(1) of the Law), of any location for the purposes of solemnizing marriages at that location to be as set out in Part 3.
By Article 13, the kinds of locations in respect of which approvals may be granted for any marriage to be solemnized include an open air location; a location that is movable property on the condition that the location remains static during the period commencing at least one hour before the solemnization of the marriage and ending at the end of the marriage ceremony; a location that is immovable property; a whole location or part of a location (whether joined or separate) or any combination of those locations.
Article 14 makes provision for the types of approval of locations for the solemnization of marriage.
Article 15 sets out the procedures in respect of applications for approval by an approving authority of a location for the solemnization of a marriage.
Article 16 makes provision for the grant, refusal and renewal of an approval of a location by the approving authority.
Article 17 provides for the register of approved locations to contain and be endorsed with certain information relating to the approved location.
Article 18 makes provision for the duration of an approval of a location for the solemnization of marriage so that –
- in the case of an approved location for the solemnization of a specified marriage referred to in Article 14 (a) or (c), the approval is valid only for the duration of the solemnization of that marriage subject to the revocation of the approval; or
- in the case of an approved location for the solemnization of a marriage referred to in Article 14(b) or (d), the approval is valid for a period of 3 years, subject to the revocation of the approval.
By Article 19, the responsible person (as defined in Article 1(1)) shall be the point of contact between the approving authority and the Superintendent Registrar with regard to all matters relating to the approval, registration and use of the approved location for the solemnization of marriage and with the public with regard to dealing with enquiries about the use of the approved location for the solemnization of marriage.
Article 20 requires that, on the day of the solemnization of a marriage, the marriage celebrant shall be responsible for ensuring that the standard conditions specified in paragraph (2) of that Article are complied with.
By Article 21, the approving authority has the power to impose any special conditions that the approving authority believes are required to ensure that an approved location is, and remains, suitable for the solemnization of marriage. The responsible person shall ensure that any special conditions imposed by the approving authority are complied with.
Article 22 gives the approving authority the power to amend any approval of a location for the solemnization of a marriage on the application of the proprietor, trustee, managing agent or administering authority of an approved location or the Superintendent Registrar or a relevant authority. An application for amendment to an approval made by the proprietor, trustee, managing agent or administering authority of an approved location must be accompanied by the required fee, except that the approving authority may waive such fee if the approving authority is satisfied that it is reasonable to do so because it is in the public interest.
Article 23 makes provision for the revocation of an approval of a location for the solemnization of marriage.
Article 24 provides for the review of a decision of an approving authority by the Minister. The Minister's decision on review is final.
PART 4 comprises Articles 25 to 27 which make provision regarding certification of a location as a usual place of public religious worship.
Article 25 sets out the information that must be contained in an application for registration of a location as a usual place of public religious worship of a religious organization.
By Article 26, a location must not be certified as a usual place of public religious if the principal use of the location is not for public worship, even if the location may be used for worship. Also, a parish hall must not be certified as a usual place of worship.
By Article 27, a location may be certified as a usual place of public religious worship if it is a location that is used primarily as a usual place of public religious worship by a religious organization that is recognized and established in Jersey regardless of whether it is used for any other purpose.
PART 5 comprises Articles 28 to 45 and makes provision for the procedures, notices and forms for marriage authorized under a marriage schedule or a certificate of no impediment to marriage.
Article 28 sets out the information be included in an application for a notice of intended marriage. Article 29 sets out the particulars to be included in a notice of intended marriage form.
Article 30 sets out the information that must be included in a freedom to marry declaration. Article 31 sets out the particulars to be contained in a marriage schedule.
Article 32 sets out the particulars to be contained in a signature verification form.
Article 33 sets out the particulars to be contained in a marriage certificate.
Article 34 sets out the particulars to be contained in a certificate of no impediment to marriage. Article 35 sets out the information to be included in an application for conversion.
Article 36 sets out the particulars to be contained in a conversion declaration form.
Article 37 provides requirements and procedures for allowing persons (intending to solemnize their marriage on the authority of a marriage schedule or conversion declaration) to solemnize their marriage according to a wish referred to in Article 24(1) of the Law, if any, of the special circumstances referred to in Article 24(2) of the Law exist.
Article 38 sets out the particulars to be contained in the register of authorize civil celebrants, register of authorized religious officials, notices of intended marriages book and the index of names of the parties to any marriages solemnized in Jersey.
Article 39 sets out the information to be contained in an application for a search under Article 24C of the Law.
Article 40 sets out the specifications for the book of banns under Article 28 of the Law.
Article 41 sets out the particulars to be contained in the register supplied to an incumbent of an Anglican church under Article 47 of the Law.
Article 42 sets out the manner in which certain requirements under Articles 47, 69 and 70 of the Law relating to the registration of particulars of a marriage may be satisfied.
Article 43 provides for returns of information in relation to marriages solemnized in an Anglican church to be provided to the Superintendent Registrar.
Article 44 a registrar to deliver registers to the Superintendent Registrar within 30 days after the end of each quarter.
Article 45 gives the Superintendent the power in exceptional circumstances to omit details in respect of forenames and surnames required as particulars in a notice of intended marriage, marriage schedule, signature verification form, marriage certificate, certificate of no impediment to marriage, conversion declaration form, notices of intended marriages book and index of the names of the parties to any marriage solemnized in Jersey.
PART 6 comprises Article 46 to 55 which deal with matters relating to registration of births and death. Article 46 sets out the requirements for registration of a birth or stillbirth under Article 50 of the Law.
Article 47 sets out the matters in respect of a declaration to be made under Article 57(2) of the Law with regard to the re-registration of the birth of a legitimated person.
Article 48 sets out the information to be contained in a certificate under Article 58(1) of the Law to be produced for a request to be made for the registration of a name as altered or given.
Article 49 sets out the particulars to be entered in the register of births kept by a registrar in the parish in which a child who was abandoned was found in accordance with Article 59 of the Law.
Article 50 sets out the particulars to be contained in a request for a short birth certificate issued by a registrar pursuant to a request made under Article 60(1) of the Law. Article 50 also sets out the particulars to be contained in a short birth certificate issued by the Superintendent Registrar pursuant to a request made under Article 60(2) of the Law in respect of a birth for which an entry has been made in the Adopted Children Register kept pursuant to Article 24 of the Adoption (Jersey) Law 1961.
Article 51 sets out the particulars to be contained in a certificate of registration of stillbirth under Article 61(5) of the Law.
Article 52 sets out the requirements for the registration of a death by a registrar under Article 50 of the Law.
Article 53 sets out the particulars to be contained in a certificate of registration of death under Article 68 of the Law.
Article 54 specifies the manner in which a declaration under Part 5 of the Law shall be made.
Article 55 makes provision for a registrar to deliver to the Superintendent Registrar within 30 days after each quarter, the registers supplied to the registrar under Article 47 of the Law and a certificate setting out the number of births, stillbirths and deaths in the parish and registered in the register.
PART 7 contains Articles 56 to 61 which deal with miscellaneous matters.
Article 56 makes provision for the correction of errors in entries by the Superintendent Registrar.
Article 57 provides for the Superintendent Registrar to arrange for the binding of returns, marriage schedules and conversion declaration forms as is necessary.
Article 58 provides for Part 2 of Schedule 1 to take effect to set the fees payable under the provisions of the Law mentioned in that Part of Schedule 1.
Article 59 provides for Schedule 2 to have effect with respect to transitional provisions.
By Article 60, the Marriage and Civil Status (Forms, Registration and Fees) (Jersey) Order 2002 and the Marriage and Civil Status (Approved Premises) Order 2002 are revoked.
Article 61 provides the title of this Order and provides for it to come into force immediately after the coming into force of the Marriage and Civil Status (Amendment No. 4) (Jersey) Law 2018.
The Order was made on 27th June 2018 and came into force in accordance with Article 61.

"Further to my written question at the last States sitting on the accuracy of the electoral registers (WQ.87/2018), in which it was revealed that 77 voters who were not on the electoral register (due to an administrative error) had been permitted to vote in the recent elections, will the Chairman request the following information from the Judicial Greffier –
- a breakdown by Parish of the people who were permitted to vote despite not being on the electoral register;
- a comparison with the previous 5 elections on the total number of people permitted to vote after such an administrative error had been proven;
- a breakdown of the number of voters who claimed they were not on the register due to an administrative error but who were either unable to prove it or who indicated they would not challenge the position because of any inconvenience it would cause to them; and
- an explanation of how such administrative errors can happen?"

"Further to her response to Written Question 92/2018, in which the Minister stated that "it was decided investment would be better utilised to develop alternative provision [to the Jersey Early Learning Literacy Years clubs]", will the Minister explain –
- whether this means that the two schemes (Making it REAL' and Triple P') used to run alongside the J.E.L.L.Y. clubs initiative, or were both replacements for those clubs;
- what funding has been allocated annually for these early literacy schemes since the commitment by the previous Council of Ministers to the 1,001 Days Programme;

"What process, if any, is in place to ensure that all States job vacancies are filled locally before they are advertised in the U.K. and elsewhere; what checks and balances are in place to ensure that such a local search has been done thoroughly; and what is the Chairman's assessment of the robustness of this process?"
