THE STATES are asked to decide whether they are of opinion
in a c cordance with Article 3(1)(a) of the Competition Regulatory Authority (Jersey) Law 2001, to re-
appoint Dr. Patrick Anthony McNutt as a member and Chairman of the Jersey Competition Regulatory Authority for a period of 3 years with effect from 17th May 2004.
ECONOMIC DEVELOPMENT COMMITTEE
REPORT
- T h e States approved the Competition RegulatoryAuthority (Jersey) Law 2001 inNovember2000.It received Royal Assenton 14th March 2001and came into force on 1stMay2001.
- U n der Article 3(1)(a) it isfor the States to appoint onemember of the Authorityas its Chairman upon the recommendationof the EconomicDevelopmentCommittee.
- U n der Article 4(2) a member shall beappointedfor a period not exceeding 5 yearsand upon expiry of such period shall be eligible for reappointment.
- D r . Patrick AnthonyMcNuttwas appointed as thefirstChairmanof the Authority with effect from 17th May2001. Dr. McNutt's current term of office as memberandChairman expires on 17th May 2004.
- D r . McNuttwas formerly Professorof Political Economyat the University of Ulster and, from 1995- 2000, wasthesecondChairmanof the Irish Competition Authority. Heis a leading authorityonEuropean competition policy with direct experienceof independent regulation of the kind now in the frame for Jersey undertheaegisof the JCRA. A short curriculum vitaeforDr.McNutt is attached.
- T h e Appointments Commission has previously indicated that they wouldwishto take anactive role in the recruitment process in respect of senior posts at the JCRA.Following consultation, the Chairmanof the Appointments Commission has agreed that it is appropriate for the Committee to recommend the reappointmentof the current Chairmanfor a further term withouthavingtoundertake a recruitment process. TheAppointments Commission will require the position toundergo a recruitment processat the end of the secondterm.
- A c cordingly, the EconomicDevelopmentCommitteerecommends that the Statesappoint Dr. McNuttas a memberandChairmanof the Jersey Competition Regulatory Authorityfor a further period of threeyears commencingon 17th May2004.
- T h ere are no additional manpowerorfinancialconsequences arising from this proposition.
