PROPOSITION
THE STATES are asked to decide whether they are of opinion
to request the Minister for Planning and Environment to withdraw his appeal against a decision of the Royal Court which ruled against the development planned around Keppel Tower, Grouville .

REPORT
The Minister for Planning and Environment is asked to stop his pursuit in challenging a decision of the Royal Court which Mrs. Mary Herold was successful in challenging against the development around Keppel Tower, Grouville .
It should be noted that if the Minister is successful in his appeal, the developer will automatically gain permission to build the 17 luxury flats. A development which this Community expressed in 2 parish meetings, in letters to the Planning Department and representations to the Minister for Planning and Environment, in that they did not feel this development was best suited to this area of unique character and coastline. It was felt that this development was inappropriate in scale, height and design for the site and particular area of our coastline. The development does not take into consideration the listed buildings of the area.
I also ask the Minister to stop wasting taxpayers' money in officer time, Court time and legal fees, to pursue this misguided appeal.
If the Minister requires that certain elements of the Island Plan be clarified, then it is within his scope to table an amendment to his own document.
And finally, I ask him to stop having papers served on a senior citizen who has successfully won 2 Court Appeals against this development, whilst trying to preserve the integrity of her own property, which was given listed status by his own department.
Financial and manpower implications
If this proposition is adopted it will avoid the Court costs associated with a Royal Court Appeal. There are no manpower implications.
