COMMENTS

The Minister's statutory powers enable him to grant a license when it is in the public interest to do so and then only for research and special purposes. The Law envisages that such a licence will be used, inter alia, by medical practitioners to conduct medical trials and provides patients with controlled drugs. The Law does not provide for the Minister to step into the shoes of a doctor and, in effect, take clinical decisions in respect of an individual case. It follows that the Minister does not have the power to grant the licences that are requested in this proposition.
