Road Traffic (Rue des Pres Trading Estate) (Amendment) (Jersey) Order 2017.

This Order amends the Road Traffic (Rue des Prés Trading Estate) (Jersey) Order 2017 so as to increase the number of permit parking spaces in L'Avenue le Bas and La Rue Martel and reduce the number of parking permit spaces in La Rue Sinnatt and La Rue Grellier.

The Order was made on 12th December 2017 and came into force on 19th December 2017.

R&O.131/2017.

Economic Development, Tourism, Sport and Culture (2018 Fees) (Jersey) Order 2017.

This Order increases the fees charged under 3 regimes administered by the Minister for Economic Development, Tourism, Sport and Culture. The fees are increased by 2% which is 0.7% below the rate of RPI(X) as of June 2017.

Article 1 amends the Places of Refreshment (Registration) (Fees) (Jersey) Order 2008 so as to increase the fee for an application for registration, or the renewal of registration, of premises as a place of refreshment under Article 4(1) of the Places of Refreshment (Jersey) Law 1967. That fee was last increased with effect from 1st January 2017.

Article 2 amends the Tourism (General Provisions) (Jersey) Order 1990 so as to increase the fees for registrations or renewals under Article 9(1) of the Tourism (Jersey) Law 1948. Those fees were last increased with effect from 14th October 2016.

Article 3 amends the Weights and Measures (Testing Fees) (Jersey) Order 2003 so as to increase the fees for testing, weighing or measuring equipment under Article 12(3) of the Weight and Measures (Jersey) Law 1967. Those fees were last increased with effect from 1st January 2017.

Article 4 provides for the title by which this Order may be cited and states when the provisions come into force. Article 2 comes into force 7 days after the Order is made and the remaining provisions of the Order come into force on 1st January 2018.

The Order was made on 14th December 2017 and came into force in accordance with Article 4.

Long-Term Care (Benefits) (Amendment No. 5) (Jersey) Order 2017.

This Order further amends (by Articles 2, 3, 4(a) and (b) and 5) the Long-Term Care (Benefits) (Jersey) Order 2014. The overall effect of these amendments is to uprate by approximately 1.5% the value of long- term care benefit comprising weekly standard care costs of long-term care. A minor amendment is also made to Article 10 of that Order (by Article 4(c)) to reflect the position that such costs are accumulated towards the care costs cap at the same rate whether the care is provided in a care home, a group home, or a person's principal residence.

Article 1 of this Order is an interpretation provision and Article 6 gives the title by which it may be cited and provides for it to come into force on 1st January 2018.

The Order was made on 15th December 2017 and came into force on 1st January 2018.

Infrastructure (Driver and Vehicle Standards – 2018 Fees) (Jersey) Order 2017.

This Order increases the fees charged by Driver and Vehicle Standards (part of the Department for Infrastructure) from 1st January 2018 by an average of just under 2.5% (the fee increases being rounded to the nearest pound). The fee for the compulsory basic training course, however, is increased by Article 5 by 3.3% (representing a cost of living increase).

The Order was made on 19th December 2017 and came into force on 1st January 2018.

EU Legislation (Sanctions – Russia) (Amendment) (Jersey) Order 2017.

Article 1 of this Order amends the EU Legislation (Sanctions – Russia) (Jersey) Order 2014 so as to give effect in Jersey to Council Regulation (EU) 2017/2212 of 30 November 2017 (OJ L 316/15, 1.12.2017) amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine. The effect of the amendment is to permit technical assistance, financing or financial assistance related to the sale, supply, transfer or export and the import, purchase or transport of hydrazine in concentrations of 70% if the hydrazine is destined for tests and flights in the framework of the ExoMars 2020 space mission. Such technical assistance, financing or financial assistance would otherwise be prohibited by Article 4 of Regulation (EU) No 833/2014.

Article 2 gives the title by which this Order may be cited and provides for it to come into force on the day after it is made.

The Order was made on 19th December 2017 and came into force on 20th December 2017.

Long-Term Care Services (Health and Social Services Charges) (Amendment No. 5) (Jersey) Order 2017.

Article 1 of this Order further amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014, to increase by approximately 1.5% the charges payable for the provision of long-term care services in a care home or group home.

Article 2 gives the title by which this Order may be cited and provides for it to come into force on 1st January 2018.

The Order was made on 19th December 2017 and came into force on 1st January 2018.

Environment (2018 Fees) (Jersey) Order 2017.

This Order uprates (by between 0.71% and 2.50%) certain fees chargeable under various enactments relating to the environment.

Article 1 amends the Animal Welfare (Licence Fee) (Jersey) Order 2008 so as to uprate (by between 1.14% and 2.50%) various licence fees prescribed by that Order. Those fees were last increased on 1st January 2017.

Article 2 amends the Artificial Insemination of Domestic Animals (Bovine Semen) (Jersey) Order 2008 so as to uprate (by between 0.71% and 2.47%) various approval, inspection and licence fees prescribed by that Order. Those fees were last increased on 1st January 2017.

Article 3 amends the Community Provisions (Bovine Embryos) (Fees) (Jersey) Order 2011 so as to uprate (by between 1.60% and 2.15%) fees prescribed by that Order for approvals, certificates and inspections. Those fees were last increased on 1st January 2017.

Article 4 amends the Community Provisions (Welfare of Animals during Transport) (Fees) (Jersey) Order 2014 so as to uprate (by between 1.43% and 2.22%) fees prescribed by that Order for authorizations, issuance of certificates of competence and certificates of approvals. Those fees were last increased on 1st January 2017.

Article 5 amends the Dangerous Wild Animals (Jersey) Law 1999 so as to uprate (by 2.36%) the fee chargeable for a licence under that Law. That fee was last increased on 1st January 2017.

Article 6 amends the Endangered Species (CITIES) (Fees) (Jersey) Order 2012 so as to uprate (by between 2.31% and 2.50%) fees prescribed by that Order in respect of permits, certificates commercial licences. Those fees were last increased on 1st January 2015.

Article 7 amends the EU Legislation (Aquatic Animal Health – Fees) (Jersey) Order 2016 so as to uprate (by between 1.80% and 2.33%) fees prescribed by that Order for authorizations, inspections and registrations. Those fees were last increased on 1st January 2017.

Article 8 amends the EU Legislation (Veterinary and Zootechnical Checks – Trade with Member States) (Fees and Expenses) (Jersey) Order 2016 so as to uprate (by between 1.57% and 2.08%) fees and expenses prescribed by that Order for certificates and inspections. Those fees were last increase on 1st January 2017.

Article 9 amends the High Hedges (Application Fee) (Jersey) Order 2008 so as to uprate (by 2.29%) the application fee chargeable to assess the impact of a high hedge. That fee was last increased on 1st January 2017.

Article 10 amends the Pet Travel Scheme (Fees) (Jersey) Order 2015 so as to uprate (by between 2.07% and 2.50%) fees prescribed by that Order for approvals and authorizations. Those fees were last increased on 1st January 2017.

Article 11 –

  1. amends Article 2 of the Planning and Building (Fees) (Jersey) Order 2008 (the "Development Fees Order") so as to uprate by 2.50% the maximum aggregate fee payable in respect of multiple applications for planning permission. That fee was last increased on 1st January 2017;
  2. amends Article 2A to uprate (by 1.96%) the fee prescribed by that Order for each application to remove or vary a condition of planning permission. If there are more than 6 such applications, the fee is the equivalent of the total fees payable in respect of 6 applications. This fee does not apply in respect of an application to remove or vary a condition of planning permission granted under a Development Order (as defined in Article 1(1) of the Planning and Building (Jersey) Law 2002) or where the permission is subject to a condition that the development, to which the permission relates, must be begun before the expiration of a specified period;
  3. amends Article 3 of the Development Fees Order so as to uprate (by 2.22%) the fee payable for a completion certificate;
  4. amends the table in Schedule 1 to the Development Fees Order relating to the application fees for planning permission so as to uprate those fees (by between 1.69% and 2.47%);
  5. amends the table in Schedule 2 to the Development Fees Order in respect of the application fees for building permission so as to uprate those fees (by between 1.42% and 2.50%); and
  6. amends the table in Schedule 2 to the Development Fees Order in respect of appeals against refusal or deemed refusal of application for planning permission so as to uprate those fees (by 2.50%).

The fees in Article 2 and Schedules 1, 2 and 3 of the Development Fees Order were last increased on 1st January 2017 and the fee in Article 2A of that Order was introduced on that date.

Article 12 amends Plant Health (Field Inspections – Fees) (Jersey) Order 2014 so as to uprate (by 2.47%) the fee per vergée for inspecting Narcissus bulbs for infestation by stem and bulb eelworm. That fee was last increased on 1st January 2017.

Article 13 amends the Sea Fisheries (General Fees) (Jersey) Order 2010 so as to uprate (by 2.50%) the fee prescribed by that Order for licences and permits. Those fees were last increased on 1st January 2016.

Article 14 amends the table in Schedule 1 to the Waste Management (Fees) (Jersey) Order 2008 so as to uprate (by between 1.75% and 2.50%) various licence, consignment note and registration fees. Those fees were last increased on 1st January 2017.

Article 15 provides for the title of this Order and for it to come into force on 1st January 2018. The Order was made on 20th December 2017 and came into force on 1st January 2018.

Income Tax (Actuarial Equivalents) (Jersey) Order 2017.

This Order revokes and replaces the Income Tax (Actuarial Equivalents) (Jersey) Order 2002 (Article 4) and prescribes the manner for determining the actuarial equivalent of –

  1. income from securities purchased by a trust for the purposes of Article 131E(4)(a)(i) of the Income Tax (Jersey) Law 1961 (Article 2); and
  2. certain income payable for life for the purposes of Article 131F(3)(d) of the Income Tax (Jersey) Law 1961 (Article 3).

Article 5 sets out the title of this Order and provides for it to come into force the day after it is made. The Order was made on 22nd December 2017 and came into force on 23rd December 2017.

Income Tax (Minimum Retirement Capital) (Jersey) Order 2017.

This Order sets out –

  1. under Article 2, the method for determining the threshold for relevant capital for the purpose of determining an individual's entitlement to minimum retirement capital in accordance with Article 131FA of the Income Tax (Jersey) Law 1961 (the "Law" as defined in Article 1);
  2. the amount and nature of relevant capital for the purposes of Articles 131FA and 131FB of the Law (Article 3); and
  3. the relevant capital factor (for the purpose of calculating an individual's minimum retirement income) under Article 131FB of the Law (Article 4).

Article 5 sets out the title of this Order and provides for it to come into force 7 days after it is made. The Order was made on 22nd December 2017 and came into force on 29th December 2017.

Immigration (Control of Entry Through Republic of Ireland) (Jersey) Order 2018.

This Order is made by the Minister for Home Affairs in pursuance of section 9 of the Immigration Act 1971 ("the 1971 Act") as extended to Jersey with modifications made by the Immigration (Jersey) Order 1993 and the Immigration (Jersey) (Amendment) Order 2017 ("the 2017 Order in Council") which was registered by the Royal Court on 3rd November 2017, and came onto force on 10th November 2017.

The Common Travel Area ("the CTA") is established as a matter of Jersey law by virtue of section 1(3) of the 1971 Act as extended viz:

"(3) Arrival in and departure from the [Bailiwick of Jersey] on a local journey from or to [the

United Kingdom, the Bailiwick of Guernsey, the Isle of Man] or the Republic of Ireland shall not be subject to control under this Act, nor shall a person require leave to enter the [Bailiwick of Jersey] on so arriving, except insofar as any of those places is for any purpose excluded from this subsection under the powers conferred by this Act; and in this Act the [Bailiwick of Jersey] and those places, or such of them as are not so excluded, are collectively referred to as the common travel area'."

There is a power by Order, in the United Kingdom and in Jersey, to impose certain restrictions and conditions on non-British citizens otherwise travelling lawfully within the CTA. The power to impose restrictions and conditions vests in the Secretary of State in the United Kingdom; but the corresponding power in Jersey vested partly in the Minister for Home Affairs and partly in the Lieutenant-Governor until the 2017 Order in Council came into force. Since then the corresponding power in Jersey has vested fully in the Minister in the same way as it vests fully in the Secretary of State in the United Kingdom.

The purpose of this Order is to repeal the Immigration (Control of Entry Through Republic of Ireland) (Jersey) Order 2015 which was made jointly by the Lieutenant-Governor and the Minister for Home Affairs before the 2017 Order in Council came into force, and to re-enact equivalent provisions in the name solely of the Minister for Home Affairs, in accordance with the 2017 Order in Council.

The Order was made on 8th January 2018 and came into force on 15th January 2018.

Immigration (Removal Directions) (Jersey) Order 2018.

This Order is made by the Minister for Home Affairs in pursuance of section 10 of the Immigration and Asylum Act 1999 ("section 10") as extended to Jersey, with modifications and exceptions, by the Immigration and Asylum Act 1999 (Jersey) Order 2003, as amended by the Immigration (Jersey) (Amendment) Order 2017 ("the 2017 Order in Council").

Section 10 provides that a person who is not a British citizen may be removed from Jersey in accordance with directions given by an immigration officer, if certain conditions are met. Directions under section 10 may be given only to persons falling within a class prescribed by Order; and that such directions may impose any requirements of a kind prescribed by Order. The power to make Orders for these 2 purposes vested in the Lieutenant-Governor under the Immigration and Asylum Act 1999 (Jersey) Order 2003; and the relevant prescribed classes and prescribed conditions were laid down in the Immigration (Removal Directions) (Jersey) Order 2004 ("the 2004 Order") made by the (then) Lieutenant-Governor.

The 2017 Order in Council now provides for the Order-making function under section 10 to vest in the Minister for Home Affairs. The purpose of the draft Order is therefore to repeal the 2004 Order, and to re- enact equivalent provisions in the name of the Minister for Home Affairs, in accordance with the 2017 Order in Council.

The Order was made on 8th January 2018 and came into force on 15th January 2018.

The Law Society of Jersey (Disciplinary Proceedings) Rules 2018.

The Law Society of Jersey (Amendment No. 4) Law 2017 ("the amending Law") was registered by the Royal Court on 27th July 2017. The amending Law has yet to be brought into force by the States.

One of the purposes of the amending Law is to revise and improve the procedures in The Law Society of Jersey Law 2005 for dealing with complaints of professional misconduct against advocates and solicitors. Another purpose is to make provision for the recognition and disciplinary control of legal services bodies. The amending Law made fresh provisions for the Superior Number of the Royal Court to make Rules in connection with the procedures to be followed when complaints of professional misconduct are made. These Rules have been made pursuant to those provisions.

The Rules consist of 5 Parts.

Part 1 consists of Rule 1 which contains definitions for the purposes of the Rules.

Part 2 consists of Rules 2 and 3 setting out initial procedures in relation to a complaint once a prima facie case has been established.

Part 3 consists of Rules 4 to 7 relating to procedures upon the reference of a complaint to a disciplinary committee.

Part 4 consists of Rules 8 to 14 relating to hearings and evidence.

Part 5 consists of Rules 15 to 17 which make miscellaneous provisions including the citation of the Rules.

The Rules were made by the Superior Number of the Royal Court on 10th January 2018 and (under Rule 17) are expressed to come into force on the same date as the amending Law (which has yet to be brought into force by Act of the States).

  1. The Chief Minister will table an answer to the following question asked by Deputy M.R. Higgins of St. Helier

"With regard to the European Union's requirement for companies and, if applicable, trusts and foundations, to have real substance within the jurisdictions in which they reside for tax purposes, will the Chief Minister advise members –

  1. if the E.U. has advised the relevant Jersey authorities how they have defined the substance test', and if so what that test is; and
  2. if the E.U. does not have a common test, what test Jersey is proposing to use in this regard; and
  3. what knowledge he has of the test being used by Guernsey and the Isle of Man?"
