PROPOSITION

THE STATES are asked to decide whether they are of opinion

to a p point, in accordance with Article 6C of the Island Planning (Jersey) Law 1964, as amended, on the

recommendation of the Minister for Planning and Environment, the following persons as members of the Planning Applications Panel with immediate effect for a period of 3 years

(a ) T h e Connétable of St. Peter as a member;

(b ) T h e Deputy of Trinity as a member;

(c ) T h e Connétable of St. Saviour as a reserve member; (d ) T h e Connétable of St. Helier as a reserve member.

MINISTER FOR PLANNING AND ENVIRONMENT

REPORT

The States recently agreed, by amending the Island Planning (Jersey) Law 1964, that a Planning Applications Panel should be appointed. As its name implies, its primary purpose is to determine planning applications, and to that extent it replaces the Planning Sub-Committee which has performed this function since 1996.

The Amendment to the Law (L.34/2005) was registered in the Royal Court on Friday 16th December 2005.

When the Planning and Building (Jersey) Law 2002 is introduced, hopefully in April 2006, the Panel's meetings will be held in public.

The Law provides that the Panel should comprise 3 States members and that it will be chaired by an Assistant Minister, appointed by the Minister for Planning and Environment, with the agreement of the Chief Minister. The Panel will be chaired by the Assistant Minister for Planning and Environment and the Connétable of St. John.

The other 2 members, together with 2 reserves, will be appointed by the Minister, after he has nominated them to the States, and the States has agreed the nominations.

Nominations can only be made by the Minister. If the States rejects his nomination, the Minister has to nominate another States Member, and so on, until all the vacancies are filled. The Law provides that the period of membership of a Panel member is 3 years.

The Connétable of St. Peter and the Deputy of Trinity have agreed to serve as Panel members, and the Connétable s of St. Saviour and St. Helier as reserve members of the Panel, if the nominations are successful.

The 3 Connétable s have prior experience of serving on the former Island Development, Planning and Environment, or Environment and Public Services Committee.
