PROPOSITION
THE STATES are asked to decide whether they are of opinion -
to re f e r to their Acts, dated 30th July 1996 and 9th December 1997, in which they approved the establishment of a
Jersey Law Commission and appointed members, and to appoint the following persons for a period of five years with effect from 8th February 2000 -

LEGISLATION COMMITTEE
REPORT
The States, by Act dated 30th July 1996, adopted a proposition of the Legislation Committee and approved the establishment of a Jersey Law Commission. They also appointed the following persons to act as its Chairman and members -

M r . D a v id Lyons
On 9th December 1997 the States approved the appointment of the following additional Members to the Commission -
A d v o c a te William James Bailhache M r . D a v id Oswald Moon
The Commissioners are mindful of the need to ensure continuity in the work of the Commission and feel that it would be wise to seek the appointment of an additional three Members now to enable them to gain an insight into its current activities and pilot topics before the proposed retirement of Advocate Baker and Jurat Le Boutillier during 2000 and the departure of Advocate Bailhache , who is soon to assume the office of H.M. Attorney General.
The Law Commission has asked that these and all future appointments be made for an initial term of five years, on the understanding that each appointee will be eligible for re-appointment at the end of that term.
The Committee recommends that the following be appointed to serve on the Jersey Law Commission for a period of five years with effect from 8th February 2000 -
A dv o c a te John Gerald Patrick Wheeler
A d v o c a te Wheeler was born in St. Helier, Jersey, in 1949. He was educated at St. Lukes School and De La Salle
College and graduated from University of Essex with a degree in government in 1970. He was called to the Bar (Inner Temple) in 1978 and sworn in as an Advocate of the Royal Court in September 1981. Since that time he has been in private practice; for the last three and a half years as a consultant with Messrs. Le Gallais & Luce .
A d v o c a te Wheeler has been a Crown Advocate since 1995 and his areas of specialisation include Commercial law,
insolvency and criminal law. He was Terms of Employment Officer from 1997-1999 and was appointed as Master of the Royal Court with effect from December 1999.
A dv o c a te Alan Richard Binnington
A d v o c a te Binnington is a Litigation Partner with Mourant du Feu & Jeune . He was born in 1958 and was educated
at St. Catherine's College, University of Cambridge.
H e w a s admitted in 1981 to the English Bar (Middle Temple) and in 1984 to the Jersey Bar. He is a member of the
Editorial Board of the Jersey Law Review and of the International Bar Association and is the Belgian Consul in Jersey. He is also the President of the National Trust for Jersey.
A d v o c ate Binnington is a frequent speaker at seminars and article writer on specialist subjects including
commercial and banking litigation, asset tracing and fraud investigation, fraud on the Internet, the banker's duty of confidentiality, trust litigation and money laundering.
Mr . C liv e Aubrey Charles Chaplin
C liv e C haplin graduated from Nottingham University with an upper second class Bachelor of Arts degree in law in
1974. He subsequently attended the College of Law in Guildford and after two years articles in central London, qualified as an English Solicitor in June 1977. In April 1979, he took up a position at Michael Voisin and Company as an assistant solicitor specialising in unit trusts and other investment funds. He qualified as a solicitor of the Royal Court in June 1985 and became a partner at Michael Voisin and Company.
In A u g ust 1986, he left private practice to take up a position as senior counsel with an international investments
group headquartered in Jersey and later also became the company secretary of the publicity quoted parent. He returned to private practice in October 1994 joining Ogier and Le Masurier as a partner within the business law group and he is now managing partner of that firm.
