PROPOSITION

THE STATES are asked to decide whether they are of opinion -

  (a ) to accept the bequest of the late Mrs. Aline May Moyse, née Gosney, widow of Alan Cyril Moyse, to the

public of an equal share with Jersey Hospice Care of the whole of her real property, which consists of the property Banksia, La Chasse Brunet, in the parish of St.  Saviour, on condition that the proceeds of sale of the property be used by the Public of the Island for the benefit of the Oncology Department at the General Hospital and by Jersey Hospice Care for the benefit of Clarkson House, the whole in memory of the late Alan Cyril Moyse;

( b ) to agree that the Public should pay one half of the costs of registration of the will, and of the fees and

disbursements incurred with registration.

Mrs. Aline May Moyse, née Gosney, died on 24th May 2002. By her Will of Real Estate dated 20th February 1997, she left the whole of whatever real property which she might possess or to which she might be entitled at the time of the decease in equal shares to the public of the Island of Jersey for itself and its successors and to Jersey Hospice Care for itself and its successors in perpetuity subject to the payment of all charges which might be due for and on account of such real property and to conform to all clauses, conditions and restrictions relative thereto.

These devices were made on condition that the proceeds of sale of the said real property should be used by the public of the Island for the benefit of the Oncology Department at the General Hospital and by Jersey Hospice Care for the benefit of Clarkson House, the whole in memory of Mrs.  Moyse's late husband, Alan Cyril Moyse.

At the date of her death Mrs. Moyse's real property consisted of the property known as Banksia, la Chasse Brunet, in the parish of St. Saviour.

The Committee has been informed that there are no charges due for and on account of the property.

The Will of Realty will need to be registered and fees and disbursements in connection with the registration will amount to approximately one per cent of the valuation of the property. It is proposed by the lawyers acting for the late Mrs.  Moyse that these costs be borne equally between the public and Jersey Hospice Care.

The Committee recommends that the States accept the generous bequest of the late Mrs. Moyse. There are no revenue or manpower implications to this report.
