Control of Housing and Work (Exemptions) (Amendment No. 2) (Jersey) Order 2018.

This Order amends the Control of Housing and Work (Exemptions) (Jersey) Order 2013 (the "principal Order" as defined in Article 1) in respect of the number of Registered persons who may be disregarded by an undertaking for the purpose of complying with the undertaking's business licence. Under Article 27(1) of the Control of Housing and Work (Jersey) Law 2012 (the "Law"), the maximum number of Registered or Licensed persons who can be employed by an undertaking is specified as a condition of the undertaking's business licence. Article 27(3) of the Law allows the Minister to prescribe descriptions of individual who may be disregarded for the purpose of complying with this condition. The principal Order prescribes several descriptions of individual who may be disregarded for this purpose.

Article 2 amends Article 1 of the principal Order so as to insert some new definitions including a definition of "registrable occupation" for the purposes of Article 4(4)(a) of, and the new Schedule to, the principal Order.

Article 3 amends Article 4 of the principal Order so as to add a further description of individual who may be disregarded and applies in respect of any Registered person who has been ordinarily and continuously resident in Jersey for less than 5 years and is the cohabiting partner of a person with Entitled, Licensed or Entitled for Work Only status. "Cohabiting partner" is defined as a person whom the Minister is satisfied fulfils certain conditions set out in Article 4(4) – essentially the Registered person must have been living with the person with Entitled, Licensed or Entitled for Work Only status ("ELP"), as if they were married to, or in a civil partnership with, each other, for a period of at least 3 months as at the date the ELP received an offer of full-time employment in a registrable occupation specified in the Schedule.

Article 4 adds a new Schedule to the principal Order. That Schedule lists certain occupations which are registrable under the Health Care (Registration) (Jersey) Law 1995 (the "Health Care Law") which, for the purposes of Article 4(4)(a) of the principal Order, means a registered midwife, nurse or social worker (which are also registrable occupations listed in the Schedule to the Health Care Law).

Article 5 provides for the title by which this Order may be cited and for it to come into force 7 days after it is made.

The Order was made on 15th January 2018 and came into force on 22nd January 2018.

Road Traffic ( St. Lawrence ) (Amendment No. 25) (Jersey) Order 2018.

This Order amends the Road Traffic ( St. Lawrence ) (Jersey) Order 1990 (the "principal Order") to prohibit waiting on a section of La Grande Route de St. Laurent and La Rue de la Blanche Pierre; to apply a maximum waiting period of 12 hours in any continuous period of 24 hours on 2 sections on the western side of La Route de St. Jean; and to introduce a 20 minute disk parking every day on a section of La Grande Route de St. Laurent by the St. Laurent public house.

The Order was made on 22nd January 2018 and came into force on 29th January 2018.

"What measures, if any, does the Minister have under consideration as part of her review of the Social Security system to make it less regressive and, in particular, to address the following aspects of the current system –

  2. the fact that contribution rates are based solely on earned income and do not, for instance, take into account earnings from investment income?"
