PROPOSITION

THE STATES are asked to decide whether they are of opinion

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999, to appoint the following persons as members of the Jersey Police Complaints Authority for a period of 3 years, commencing on 1st January 2017 –

Mrs. Rachel Catchpole Mr. Matthew Swan.

Jersey Police Complaints Authority ("JPCA") membership

Article 1(1) of the Schedule to the Police (Complaints and Discipline) (Jersey) Law 1999 stipulates that the JPCA shall consist of a Chairman and not less than 6 or more than 8 other members.

The current membership of the JPCA is

Appointed 2nd February 2016 for 3 years (P.158/2015) Advocate D. Prosser (Chairman)

Appointed 10th March 2015 for 3 years (P.15/2015) Mr. D. Baxter

Miss A. Binnie

Mrs. G. McCourt

Ms. D. Sebire

Appointed 12th April 2016 for 3 years (P.21/2016)

Mrs. D. Taylor -Cox.

P.104/2016

The States approved P.104/2016 on 1st November 2016 to appoint Mr. Howard Cooper as Chairman of the JPCA with effect from 1st January 2017. Mr. Cooper's appointment as Chairman leaves 6 members of the Authority still in office at 1st January. As outlined above, the Police (Complaints and Discipline) (Jersey) Law 1999 allows for 2 more members of the Authority to be appointed.

New members

A recruitment process for 2 new members of the Authority was undertaken by the JPCA earlier this year, in parallel with the recruitment for a new Chairman. The process resulted in Mrs. Catchpole and Mr. Swan being offered positions on the Authority, subject to the agreement of the States Assembly.

These recommended appointments have been approved by the Jersey Appointments Commission.  Accordingly,  the  Minister  for  Home  Affairs  recommends  that Mrs. Catchpole and Mr. Swan be appointed to serve as members of the Jersey Police Complaints Authority for a period of 3 years, commencing on 1st January 2017.

Biographies

Mrs. Rachel Catchpole

Mrs. Catchpole graduated from UCL in 2001 with an LLB in law before attending the Inns of Court School of Law in London. Following the completion of a 2-year training contract, she qualified as a solicitor in 2004. Mrs. Catchpole practiced law at a major international law firm for 8 years, where she specialised in international arbitration,

predominately in relation to multi-million-dollar construction and energy projects. She moved to Jersey with her husband in 2012 and currently works as a freelance legal consultant.

Mr. Matthew Swan

Mr. Swan qualified as a Jersey advocate in 1999. He recently retired in 2015 as a partner of Ogier, having been managing partner of the Jersey law firm and head of the Banking and Finance Team. He has qualified as an English solicitor and a Cayman attorney. He is a Commissioner of the Jersey Gambling Commission, a member of the Board of Examiners  for  the  Jersey  advocates'  and  solicitors'  examination,  and  is  actively involved in the Jersey Citizen's Advice Bureau.

Financial and manpower implications

The posts are honorary, although reasonable expenses can be claimed.

There are no additional financial or manpower implications for the States arising from this proposition.
