PROPOSITION

THE STATES are asked to decide whether they are of opinion

to re - appoint Mr.  Timothy Dunningham as Chairman of the States Audit Commission for a further period

of 3 years.

REPORT

The States will recall that at the meeting held on 17th July 2001, they approved the appointment of Mr.  Timothy Dunningham as Chairman of the States Audit Commission for a period of 24  months with immediate effect. Therefore Mr.  Dunningham's term of office expires on 17th July 2003.

This  would  complete  a  3-year  term  of  office  for  Mr.  Dunningham,  the  States having  previously  appointed Mr.  Dunningham for an interim 12-month term on 2nd May 2000 after the resignation of Senator Christopher Lakeman on his election to the States.

The future of the Audit Commission is dependent on the timing of changes included in machinery of government reforms. These include the appointment of an Auditor-General and the introduction of a Public Accounts Committee which would, in effect, replace the Audit Commission. There is currently no firm timetable for these changes.

Consequently, the States needs, on the recommendation of the Finance and Economics Committee, to either appoint a new Chairman for the States Audit Commission, or approve a further extension to the term of the current Chairman until such time as any new arrangements are implemented.

The terms of reference for the Commission provide for the Chairman's term of office as "for up to three years" (as amended in 2000).

On the assumption that the proposed Reforms of the Machinery of Government will be implemented within the full term provided for within the States Audit Commission's terms of reference, the Finance and Economics Committee requests that the States reappoint Mr.  Timothy Dunningham as Chairman of the Audit Commission for a further period of 3  years although it is recognised, and agreed by Mr.  Dunningham, that this period would b curtailed if the new arrangements come into force before the end of the 3-year period.

There are no additional financial or manpower implications for the States arising out of this proposition. _______________________________________________________________
