Planning and Building (Covid-19 Bridging Island Plan) (Jersey) Order 2021. Minister for the Environment.
This Order is made under the enabling powers recently introduced into the Planning and Building (Jersey) Law 2002 (the "Law") by the Covid-19 (Island Plan) (Jersey) Regulations 2021, to provide for the procedures (in particular, the examination in public) relating to the introduction of a relatively short-term, bridging Island Plan in the circumstances created by the Covid-19 emergency and its aftermath.
By Article 2 (application) it is made clear that this Order does not affect the continued existence and application of the Planning and Building (Island Plan) (Jersey) Order 2009, which remains in effect in relation to all other Island Plans. However, many of the provisions of this Order resemble those in the 2009 Order, but with necessary modifications – for example, as to meetings and hearings taking place online – to accommodate the holding of an examination in public in the current exceptional circumstances.
Article 1 is the interpretation provision.
Article 3 defines what is meant by a requirement in the Order to "announce and publish" a document, information or matter.
Article 4 sets out some general requirements as to how representations in relation to the draft bridging plan may be made – both by Members of the States Assembly (who may do so by lodging amendments, in accordance with Article 4A of the Law, as well as in their capacity as private individuals), and by members of the public. This Article also enables the Minister or the inspector conducting the examination in public to invite a person who has submitted an initial representation to provide further information or background material.
Article 5 sets out the Minister's obligations relating to lodging of the draft bridging plan, and publicising the consultation on that plan and the examination in public, including an obligation to invite initial representations on the draft bridging plan both from Members of the Assembly acting as such, and from members of the public at large.
Article 6 deals with the form and manner in which initial representations are to be made, and in particular sets out the requirements which representations made by members of the public must fulfil.
Article 7 deals with the appointment by the Minister of an inspector to conduct the examination in public relating to the draft bridging plan. This Article also specifies the qualifications for inspectors, and provides that the Minister must set their terms of reference.
Article 8 sets out the general functions of an inspector and confers a discretion as to the manner in which an inspector may conduct the examination in public.
Article 9 contains requirements as to preliminary matters which must be fulfilled before the examination in public begins. The inspector must publish a draft list of the matters to be considered in the examination in public, and may hold a programme meeting (including a meeting which is wholly or partly online) to discuss the draft list and the timetable, but is not obliged to do so. If no programme meeting is held the inspector must make clear how the public may make submissions as to the draft list and the timetable. Once the timetable has been set the inspector must announce and publish it, together with details as to how further representations may be submitted.
Article 10 deals with the form and manner of such further representations, which may again be made both by Members and by members of the public and must be relevant and concise as specified by this Article.
Articles 11 to 15 deal with the inspector's powers to conduct the examination in public.
Under Article 11, the inspector may arrange informal resolution meetings between the Minister and other persons, at which the inspector is not present, for the purpose of resolving or clarifying disagreements; and may hold administrative meetings, technical seminars and site visits, for the purposes and in the manner set out in the Article.
Article 12 empowers the inspector to hold thematic hearings on matters relevant to the examination in public, to which the Minister (in person or by officers) must be invited, together with others whose contribution appears to the inspector to be useful.
Article 13 requires the inspector to hold at least one plenary hearing (and if more than one hearing is held the final hearing of the examination in public must be a plenary hearing). Article 14 provides for the manner of conduct of hearings generally, and that they must be held in public (including by being held wholly or partly online). However under Article 15 the inspector may exclude, from a hearing or a meeting, any person behaving in a disruptive manner.
Article 16 imposes the requirement for an inspector to prepare a written report of the examination in public for submission to the Minister, and sets out the criteria which the report must fulfil.
Article 17 confers power on the Minister to re-open the examination in public if material considerations arise which are not mentioned or are insufficiently considered in the report or if the report contains technical information which is materially incorrect.
Article 18 places obligations on the Minister to announce and publish the report and to present it to the States. Having done so, the Minister may under this Article lodge amendments to the draft bridging plan. The Article also permits other Members to lodge final amendments, or amendments to amendments, provided that these relate to substantive issues which have already been considered (and provided also that, in accordance with Article 4(1)(a) and (2), they are lodged in compliance with the time limits in Article 4A of the Law).
Article 19 gives the title by which this Order may be cited and provides for it to come into force on the day after it is made.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 4) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the "Workplaces Order") and the Covid-19 (Gathering Control) (Jersey) Order 2020 (the "Gatherings Order") to relax the numbers allowed for certain gatherings whilst imposing additional requirements on those gatherings where they take place in workplaces.
Article 1 provides that Articles 2 to 8 amend the Workplaces Order.
Article 2 inserts a new definition of "ritual gathering" to include marriage and civil partnership ceremonies, funerals and services of religious worship and makes a minor amendment to an existing term.
Article 3 imposes a restriction on the opening of a workplace in an outdoor area being used by adults for sport or exercise, to limit the numbers involved to 45 and to impose requirements on the occupier or operator to take certain steps to assist in controlling the spread of Covid-19. It also extends the limitation on the opening of visitor attractions where they are closed by another provision of the Workplaces Order to include outdoor areas.
Articles 4 to 7 extend the requirements to wear masks by visitors and workers, to give details for contact tracing and to observe 2 metre distancing to indoor workplaces used for ritual gatherings of more than 45 participants.
Article 8 substitutes a new Article 5D that provides that no requirement of Article 5, 5B or 5C applies in respect of gatherings of children that are exempted from the restrictions on gathering imposed by the Gatherings Order, except that in the case of a children's activity group the exception does not apply if more than 10 people are participating in the gathering.
Article 9 amends the Gatherings Order to extend the exception to limiting gatherings in a workplace to 10 to include workplaces in outdoor areas and ritual gatherings. Articles 7 (which provided an exception to the gathering limits for ritual gatherings) and 8A (which include an exception for gatherings of adults for sport or exercise) are deleted because revised provision is made elsewhere by these amendments. The provision limiting numbers in relation to gatherings of children's activity groups in Article 8 is also removed because of the provision in substituted Article 5D of the Workplaces Order set out above. It is further provided that 45 people are also allowed to be part of a controlled gathering of children in the open air. Definitions previously in deleted Article 7 are relocated into Article 8.
Article 10 contains the citation provision and provides for the Order to come into force on 26th March 2021.

Social Security (Contributions) (Covid19) (Amendment No. 3) (Jersey) Order 2021. Minister for Social Security.
The Social Security (Contributions) (Covid-19) (Amendment No. 3) (Jersey) Order 2021 amends the Social Security (Contributions) (Covid-19) (Jersey) Order 2020 (the "principal Order").
Article 1 is an interpretation provision.
Article 2 amends Article 1 of the principal Order, to define Quarter A 2021 as the period of 3 months beginning 1st January 2021 and to delete the definition "Department" – all references to "Department" throughout the Order are replaced with "Minister".
Article 3 amends Article 2 of the principal Order, to provide that an employer required to make a Class 1 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months.
Article 4 amends Article 3 of the principal Order, to provide that an insured person required to pay a Class 2 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months.
Article 5 amends Article 4 of the principal Order, to clarify that recovery of a relevant benefit may be made for any relevant benefit paid which is based on a quarter deferred under Article 3 of the principal Order, and that the Minister may seek to recover survivor's benefit from the survivor of a person who makes a deferral under that Article 3.
Article 6 gives the citation and provides that the Order comes into force on 30th March 2021. The Order was made on 26th March 2021 and came into force on 30th March 2021.

This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Friday 30th April 2021.

Covid-19 (Workplace Restrictions) (Amendment No. 10) (Jersey) Order 2021. Minister for Health and Social Services.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 in relation to food and drink premises, but only in relation to consumption on the premises.
The Order extends to 11 p.m. (from 10 p.m.) the time until which the food or drink may be ordered, and to 11.30 p.m. (from 10.30 p.m.) the time by which the food or drink must be consumed (this does not extend any opening times otherwise imposed under the legislation on alcohol licensing or by any other law). It removes the requirement for customers to be seated at a table while ordering or paying for the food or drink (but retains the seating requirement while consuming the food or drink, and retains the separate limit of 10 customers per table). It removes the requirement for alcoholic drinks to be ordered with a meal. Lastly it broadens the exception from wearing a mask, so that the customer can remove the mask for all of the time spent sitting at the table at which the food or drink is to be consumed (currently the mask can be removed only while actually consuming the food or drink).
The Order was made on 31st March 2021 and came into force on 2nd April 2021.

Control of Housing and Work (Fees) (Amendment No. 3) (Jersey) Order 2021. Chief Minister.
The Control of Housing and Work (Fees) (Amendment No. 3) (Jersey) Order 2021 amends the definition of "employment agencies", so that the definition includes businesses which supply persons employed by that business to work for any other business (commonly referred to as "temp agencies").
The definition of "employment agency" previously covered this type of business only if the persons supplied to other businesses acted as office staff or domestic staff, and did not cover any other type of work.
The Order was made on 1st April 2021 and came into force on 8th April 2021.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 5) (Jersey) Order 2021. Minister for Health and Social Services.
This Order further relaxes the restrictions imposed by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the "Workplaces Order") and the Covid-19 (Gathering Control) (Jersey) Order 2020 (the "Gatherings Order").
Article 1 provides that Articles 2 to 11 amend the Workplaces Order.
Article 2 contains 2 definitions which are now used more widely in the Order to the definitions Article at the beginning of the Workplaces Order. The definition of "indoor area" has been reworded for clarification purposes.
Article 3 substitutes Article 2 of the Workplaces Order so that the only workplaces that are completely closed are Jacuzzis, plunge pools, steam rooms, saunas, Turkish baths, and the like.
Article 4 removes the restrictions on opening in Article 3 of the Workplaces Order in respect of all sports facilities and visitor attractions and removes the restriction on more than 10 people sitting at a table in food and drink premises. Restrictions on opening of specific workplaces now apply only in relation to food and drink premises and nightclubs.
Article 5 substitutes Article 4 of the Workplaces Order to widen it to include a new restriction applicable to all workplaces to which a public or a section of the public have access. This requires the occupier or operator of the workplace to take all reasonable steps to assist in controlling the spread of Covid-19, including taking account of any relevant guidance.
Article 6 removes the requirement in Article 5 of the Workplaces Order for visitors to wear masks in residential care homes and limits mask-wearing to indoor areas in workplaces where it is currently required (except for close contact premises where it is still required outdoors). The requirement to wear masks for ritual gatherings now applies only when more than 50 are gathered as opposed to 45. There is now a requirement to wear masks in indoor areas of entertainment facilities.
Article 7 amends Article 5A of the Workplaces Order to make the same changes in mask-wearing requirements for workers in relation to ritual gatherings and entertainment facilities in the case of workers (though there is no restriction to indoors in the latter category).
Article 8 amends Article 5B of the Workplaces Order to make the same changes as made above in relation to ritual gatherings, entertainment facilities, in relation to contract-tracing requirements. The exception in relation to indoor physical activity facilities is removed (there is a more general exception for children in Article 5D of the Workplaces Order).
Article 9 deletes Article 5C of the Workplaces Order thus removing the legal requirements for social distancing.
Article 10 substitutes Article 5D of the Workplaces Order modifying the exceptions for certain gatherings of children in workplaces. Mask-wearing and contact-tracing requirements do not apply to (a) a gathering of up to 10 children for them to take part in an activity specially for the children, (b) a gathering of any number of children for education or day care or (c) a gathering for any number of children organised by the Jersey Youth Service.
Article 11 inserts Article 5E of the Workplaces Order creating an exception from the requirement to wear masks in the case of people present in workplaces for the purposes of acting, reciting, singing or playing a woodwind or brass instrument.
Article 12 provides that Articles 13 to 15 amend the Gatherings Order.
Article 13 amends Article 3 of the Gatherings Order to allow up to 20 people to gather in people's homes and for up to 50 people to gather in gardens etc. for a marriage or civil partnership ceremony.
Article 14 amends Article 4 of the Gatherings Order to allow gatherings of up to 20 people in the open air or unlimited numbers in the case of a "controlled gathering", which is defined by reference to a responsible person having to take steps on assist in controlling the spread of Covid-19.
Article 15 removes the restrictions in the Gatherings Order on gathering in certain workplaces, in other locations and the exception relating to certain gatherings of young people.
Article 16 provides for how the Order is to be cited and for it to come into force on 12th April 2021. The Order was made on 9th April 2021 and came into force on 12th April 2021.

Covid-19 (Safe Distancing – Suspension No. 2) (Jersey) Order 2021. Minister for Health and Social Services.
This Order is made under Regulation 6(4) of the Covid-19 (Safe Distancing) (Jersey) Regulations 2020, to suspend indefinitely the effect of Regulations 2(2) and 3(1) of those Regulations. The suspended provisions contain the only criminal offences in the Regulations, and the effect of the suspension is that there is no criminal sanction in respect of breaches of safe distancing under the Regulations. The suspension is for an indefinite period, so it lasts until this Order is repealed. But the Regulations themselves are due to expire at the end of 30th April 2021, although P.25/2021 has been lodged to propose extending that date to the end of 31st October 2021. The offences will fall away on the expiry date in any case, whenever that might be.
The offence provisions were previously suspended on 26th June 2020, by the Covid-19 (Safe Distancing – Suspension) (Jersey) Order 2020, and reinstated on 4th December 2020, by the Covid-19 (Safe Distancing – Exception and Revocation of Suspension) (Jersey) Order 2020.
This Order also repeals the Covid-19 (Safe Distancing – Exception and Revocation of Suspension) (Jersey) Order 2020, which added some exceptions to safe distancing. The repeal is because the exceptions given by that Order are not needed while the offences are suspended, and the repeal will make the statute book clearer.
The Order was made on 9th April 2021 and came into force on 12th April 2021.
