Teachers Superannuation (Refund of Contributions, Deferred Pensions and Transfer Value Payments) (Miscellaneous Amendments) (Jersey) Order 2018.

Part 1 of this Order amends the Teachers' Superannuation (Existing Members) (Jersey) Order 1986 (the "Existing Members Order" as defined by Article 1).

Article 2 substitutes a cross heading in Section D of the Existing Members Order to clarify that the scope of that particular Section concerns provisions about refund of contributions, deferred pensions and transfer value payments.

Article 3 substitutes Article 44(1) of the Existing Members Order the effect of which is to enable a teacher to receive a refund of his or her contributions instead of the payment of any benefits under Part 3 of that Order.

Article 4 inserts new Article 44A and Article 44B into the Existing Members Order. Article 44A entitles a teacher, who has ceased employment for the purposes of the Teachers' Superannuation Scheme (the "Scheme"), to payment of a deferred pension on attaining the age of 60 provided he or she has not applied for a refund of contributions or a transfer value payment. Article 44B entitles a teacher, who has ceased employment for the purposes of the Scheme, to a transfer value payment provided he or she has not applied for a refund of contributions or payment of a deferred pension.

Part 2 of this Order amends the Teachers' Superannuation (New Members) (Jersey) Order 2007 (the "New Members Order" as defined by Article 5).

Article 6 substitutes a cross heading in Part 4 of New Members Order analogous with the amendment made by Article 2.

Articles 7, 8 and 9 respectively amend Articles 20 to 22 of the New Members Order. The effect of the amendments is to remove the current 2 year qualifying period before a member of the Scheme is entitled to a deferred pension, and to enable a member to take a deferred pension, transfer value payment or refund of contributions instead of the payment of a pension under any of Articles 15 to 17 of that Order.

Article 10 provides for the title by which this Order may be cited and for its coming into force 7 days after it is made.

The Order was made on 26th January 2018 and came into force on 2nd February 2018.

EU Legislation (Sanctions – Somalia) (Amendment) (Jersey) Order 2018.

Article 1 of this Order amends the EU Legislation (Sanctions – Somalia) (Jersey) Order 2014 so as to give effect in Jersey to Council Regulation (EU) 2017/2415 of 21 December 2017 (OJ L 343/33, 22.12.2017) amending Regulation (EU) No 356/2010 imposing certain specific restrictive measures directed against certain natural or legal persons, entities or bodies, in view of the situation in Somalia. The effect of the amendment is to permit the making available of funds or economic resources necessary to ensure the timely delivery of urgently needed humanitarian assistance in Somalia by the United Nations, its specialised agencies or programmes, humanitarian organisations having observer status with the United Nations General Assembly that provide humanitarian assistance, and their implementing partner NGOs participating in the United Nations Humanitarian Response Plan for Somalia.

Article 2 gives the title by which this Order may be cited and provides for it to come into force on the day after it is made.

The Order was made on 2nd February 2018 and came into force on 3rd February 2018.
