PROPOSITION

THE STATES are asked to decide whether they are of opinion

to appoint, in accordance with the provisions of Article 18(2) of The Law Society of Jersey Law 2005, Mrs. Margaret Ann Rondel as a lay member of the Law Society Disciplinary Panel for a period of 5 years.

REPORT

The States approved the Law Society of Jersey Law and agreed that the Law Society should be formally incorporated as a public body in 2005. The Disciplinary Panel was established in order to deal with complaints of professional misconduct by members of the legal profession who are practitioners of the Royal Court. The Panel's remit, therefore,  does  not  extend  to  English  barristers  or  solicitors,  nor  to  professional lawyers registered in other jurisdictions. On 6th December 2006, the States approved The Law Society of Jersey Law 2005 (Appointed Day) Act 2006, the main purpose of which was to bring into force on 1st January 2007 the provisions of the Law Society of Jersey Law 2005.

The framework for the Disciplinary Panel was established by the States in 2005 when it approved the Law Society of Jersey Law. In accordance with Article 18(1) of the Law, the Panel consists of up to 7 lay members, together with 4 members of the legal profession. Complaints against legal practitioners are submitted to the President of the Law Society and, in those cases where the President is satisfied that a complaint should be investigated; the matter will be referred to a Disciplinary Committee, which will consist of 3 members of the Disciplinary Panel.

Following the resignation of a lay member of the Panel, it is now necessary for the States to appoint a new member. A recruitment exercise has been undertaken and I am pleased to be able to nominate Mrs. Margaret Ann Rondel as a lay member of the Law Society Disciplinary Panel for a period of 5 years with effect from the appointment by the States.

There are no financial or manpower implications for the States arising from this proposition.

Margaret Ann Rondel

Mrs. Rondel is Regional Head of Compliance, Money Laundering Reporting Officer and Deputy Money Laundering Compliance Officer at Ansbacher (Channel Islands) Limited.

She has a BSc (Hons) in Financial Services, a City and Guilds Unit Credit Certificate towards  Teaching  Practice  Stage  One  Further  and  Adult  Education  Teachers' Certificate, an International Diploma in Anti-Money Laundering and an International Diploma in Compliance.

She is also an Associate Member of the Chartered Institute of Bankers, a Fellow of the International Compliance Association and a Full Member of the Society of Trust and Estate Practitioners.

Mrs. Rondel has over 20 years of experience in the financial services sector, and has strong working relationships with the Jersey Financial Services Commission and the Joint Financial Crimes Unit. She also spent several years as a lecturer and exam-setter and moderator at Highlands College.
