PROPOSITION
THE STATES are asked to decide whether they are of opinion
to agree, in accordance with the provisions of Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, that all monies standing to the credit of the Channel Islands Lottery (Jersey) Fund which have not already been set aside by the Minister (representing 100% of the total Jersey portion of the proceeds of the Channel Islands Lottery for 2016) should be paid to the Association of Jersey Charities for the benefit of the local community and the charitable needs of the Island.

REPORT
The proceeds from sales of all Channel Islands Lottery tickets in 2016, according to the provisions of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, are to be applied "in such manner and for such purposes of public benefit as the States shall from time to time by Act direct". It is the Minister's recommendation to the States that 100% of these funds are granted, subject to the signing of a Service Level Agreement, to the Association of Jersey Charities ("AJC"). Work will be undertaken during 2017 by the Economic Development, Tourism, Sport and Culture Department towards examining the feasibility of a mechanism to ensure that lottery proceeds are accessible to a range of community organisations who will not be registered charities once the Charities (Jersey) Law 2014 is brought fully into force.
The AJC undertakes a valuable function by considering and allocating funding to its membership on the basis of need. In doing so, the AJC fulfils a vital role in Jersey society.
Inter alia, the Service Level Agreement will make the following requirements of the AJC –
To allocate lottery proceeds, on the basis of need, to voluntary and community sector organisations. This will include allocating a designated proportion of those proceeds to any organisations that are in possession of charitable tax exemptions from the Comptroller of Taxes in Jersey, and which meets certain eligibility criteria in relation to standards of governance appropriate to their activities.
To utilise a proportion of the lottery proceeds to provide a development support programme to voluntary and communication sector organisations.
To review, and keep under review, their grant-making criteria and process to ensure that they are fit for purpose.
Collective responsibility under Standing Order 21(3A)
The Council of Ministers has a single policy position on this proposition, and as such, all Ministers, and the Assistant Ministers for Economic Development, Tourism, Sport and Culture, are bound by the principle of collective responsibility to support the proposition, as outlined in the Code of Conduct and Practice for Ministers and Assistant Ministers (R.11/2015 refers).
Financial and manpower implications
Subject to the States' approval, and the signing of a Service Level Agreement, 100% of the Jersey proceeds from the Channel Islands Lottery in 2016 (£1,250,482) will be transferred as soon as is reasonably practicable to the Association of Jersey Charities.
There are no financial or manpower implications for the States arising from this proposition.
