Long-Term Care Services (Health and Social Services Charges) (Amendment No. 7) (Jersey) Order 2019.

This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014, to increase by approximately 2.6% the charges payable, from 1st January 2020, for the provision of long-term care services to persons aged 18 years or over in a care home or group home.

The Order was made on 9th December 2019 and comes into force on 1st January 2020.

Sanctions and Asset-Freezing (General Provisions) (Jersey) Order 2019.

This Order repeals and replaces the EU Legislation (Sanctions) (General Provisions) (Jersey) Order 2014, adapting its provisions to the Sanctions and Asset-Freezing (Jersey) Law 2019 (the "Law"). It also preserves the information provisions of the repealed Order, to apply to Orders that are preserved by Article 48 of the Law.

It applies the general provisions to all Orders made under Article 3(1) of the Law (and to Orders preserved by Article 48), unless those Orders provide otherwise. It also provides that references in the Law to compliance, evasion, offences and functions apply in relation to the implemented EU sanctions provisions as they do in relation to the Law and to Orders under the Law.

The Order was made on 11th December 2019 and came into force on 12th December 2019.

Sanctions and Asset-Freezing (Turkey) (Jersey) Order 2019.

This Order implements Council Regulation (EU) 2019/1890 of 11 November 2019 concerning restrictive measures in view of Turkey's unauthorised drilling activities in the Eastern Mediterranean (OJ L 291, 12.11.2019, p. 3). That Regulation imposes an asset-freeze, which will apply to persons to be listed in its Annex I (none are listed so far). The Order imposes the asset-freeze provisions in Part 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019, by designating any person listed by the Regulation. It applies the derogations in the Regulation for the purpose of granting licences under that Law. It also applies the provisions of the Regulations that limit the liability of those taking action under it. The general provisions in the Sanctions and Asset-Freezing (General Provisions) (Jersey) Order 2019 are to be read as part of this Order.

The Order was made on 11th December 2019 and came into force on 12th December 2019.

That Regulation imposes an asset-freeze, which will apply to persons to be listed in its Annex I (none are listed so far). The Order imposes the asset-freeze provisions in Part 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019, by designating any person listed by the Regulation. It applies the derogations in the Regulation for the purpose of granting licences under that Law. It also applies the provisions of the Regulations that limit the liability of those taking action under it. Infrastructure (Driver and Vehicle Standards – 2020 Fees) (Jersey) Order 2019.

This Order increases certain fees charged by Driver and Vehicle Standards from 1st January 2020 by an average of 2.5% (the fee increases being rounded to the nearest pound).

The Order was made on 13th December 2019 and came into force on 1st January 2020.

Charities (Additional Information) (Amendment) (Jersey) Order 2019.

This Order amends the Charities (Additional Information) (Jersey) Order 2018 to add a requirement that an annual return must include a narrative statement of the manner in which the charity claims to have complied (or failed to comply) with its duty (its "public benefit duty") to provide public benefit in accordance with its registered public benefit statement in the year concerned.

The Order also makes further provision as to what must be entered on the register of charities in relation to the annual return (the annual return itself is not entered on the register).

The Commissioner must enter on the register a narrative statement as to the charity's compliance with its public benefit duty in the year to which the annual return relates (or to which it should relate, if late). If the charity included a statement in its annual return, and the Commissioner approves the statement, then that statement can be entered on the register. If the annual return is not submitted (in time or at all), or the Commissioner does not approve the charity's statement (or, for any other reason, decides not to enter it in the form in which the charity submitted it), then the Commissioner can produce a version of the statement setting out how it appears to the Commissioner that the charity has (or has not) complied with its public benefit duty. The Commissioner must enter the statement (as approved or produced by the Commissioner) on the register within 4 months after the end of the year concerned (amounting to a further 2 months after the annual return is due).

If the charity's last annual return was not received within the time allowed (which is 2 months from the end of the year concerned), then the register must also include a note that it was late.

The Order was made on 16th December 2019 and came into force on 23rd December 2019.

Charities (Timing of Annual Return) (Jersey) Order 2019.

This Order provides that an annual return from a charity, registered under the Charities (Jersey) Law 2014, must relate to a year ending on the anniversary of the charity's registration (or on another date agreed, within the first year of registration, with the Charity Commissioner). The annual report must be sent, and received, within 2 months after the end of the year to which it relates.

The Order was made on 16th December 2019 and came into force on 23rd December 2019.

Poisons (Removal of Cannabis from List) (Jersey) Order 2019.

The Poisons (Removal of Cannabis from List) (Jersey) Order 2019 amends the Poisons (General Provisions) (Jersey) Order 1968 and the Poisons List (Jersey) Order 1986 to remove references to cannabis.

The Order was made on 17th December 2019 and came into force on 18th December 2019.

Nursing Homes (2020 Fees) (Jersey) Order 2019.

This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995 to increase the registration and annual fees set out in that Order by 2.5% in line with inflation. Those fees were last increased with effect from 1st December 2017.

The Order was made on 18th December 2019 and came into force on 1st January 2020.

Regulation of Care (Fees) (Amendment) (Jersey) Order 2019.

This Order makes provision for the fees set out in the Regulation of Care (Fees) (Jersey) Order 2018 to increase by 2.5%, in line inflation, with the exception of the £50 fee in Article 2 (annual fees) charged to individuals directly employed by the care receiver, which remains at £50.

The Order also deletes paragraph (3) of Article 2, which provided for transitional arrangements only required for 2019.

The Order was made on 18th December 2019 and came into force on 1st January 2020.

Road Works (Permit Fees) (Jersey) Order 2019.

This Order sets out fees for permits to carry out road works under the Road Works and Events (Jersey) Law 2016 and repeals the Road Works (Permit Fees) (Jersey) Order 2018.

Article 1 is an interpretation provision.

Article 2 specifies 2 sets of fees depending on whether the road works authorised by the permit for which an application is made include the use of fixed scaffolding in or on a road. The amount of the fee is also dependent on the length of time that the road works take or, where applicable, the fixed scaffolding in or on a road is in place and on the extent to which the road works impact on normal traffic movement. For the purpose of determining the fee, the length of time that road works take is determined by the date on which notice is given of completion of road works. Under the current Order, the fee is determined by the expected length of time that the road works are likely to take and the expected impact that they will have on normal traffic use. Under the new Order, as under the current Order, additional fees are added to the permit fee if the road works involve breaking up the road and if the relevant highway authority incurs additional costs administering a system for monitoring the placement, use and removal of scaffolding. The specified fees are each increased by 2.5%.

Article 2 also makes a new provision setting out the fees payable if an application is cancelled.

Article 3 specifies a fixed fee of £35.88 for an application to vary a permit, an increase of 2.51%. Article 4 repeals the Road Works (Permit Fees) (Jersey) Order 2018.

Article 5 sets out the title of the Order and provides for its commencement.

The Order was made on 19th December 2019 and came into force on 1st January 2020.

Social Security (Contributions) (Amendment No. 16) (Jersey) Order 2019.

The Order amends the Social Security (Contributions) (Jersey) Order 1975 to amend the basis on which the amount of full rate Class 2 contributions payable is calculated for any such contributions which are paid more than 12 months after they fall due.

The Order brings the calculation into line with that used for calculating late payments of reduced rate Class 2 contributions. The contribution payable increases by the same proportion as any increase in the standard monthly earnings limit.

The Order was made on 20th December 2019 and came into force on 1st January 2020.

R&O.150/2019.

Road Traffic ( St. Helier ) (Amendment No. 35) (Jersey) Order 2019.

This Order makes provision for designated parking bays in the parish of St. Helier for electric vehicles made available for use by a car club to its members.

Article 1 defines "principal Order" as the Road Traffic ( St. Helier ) (Jersey) Order 1996.

Article 2 inserts in the principal Order a new Article 27B which allows the Connétable of St. Helier or the Minister for Infrastructure ("issuing body") to grant permits to a car club for the parking of electric vehicles in roads specified in a new Part 15 in Schedule 8 ("designated area"). The fee payable for a permit for 12 months is £824. There is no restriction on the length of time an electric vehicle may remain parked in the designated area. "Electric vehicle" is defined to mean a vehicle powered solely by an electric motor.

Article 3 deletes 4 parking bays which are currently designated in Halkett Place and The Parade subject to a one hour limit and specifies them as the designated area in the new Part 15 in Schedule 8.

Article 4 provides for the Order to come into force 7 days after the day it is made.

The Order was made on 23rd December 2019 and came into force on 30th December 2019.

Environment (2020 Fees) (Jersey) Order 2019.

This Order increases, with effect from 1st January 2020, fees charged under the legislation relating to animals and veterinary matters (other than the fees payable under the Endangered Species (CITES) (Jersey) Order 2012), planning, plant health, sea fisheries, waste management and water resources. The fees have been increased from a year ago by 2.5% (subject to some rounding down).

The Order was made on 31st December 2019 and came into force on 1st January 2020.
