PROPOSITION

THE STATES are asked to decide whether they are of opinion

to  request  the  Minister  for  Economic  Development  to  bring  forward  for approval legislation to provide that 25% of any fines levied in relation to breaches of gambling and gaming legislation in Jersey should be remitted to the Association of Jersey Charities for onward distribution to charitable causes in Jersey.

REPORT

On 20th July 2011, the States approved the Draft Gambling (Jersey) Law 201-. During the debate, the Minister proposing the Law informed members that any fine levied in relation to breaches of gambling and gaming legislation would be deposited into the Consolidated Fund. I believe 25% of those funds should go to the Association of Jersey Charities. I am informed by the Economic Development Department that there has been no fine income for at least 10 years, and it is not anticipated that there is likely to be any under the new legislation. However, should any breaches occur, this proposition will ensure that part of the proceeds go to a good cause.

Financial and manpower implications

There are no financial or manpower implications arising from this proposition, other than are apparent from the Report above.
