In the view of the Legislation Committee the provisions of the Projet de Loi (200-) concernant les serments des Connétable s et des Centeniers are compatible with the Convention Rights.

REPORT

The Legislation Committee's attention was recently drawn to the existing terms of the oaths of Connétable s and Centeniers. The oaths are set out in the Code of Laws of 1771 and have never been the subject of revision.

The existing oath of a Connétable is as follows -

VOUS jurez et promettez, par la foi et serment que vous devez à Dieu, que bien et fidèlement vous exercerez la Charge et Office de Connétable en la Paroisse de

vous garderez et ferez garder la pa Majesté, vous opposant, et saisissant de fait tous Mutins, Séditieux, Larrons, Homicides, et toutes autres personnes qui interrompent le cours de la paix publique, lesquels vous présenterez en Justice pour être punis selon leurs méfaits ; ensemble tous hanteurs de Tavernes, Yvrognes, Paillards, Putains, Blasphémateurs, et tous autres qui contreviennent aux Ordonnances, et Commandemens du Magistrat, lesquelles Ordonnances vous garderez et observerez, ferez garder et observer, autant qu'il vous sera possible ; vous ne souffrirez en votre Paroisse, qu'aucune personne tienne de Taverne, autre que ceux établis et licenciés de tems en tems ; et aurez soin spécial par vous, et par vos Officiers, que le jour du Dimanche ne soit profané, par hantise, ou fréquentation auxdites Tavernes, ou autres lieux, contraire aux Ordonnances sur ce faites, lesquelles vous mettrez en due exécution ; vous chercherez, et ferez cherche toutes fois et quantes qu'il sera nécessaire, ou que vous en serez requis ; notamment vous ferez cherche généralle, une fois en trois mois, en tous lieux et maisons de ladite Paroisse qui vous seront suspectes ; vous conserverez et procurerez autant qu'il vous sera possible, les droits qui appartiennent à ladite Paroisse, vous réglant en ce qui concerne le bien public d'icelle, par l'avis et bon conseil des Principaux, et autres les Officiers de ladite Paroisse ; lesquels Officiers vous assemblerez, ou ferez assembler par le moyen de vos Centeniers une fois le mois pour aviser aux choses dont il seroit besoin concernant ladite Paroisse, et enfin qu'ils aient à déclarer tous malfaiteurs, refractaires, ou désobéissans aux Ordonnances de Justice pour que vous en informiez la Cour, et les Officiers du Roi de tems en tems; vous exécuterez les Mandemens de Monsieur le Gouverneur, ou de Monsieur le Lieutenant Gouverneur, de Monsieur le Bailly, ou de Monsieur son Lieutenant, et de Messieurs de Justice, en ce qui sera de leur Charge respectivement, assistant aux Etats du Pays lorsque vous en serez requis; et de tout ce, promettez faire votre loyal devoir, sur votre conscience.

You swear and promise before God that you will well and faithfully discharge the duties and office of Constable of the Parish of ; you and uphold the Queen's Peace, opposing and arresting all rebels, seditionists, robbers, murderers and all other persons who disturb the public peace, whom you will bring to judgment so that they may be punished according to their misdeeds; likewise with frequenters of taverns, drunkards, loafers, whores, blasphemers and all who disobey the statutes, and commands of the Magistracy, which statutes and commands you will yourself obey and uphold to the best of your ability; you will suffer no person in your Parish to keep a tavern, save those established and licensed from time to time; you and your officers will take particular care that Sundays are not profaned by resort to or frequenting of such taverns outside the hours prescribed by the statutes on these matters which you will enforce; you will carry out searches whenever necessary and whenever you are required so to do; in particular you will carry out a general search, once every three months, of the places and premises in your Parish in which you suspect offences are being committed; you will protect and uphold to the best of your ability the rights appertaining to the said Parish, and as touching the public welfare thereof, you will be guided by the advice and counsel of the Principals and Officers of the said Parish which Officers you will convene either yourself, or through your Centeniers once every month to attend as necessary to the affairs of the Parish, and to the end that they delate all evil-doers, defaulters and all others who disobey the law so that you may inform the Court and the Crown Officers thereof from time to time; you will execute the lawful orders of His Excellency the Governor, or of His Excellency the Lieutenant Governor, of the Bailiff , of his Lieutenant and of the Jurats, and attend the Assembly of the States when it shall be required of you; and all this and your bounden duty you promise upon your conscience to perform.

The Committee has approached this matter on the basis that the antiquity of these oaths is to be respected and that any reform of them is not a matter to be embarked upon lightly. However, the oath taken by the Connétable or a Centenier is a solemn oath which ought properly to reflect that which the Connétable or the Centenier (as the case may be) swears before the Royal Court that he will do. The existing oaths do not reflect accurately the duties of the respective offices.

The proposed revised oath (still in the French language) as set out in the attached projet de loi seeks to adhere as far as possible to the existing oaths and not to undermine in any way the sense of history conveyed by them.

The revised form of oath is designed to reflect the true nature of the rôle of Connétable and Centenier and, amongst other maters, to acknowledge the duty in each case to abide by the directions of Her Majesty's Attorney General as titular head of the Honorary Police.

The proposed revised oaths have been the subject of consultation with the Comité des Connétable s and the Island of Jersey Centeniers Association. Both the Comité and the Association have agreed the proposed revision of their respective oaths.

Financial/manpower implications

There are no financial or manpower implications for the States arising from the adoption of this projet de Loi. European Convention on Human Rights

Article 16 of the Human Rights (Jersey) Law 2000 will, when brought into force by Act of the States, require the Committee in charge of a Projet de Loi to make a statement about the compatibility of the provisions of the Projet with the Convention rights (as defined by Article  1 of the Law). Although the Human Rights (Jersey) Law 2000 is not yet in force, on 6th September 2002 the Legislation Committee made the following statement before Second Reading of this projet in the States Assembly -

Explanatory Note

The purpose of this Loi is to prescribe revised forms of the oaths to be taken by Connétable s and Centeniers.

T H E  ST  ATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law -

ARTICLE 1

In th e C ode of Laws confirmed by Order of His Majesty in Council of the twenty-eighth day of March, 1771 -

(a ) f o r the provisions under the title "Oath of the Connétable s" there shall be substituted the provisions set out in

Schedule  1 to this Law;

(b ) f o r the provisions under the title "Oath of the Centeniers" there shall be substituted the provisions set out in

Schedule  2 to this Law.

ARTICLE 2

T h is L a w may be cited as the "Law (200-) concerning the oaths of the Connétable s and of the Centeniers" and shall come into force on the seventh day after its registration.

"OATH OF THE CONNÉTABLES

You swear and promise before God that you will well and faithfully discharge the duties and office of Connétable of the Parish of ; you will keep a'nsd Pe upahcoe,l do pthpeo sQinuge eannd arresting all those who attempt or commit any manner of crime, délit or contravention whom you will bring to judgment so that they may be punished according to their misdeeds, abiding in this respect by the directions of Her Majesty's Attorney General; you will protect and uphold, to the best of your ability, the rights appertaining to the said Parish, and as touching the public welfare thereof, you will be guided by the advice and counsel of the Principals and Officers of the said Parish which Officers you will convene, or cause to be convened through your Centeniers, regularly to attend as necessary to the affairs of the Parish; you will execute the lawful orders of the Lieutenant Governor, of the Bailiff , of his Deputy and the Judges and Jurats of the Royal Court, attending the States when required to do so; and all this and your bounden duty you promise upon your conscience to perform.".

"OATH OF THE CENTENIERS

You swear and promise before God that you will well and faithfully discharge the duties and office of Centenier of the Parish of ; you will keep and cause to be k'se pPt ethacee ,Q oupepeonsing and arresting all those who attempt or commit all manner of crime, délit or contravention, of whom you shall inform the Connétable , in order that they be brought to judgment to be punished according to their misdeeds, abiding in this respect by the directions of Her Majesty's Attorney General; you will protect and uphold to the best of your ability the rights appertaining to the said Parish, and as touching the public welfare thereof, you will be guided by the advice and counsel of the Principals, of the Connétable and other Officers of the said Parish; you will assist the Connétable to convene the said Officers regularly, and convene them yourself should he require you to do so to attend as necessary to the affairs of the Parish; you will execute the lawful orders of the Lieutenant Governor, of the Bailiff , of his Deputy and of the Judges and Jurats of the Royal Court; and all this and your bounden duty your promise upon you conscience to perform.".
