Cycle Tracks (Amendment No. 4) (Jersey) Order 2019.

This Order amends the Cycle Tracks (Jersey) Order 2000 to add new sections of shared pedal cycle/pedestrian cycle track in St. Helier along the La Route de la Libération and opposite Commercial Buildings; along St. Peter 's Valley, and to the west of Grouville Common. This Order comes into force 7 days after the day it is made.

The Order was made on 23rd September 2019 and came into force on 30th September 2019.

Police Procedures and Criminal Evidence (Codes of Practice) (Amendment No. 4) (Jersey) Order 2019.

This Order amends the Police Procedures and Criminal Evidence (Codes of Practice) (Jersey) Order 2004 (the "Codes of Practice Order") the purpose of which is to give effect to the operation of revised Code C in the Schedule to the Codes of Practice Order, to enable records to be made in electronic form. Code C is the code of practice for the detention, treatment and questioning of persons by police officers.

In accordance with Article 62 of the Police Procedures and Criminal Evidence (Jersey) Law 2003, the Minister for Home Affairs published a draft of revised Code C on 1st July 2019.

Article 1 is an interpretation provision.

Article 2 is a corrective amendment to the preamble of the Codes of Practice Order.

Article 3 amends Code C the effect of which is that where any provision in that Code or any other Code requires the making of a record in a pocket book, that record may be made on an electronic device instead.

Article 4 provides for the title by which this Order may be cited and for it to come into force 7 days after it is made.

The Order was made on 23rd September 2019 and came into force on 30th September 2019.

Economic Development, Tourism, Sport and Culture (2020 Fees) (Jersey) Order 2019.

The Economic Development, Tourism, Sport and Culture (2020 Fees) (Jersey) Order 2019 will increase the fees charged under 3 regimes administered by the Minister for Economic Development, Tourism, Sport and Culture by approximately 2%.

Article 1 amends the Places of Refreshment (Registration) (Fees) (Jersey) Order 2008 to increase the fee for an application for registration, or the renewal of registration, of premises as a place of refreshment under Article 4(1) of the Places of Refreshment (Jersey) Law 1967. That fee was last increased with effect from 1st January 2019.

Article 2 amends the Tourism (General Provisions) (Jersey) Order 1990 to increase the fees for registrations or renewals under Article 9(1) of the Tourism (Jersey) Law 1948. Those fees were last increased with effect from 26th October 2018.

Article 3 amends the Weights and Measures (Testing Fees) (Jersey) Order 2003 to increase the fees for testing weighing or measuring equipment under Article 12 of the Weights and Measures (Jersey) Law 1967. Those fees were last increased with effect from 1st January 2019.

Article 4 gives the title of this Order and states when the provisions come into force. Article 2 comes into force 7 days after the making of this Order and the remainder of this Order comes into force on 1st January 2020.

The Order was made on 25th September 2019 and comes into force in accordance with Article 4.

Service of Process Rules 2019.

These Rules are made under the Service of Process and Taking of Evidence (Jersey) Law 1960 which enables Rules of Court to be made, among other things, regarding –

  1. service outside Jersey of civil process of a Jersey court; and
  2. service in Jersey of civil process of a court or tribunal of a foreign country.

These Rules repeal and replace the Service of Process Rules 1994 ("the 1994 Rules"), which have governed these matters for the last 25 years.

Part 1 of these Rules (Rules 1 – 15) make provision concerning service of Jersey process outside Jersey – Rule 1 sets out the scope of Part 1, and makes clear that it does not apply to matrimonial proceedings.

Rule 2 contains definitions. References to "the Court" are to the Royal Court, and include the Judicial Greffier.

Rule 3 and the Schedule set out grounds for obtaining permission to serve proceedings outside Jersey (in place of the grounds set out in Rule 7 of the 1994 Rules). Rule 3 also provides that, where contracting parties have agreed that a Summons can be served in or out of the jurisdiction in a particular manner, service in that manner shall be good and effective service wherever the person to be served is resident.

Rule 4 sets out how applications to the Court for permission must be made. Rule 5 concerns service of particulars of a claim.

Rule 6 enables a person served who is not a party to the proceedings to apply to the Court to dispute the jurisdiction.

Rule 7 deals with the method of service on a party out of the jurisdiction. Service must be effected by whatever method the Court directs, if the Court gives such a direction. Otherwise service may be effected in one of the ways set out later in the Rules; or by any method permitted by a civil procedure convention or treaty; or by any other method permitted by the law of the relevant country.

Rule 8 sets out how to serve proceedings in a country under an international convention or treaty. The Summons has to be served –

through the authority designated under the relevant convention or treaty, or

if permitted by the law of the country concerned –

through its judicial authorities, or

through the British Consular authority there.

Rule 8 also sets out how to serve proceedings in a country where there is no is no international convention or treaty. The Summons may be served, if permitted by the law of the country concerned –

through its government (where that government is willing to serve it), or

through a British Consular authority in the country.

Rule 9 (read with Rule 8) sets out how duties of the Bailiff and the Judicial Greffier in forwarding the certified documentation to –

the authority designated under the relevant international convention or treaty; or

the Foreign and Commonwealth Office ("FCO"),

so that the necessary arrangements can be made for effecting service in the country concerned. Rule 10 provides that where a party wishes to serve proceedings in any country where  there is no international convention or treaty, the Summons or other document may be served through an ordinary process server, if legally permissible in that country. This Rule also provides, in relation to –

the United Kingdom,

Guernsey or the Isle of Man

an Overseas Territory

Commonwealth States where the Hague Convention[1] does not apply),

that the party or the party's agent must effect service either directly or by another method directed by the Court.

Rule 11 sets out the procedure to for serving proceedings the summons or other document on a State.[2]

Rule 12 requires copies summonses or other documents to be accompanied by a translations, as necessary. This does not apply however where English is the official language of the relevant country, or where service is being effected on a British citizen.

Rule 13 requires undertakings to be given by applicants in appropriate circumstances to be responsible for, and to pay, all expenses incurred by FCO or the foreign judicial authority.

Rule 14 enables the Court to make orders for substituted service, as necessary, to give effect to the Rules.

Under Rule 15 a plaintiff may not obtain judgment against a defendant until the plaintiff files written evidence that the Summons has been duly served in accordance with the Rules.

Part 2 of these Rules (Rules 16 – 23) makes provision concerning service of Documents in Jersey from courts outside Jersey.

Rule 16 concerns the scope of Part 2 (i.e. it applies to the service in Jersey of any document in connection with civil or commercial proceedings in a foreign court or tribunal).

Rule 17 defines "convention country" and "foreign court or tribunal".

Rule 18 concerns letters of request. The Viscount will serve a document under the Rules upon receipt from the Attorney General of a written request for service that has been forwarded by –

a consular or other authority of the country (in the case of a convention country),

FCO in other cases.

The request must be accompanied by a translation of the request into English.

Rule 19 relates to other forms of request. The Viscount –

may serve a document upon receipt of a written request other than a request referred to in Rule 18; and

may require translations.

Rule 20 provides that the Viscount will serve documents by personal service in accordance; but if the request specifies a different method of service, the Viscount may use that method as well as or instead of personal service.

Rule 21 sets out the procedures to be followed by the Viscount when it has not been possible to serve a document. It also makes provision about specifying the costs incurred attempting to serve documents.

Under Rule 22, where the Viscount has served a document, he or she will return a copy together with a record certifying when and how service was effected. The document is returned to the Attorney General or to the person who lodged the request, if it was not the Attorney General.

The Attorney General can request the Viscount to specify the costs incurred in serving the document.

Rule 23 provides, in relation to letters of request (under Rule 18) that the Attorney General will send a certificate to the person who requested service, stating –

when and how the document was served or

the reason why it was not served.

The certificate will also state any costs involved, and be accompanied by the relevant document, or a copy of it.

Part 3 consists of Rules 24 and 25

Rule 24 revokes the 1994 Rules.

Rule 25 is the usual citation and commencement provision.

These Rules were made by the Superior Number of the Royal Court on 26th September 2019 and come into force on 28th October 2019.

Taking of Evidence Rules 2019.

1 Part 2 of the Service of Process and Taking of Evidence (Jersey) Law 1960 ("the 1960 Law") makes

provision about taking evidence, in Jersey, in civil matters that are before courts or tribunals outside Jersey. Applications may be made to the Royal Court for such evidence to be obtained in Jersey.

2 Article 11(b) of the 1960 Law enables Rules of Court to be made for the purposes of such

applications and for regulating the relevant procedures. These Rules are made under Article 11(b). 3 The Rules make provision as follows –

  1. Rule 1 concerns interpretation;
  2. Under Rule 2, applications must be supported by affidavit and may be made without notice;
  3. Rule 3 enables the Attorney General to make an application in certain circumstances;
  4. Rule 4 relates to who may take the examination (normally the Viscount) and how;
  5. Rule 5 makes provision for enforcing attendance of witnesses;
  6. Rule 6 is concerned with the payment of fees and expenses of the examiner;
  7. Rule 7 relates to the lodging of the eventual deposition, and the Judicial Greffier's certificate under seal concerning the evidence taken;
  8. Rule 8 makes provision about claims to privilege;
  9. Rule 9 is the citation and commencement provision.

Royal Court (Amendment No. 24) Rules 2019.

These Rules amends the Royal Court Rules 2004 ("the principal Rules") in the following respects –

Part 15 of the principal Rules relates to the procedure on appeals to the Court from administrative decisions. A new Rule 15/6 is inserted to make it clear that Rule 6/31 of the principal Rules applies to the discontinuance or withdrawal of an appeal for the purposes of Part 15 as it applies to the discontinuance or withdrawal of an action for the purposes of Part 6, which governs procedure and pleading generally. (See Rule 2 of these Rules.)

Part 15B of the principal Rules relates to appeals to the Court from the Jersey Employment and Discrimination Tribunal. Rule 15B is amended to make it clear that that it applies where –

  1. the Tribunal has granted leave to appeal; or
  2. the Bailiff has granted leave to appeal,

and that the appeal must be brought within 14 days of the date on which leave was granted. (See Rule 3 of these Rules.)

Under Rule 17/3(1)(g) of the principal Rules an application to the Royal Court for an order for evidence to be obtained in Jersey, in relation to overseas civil proceedings, is able to be heard by the Judicial Greffier in chambers. An equivalent enabling provision is now made in the Taking of Evidence Rules 2019 (made by the Superior Number at the same time as these Rules). Rule 17/3(1)(g) is therefore revoked. (See Rule 4 of these Rules.)

Royal Court (Amendment No. 25) Rules 2019.

Introductory

The Chief Minister notified the Assembly of his intention to make an Order under Article 29A of the States of Jersey Law 2005, transferring responsibilities and functions from the Minister for Health and Social Services to the Minister for Children and Housing. Pursuant to the draft States of Jersey (Transfer of Responsibilities and Functions) (Health and Social Services to Children and Housing) Order 201- (the "Transfer Order") the Minister for Children and Housing will henceforth be responsible for various legislative responsibilities and functions that relate to children.

The rights enjoyed and liabilities incurred by the Minister for Health and Social Services in connection with the responsibilities and functions transferred are also being transferred to the Minister for Children and Housing by the Transfer Order.

These Rules will amend several rules of court made by the Superior Number of the Royal Court to ensure that they reflect the new division of responsibilities between Ministers and the transfer of rights and liabilities between them.

Rule 1 (References to Minister for Health and Social Services substituted)

Sets out the specific references to the Minister for Health and Social Services that are substituted in particular rules made by the Royal Court.

Rule 2 (Transitional provisions)

Provides that the substitutions effected by Rule 1 shall not prejudice the validity of anything that was done by the Minister for Health and Social Services; and that in all proceedings currently before the Court such things shall be treated as duly done by the Minister for Children and Housing, who will also be substituted for the former as a party to any relevant proceedings.

Rule 3 (Citation and commencement)

This is the usual citation provision. The proposed commencement date of 9th October 2019 has been aligned with the expected commencement of the Transfer Order.

The Rules were made on 26th September 2019 and come into force on 9th October 2019.

Animal Health (Miscellaneous Exotic Diseases) (Amendment) (Jersey) Order 2019.

This Order amends the Animal Health (Miscellaneous Exotic Diseases) (Jersey) Order 2017 so as to

  1. add Psittacosis (otherwise known as Ornithosis), Rinderpest virus, Teschen disease and Trichinellosis and their susceptible animals to the schedule of diseases to which the Order applies (Article 3);
  2. apply the power to kill animals to Rinderpest virus and Trichinellosis (Article 2);
  1. add Rinderpest virus and Trichinellosis to the list of diseases to which additional measures set out in Schedule 3 to the Order apply (Article 4).

The Order was made on 30th September 2019 and comes into force on 10th October 2019.

Animal Health (Surveillance) (Amendment) (Jersey) Order 2019.

This Order amends the Animal Health (Surveillance) (Jersey) Order 2017 so as to require the keeper of a bovine animal to report information concerning any early abortions to the Minister for the Environment.

The Order was made on 30th September 2019 and comes into force on 10th October 2019.

Artificial Insemination of Domestic Animals (Bovine Semen) (Amendment No. 3) (Jersey) Order 2019.

This Order imposes a requirement to have a licence from the Minister for the Environment in order to import bovine semen from another British Island.

The Order was made on 30th September 2019 and comes into force on 10th October 2019.

Animal Health (Amendment of Law) (Jersey) Order 2019.

This Order amends the Animal Health (Jersey) Law 2016 ("the Law") by –

  1. adding Psittacosis (otherwise known as Ornithosis), Rinderpest virus, Teschen disease and Trichinellosis to the diseases covered by the Law; and
  2. adding Psittacosis (otherwise known as Ornithosis) to the list of specified pathogens under the Law.

The Order was made on 30th September 2019 and comes into force on 10th October 2019.

Aquatic Resources (Seaweed Licence Fees) (Jersey) Order 2019.

This Order prescribes a fee of £91.50 for a licence to harvest seaweed by hand for commercial purposes. This Order comes into force on the day after the day it is made.
