Bankruptcy (Désastre) (Amendment No. 3) (Jersey) Order 2023.

This Order amends Article 5 of the Bankruptcy (Désastre) (Jersey) Order 2006.

The amendments increase the prescribed maximum amounts payable under Article 32(1)(b)(i) and (ii) of the Bankruptcy (Désastre) (Jersey) Law 1990. The amounts are payable to an employee of a debtor in respect of an amount due to the employee at the date of the declaration en désastre in respect of arrears of –

wages or salary for services rendered to the debtor during the 6 months immediately preceding the declaration, and

holiday pay and bonuses.

These prescribed amounts were last increased in April 2018.

This Order comes into force 7 days after it is made.

The Order was made on 7th November 2023 and came into force on 14th November 2023.

This Order amends the Control of Housing and Work (Guidance on Temporary Absence and Significant Ownership) (Jersey) Order 2013.

The Chief Minister issued new guidance in October 2023 concerning the effect on a person's residential and employment status of any temporary absence from Jersey. It replaces guidance issued in May 2019. The amendments give effect to the new guidance starting on the day on which this Order comes into force, which is 7 days after the Order is made.

The Order was made on 9th November 2023 and came into force on 16th November 2023.

Long-Term Care (Benefits) (Amendment No. 12) (Jersey) Order 2023. Minister for Social Security.

This Order amends the Long-Term Care (Benefits) (Jersey) Order 2014 (the "2014 Order") to increase by approximately 7.7% –

the rates of long-term care benefit for weekly standard care costs (specified in Article 8 of the 2014 Order) (Article 2);

the amounts that a person must pay towards the weekly costs of living in an approved home and for incidental expenses (specified in Article 9 of the 2014 Order) (Article 3);

the amounts that a person must pay towards the person's standard care costs before the person qualifies to receive a long-term care benefit for standard care costs (specified in Article 10 of the 2014 Order) (Article 4);

the amount that may be loaned to a person to enable the person to pay the costs of living in an approved home (specified in Article 12 of the 2014 Order) (Article 5).

These rates and amounts were last increased with effect from 1st January 2023.

This Order comes into force on 1st January 2024.

Long-Term Care Services (Health and Social Services Charges) (Amendment No. 11) (Jersey) Order 2023. Minister for Health and Social Services.

This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014 to increase, by approximately 7.7%, the charges specified in that Order for care services provided in a care home or group home. These charges were last increased with effect from 1st January 2023.

The charges specified for each level of long-term care services have been calculated as follows:

rate for long-term care benefit for the equivalent level of standard care

+

amount that a person must pay towards the weekly costs of living in an approved home, excluding incidental expenses

The rate for long-term care benefit is prescribed in Article 8 of the Long-Term Care (Benefits) (Jersey) Order 2014 (the "Benefits Order"), and the amount that a person must pay towards the weekly costs of living in an approved home are prescribed in Article 9(c) of the Benefits Order, and both are to be increased for 2024.

This Order comes into force on 1st January 2024.

Home Affairs (Fire and Rescue and Petroleum – 2024 Fees) (Jersey) Order 2023. Minister for Justice and Home Affairs.

This Order increases the fees payable under the following Orders –

  1. the Fire Precautions (Fees) (Jersey) Order 2010, by between 2% and 2.3%;
  2. the Fire and Rescue Service (Charges) (Jersey) Order 2012, by between 1.9% and 2.4%; and
  3. the Petroleum (Licensing) (Fees) (Jersey) Order 2012, by between 2.2% and 2.5%.

These fees were last increased with effect from 1st January 2023.

This Order also amends the Fire Precautions (Fees) (Jersey) Order 2010 to provide for a minimum fee for an application for a fire certificate, and to clarify that the fee for a replacement fire certificate also applies to an application for renewal of a fire certificate. It makes minor clarificatory amendments to the Fire and Rescue Service (Charges) (Jersey) Order 2012, and makes minor amendments to apply current drafting practice to the Petroleum (Licensing) (Fees) (Jersey) Order 2012.

The Order was made on 16th November 2023 and comes into force on 1st January 2024.

This Order renames the Minister for Economic Development, Tourism, Sport and Culture as the Minister for Sustainable Economic Development, and makes amendments to legislation consequential on that renaming.

The Order comes into force 7 days after it is made.

The Order was made on 17th November 2023 and came into force on 24th November 2023.

Nursing Homes (2024 Fees) (Jersey) Order 2023. Chief Minister.

This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995. It comes into force on 1st January 2024.

The amendments increase by 2.5% –

the fee payable for an application for registration by a person carrying on, or intending to carry on, a nursing home;

the fee payable for an application for registration by another person who is, or is intended to be, in charge of a nursing home; and

the annual fee payable by a registered person.

The fees were last increased on 1st January 2023.

The Order was made on 20th November 2023 and comes into force on 1st January 2024.

Cremation (Fees – Amendment) (Jersey) Order 2023. Minister for Health and Social Services.

The Cremation (Fees – Amendment) (Jersey) Order 2023 amends the Cremation (Fees) (Jersey) Order 2007 to increase the fee for cremating the remains of a person aged 18 or over from £738.50 to £828, an increase of 12.1%. Approval for this increase has been granted by Treasury. The fee for cremating the remains of a person aged under 18 remains nil. The Order also increases the maximum fee that a medical practitioner may charge for completing the medical certificate required by Regulation 6(a) of the Cremation (Jersey) Regulations 1961 from £82 to £100, an increase of 22%. The fees were last increased on 1st January 2017. The Order comes into force on 1st January 2024.
