European Convention on Human Rights The President of the Legislation Committee has made the following statement -

In the view of the Legislation Committee the provisions of the Projet de Loi (200-) concernant la Police Honorifique de St. Martin are compatible with the Convention Rights.

REPORT

The Parish currently has three Centeniers who are on duty one week in three. A duty week lasts for seven days from 7.30 p.m. on Wednesday until the same time the following Wednesday. During this period the Centenier will deal with all matters referred to him in addition to attending all Court sittings that week for which the Parish has cases listed. This, in particular, can be a heavy responsibility particularly for those who have full-time work commitments in addition to their family responsibilities.

Vingteniers and Constable's Officers in the Parish are rostered in three duty groups but the appointment of an additional Centenier will enable a fourth duty group to be arranged. This will reduce the burden on all officers and bring the frequency of duty weeks more into line with those for other Parishes.

The approval of the post of a fourth Centenier will ease the pressure on those elected to this office, particularly when officers may be out of the Island on holiday or for business commitments, and to cover periods of sickness. The reduced burden may also encourage others to stand for office and will make it easier to retain proven officers. It is not thought that there will be any problem in recruiting suitable candidates.

The States have recently approved an increase to four Centeniers for each of the Parishes of Trinity , St. Lawrence, St.  Mary and St. John. The proposed increase to four Centeniers for St.  Martin has no implications for the financial or manpowe resources of the States.

European Convention on Human Rights

Article 16 of the Human Rights (Jersey) Law 2000 will, when brought into force by Act of the States, require the Committee in charge of a Projet de Loi to make a statement about the compatibility of the provisions of the Projet with the Convention rights (as defined by Article 1 of the Law). Although the Human Rights (Jersey) Law 2000 is not yet in force, on 17th January 2002 the Legislation Committee made the following statement before Second Reading of this projet in the States Assembly -

T H E  ST  ATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law -

ARTICLE 1

T h e n u m ber of Centeniers for the parish of St. Martin is increased to four. The term of office of the new Centenier shall be of the same duration as that of the existing Centeniers; he shall have the same duties to perform and the same rights as the latter.

ARTICLE 2

T h is L a w may be cited as the "Law (200-) concerning the Honorary Police of St. Martin".

  L e n o m  bre des Centeniers de la paroisse de St.  Martin est porté à quatre. La gestion du nouveau Centenier aura la même durée que celle des Centeniers actuels; il aura les mêmes devoirs à remplir et les mêmes droits que ces derniers.

ARTICLE 2

L a p r é s ente Loi pourra être citée sous le titre de "Loi (200-) concernant la Police Honorifique de St. Martin".
