PROPOSITION

THE STATES are asked to decide whether they are of opinion

t o ap point, in accordance with Article 9C of the Planning and Building (Jersey) Law 2002 on the

recommendation of the Minister for Planning and Environment, the following persons as members of the Planning Applications Panel with immediate effect for a period of 3 years

(a ) th e Connétable of St Peter as a member;

(b ) th e Deputy of Trinity as a member;

(c ) th e Connétable of St. Saviour as a reserve member; (d ) th e Connétable of St. Helier as a reserve member.

REPORT

The States agreed, in 2005, by amending the Island Planning (Jersey) Law 1964 and the Planning and Building (Jersey) Law 2002, that a Planning Applications Panel should be appointed. As its name implies, its primary purpose is to determine planning applications. The Panel has met regularly since the start of 2006.

I am advised that with the coming into force of the Planning and Building (Jersey) Law 2002, it is necessary for me, under the requirements of the Law, to nominate a "new" Panel.

The Law provides that the Panel should comprise 3 States members and that it will be chaired by an Assistant Minister, appointed by the Minister for Planning and Environment, with the agreement of the Chief Minister. The Panel has been and will continue be  chaired by the Assistant  Minister for  Planning and  Environment,  the Connétable of St. John.

The other 2 members, together with 2 reserves, will be appointed by the Minister, after he has nominated them to the States, and the States has agreed the nominations.

Nominations can only be made by the Minister. If the States rejects his nomination, the Minister has to nominate another States' member, and so on, until all the vacancies are filled. The Law provides that the period of membership of a Panel member is 3 years.

The current Panel has been particularly effective, and comprises the Connétable of St.  Peter and the Deputy of Trinity as Panel members, and the Connétable s of St.  Saviour and St. Helier as reserve members of the Panel. Each has agreed to continue in this role should my nomination of them be successful.
